Because of the existing slope of your land and the siltation ponds you plan on adding, we would like you to grade a permanent ditchline down your drive and down the old road alongside the bank and connect them to the siltation ponds. The grade of the road shall be such that all runoff will flow into the ditchlines. Inside the ditchlines you will need to use a combination of rock wall check dams and hay bales. (see attached examples) 2. As long as the grade of each road keeps the runoff away from the bluff a filter fabric fence will not be necessary. 3. The ditchline alongside the bluff and pond 'A' we want to remain as a permanent protection of the bluff and fish and wildlife habitat areas. Your engineer should submit a copy of your Erosion Control Plan with these added ditchlines and rock wall check dams to the Public Works Department. Your plan will then be approved for construction. When the construction of these facilities is complete I will plan on visiting the site again to take a look at your system. If you have any questions please do not hesitate to contact me at 379-4450. There exists well established lawns and flower gardens to buffer the area between new home construction limits and adjoining waterways . Site grading for the new home is minimal, requiring less than 100 CY of excavation for the foundation. The existing driveway will also serve the new home . Best management practice for control of potential erosion resulting from excavation for the foundation of the new home will be as follows : 1 . All ground cleared by excavation will be replanted with Dutch clover or other suitable ground cover. 2. Runoff will be directed down existing driveways where rainwater will be ponded to allow sedimentation to filter out . 3. Ponding and/or water velocity will be controlled using a series of straw bales or other suitable material . See notes A and B on attached drawing for location. 4. Jefferson County Permit Center November 23 , 1994 621 Sheridan Port Townsend WA 98368 (206) 385-4463 FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE Critical Area Review Case No: CAR94-0153 Date Received: 11/03/94 Applicant WILLIAM DUESING Mailing Addr: 2510 BEE MILL RD BRINNON WA 98320 Project Description: septic Site Address: 2510 BEE MILL RD BRINNON, WA Legal Description: Subdivision Block Lot S-T-R: 07-26-01 W Parcel # 601072010 FINDINGS In accordance with the authority provided under subsection 4. 101 and the requirement contained in Subsection 5.402 of the Jefferson County Interim Critical Areas Ordinance, the Critical Areas Administrator enters the following findings of fact relating to the referenced application: 1) The application was reviewed by Jefferson County Permit Center staff on 11/04/94 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: fish and wildlife habitat area. 2) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 11/08/94 and confirmed the existence of the following critical areas and/or their associated buffers on the property: fish and wildlife habitat area. 3) A site visit was conducted by County staff on 11/08/94 and verified that the subject property is adjacent to Quilcene Bay, an important fish and wildlife habitat area, including shellfish. The fish and wildlife habitat area is entirely associated with the shoreline. 4) The minimum buffer required for fish and wildlife habitat associated with the shoreline is 30 feet. The purpose of the minimum buffer is to reduce the impact of development along the immediate shoreline. The proposed development area for both septic and building site, is not located within the fish and CAR94-0153 wildlife habitat area. 5) However, when applicant cleared the development site, excess soil was graded down a slope toward the water within the fish and wildlife habitat area buffer. While the slope is moderate, there is clear evidence of erosion occuring from sheet flow across the disturbed soils. Small washes have created channels through the loose soils. These channels lead directly to the shoreline, Quilcene Bay and the shellfish habitat. 6) Fish and wildlife habitat buffers along shorelines are required to remain naturally vegetated to minimize impacts to water quality which may occur during construction and to provide wildlife habitat. Quilcene Bay is an important shellfish fishery habitat and needs to be protected from silted run-off caused by land clearing. The placement of loose soil on a slope leading down and through the fish and wildlife habitat area buffer is considered to be an improper activity according to the Ordinance. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the applicant complying with the following conditions. Any deviation from these conditions shall result in this waiver being revoked by the Critical Area Administrator and the application becoming subject to further review under the Interim Critical Areas Ordinance. CAR94-0153 Page: 3 CAR94-0153 WILLIAM DUESING CONDITIONS OF APPROVAL 1) A minimum buffer of 30 feet shall be maintained for the fish and wildlife habitat area associated with the shoreline. This buffer shall be measured from the beginning of the vegetation line along the shore for a distance of 30 feet landward. 2) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No additional soil or other fill is allowed within the buffer area. 3) No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the Critical Area Administrator. 4) Applicant is required to submit a "Small Parcel Drainage and Erosion Control Plan" to the Jefferson County Department of Public Works. Since land disturbing activity has already occurred and erosion appears to be an immediate problem, the applicant shall contact the Department of Public Works to decide what best management practices, if any, are required during the current construction stage. This is required to protect water quality in Quilcene Bay. 5) The applicant shall fully implement the provisions of the submitted Drainage and Erosion Control Plan, and contact the Jefferson County Public Works Department to arrange a schedule of inspection for plan compliance. (Applicant will be charged $35. 00 per hour for plan review and site inspection) Implementation of the full plan is not required until the construction phase on the proposed home is underway. However, the applicant shall immediately implement any interim mitigation measures that the Department of Public Works deems necessary to protect the water quality of run-off entering Quilcene Bay. Applicant shall inform the Department of Public Works of the plans to demolish current residence, and address any relevance this may have to the completed small parcel erosion control plan. 6) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application. 7) This waiver is good for both the current septic permit and a future building permit as long as the above conditions are fully met. However, the current septic permit shall be held until the Department of Public Works notifies the Permit Center that the interim measures necessary to mitigate the present erosion problem are in place. The future building permit shall be withheld until the full "Small Parcel Erosion Control Plan" is implemented and checked for compliance.
