HomeMy WebLinkAboutBLD1995-00174 • Jefferson County Permit Center April 14 , 1995 621 Sheridan Port Townsend WA 98368 (360) 379-4463 FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE Critical Area Review Case No: CAR95-0049 Date Received: 04/10/95 E V E l U Applicant : NOEL WILLIAMS APR 18 NM Mailing Addr: PO BOX 500 INDIANOLA WA 98342 JER P,MN Y H P T trig€ITER Project Description: Site Address: 110 N BEACH DR PORT LUDLOW, WA 98365 Legal Description: Subdivision BRIDGEHAVEN DIV 7 Block Lot 31 S-T-R: 16-27-01 E Parcel # 935700030 FINDINGS In accordance with the authority provided under subsection 4 .101 and the requirement contained in Subsection 5. 402 of the Jefferson County Interim Critical Areas Ordinance, the Critical Areas Administrator enters the following findings of fact relating to the referenced application: 1) The application was reviewed by Jefferson County Permit Center staff on 04/12/95 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: fish and wildlife habitat area. 2) Acting upon the above information, Jefferson County staff conducted additional review of the subject property on 04/14/95 and confirmed the existence of the following critical areas and/or their associated buffers on the property: fish and wildlife habitat area. 3) County staff reviewed the submitted application and called the applicant on 04/14/95 regarding the setback from the shoreline. Applicant's neighbor to the north is 24 feet 2 inches from the top of the bulkhead. Based on subsection 5.160 of the Shoreline Management Master Program, the applicant may average the required setback (30 feet) with his neighbor's (24 feet 2 inches) . Based on this provision, applicant's setback is 27 feet. 4) Fish and wildlife habitat areas along the shoreline normally require a 30 foot setback, however, the reduced CAR95-0049 • setback of 27 feet based on the shorelines setback is considered adequate in this instance. The fish and wildlife buffer is presently vegetated with grasses and does not exist in a natural condition. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the applicant complying with the following conditions. Any deviation from these conditions shall result in this waiver being revoked by the Critical Area Administrator and the application becoming subject to further review under the Interim Critical Areas Ordinance. CAR95-0049 .,4 • Page: 3 CAR95-0049 NOEL WILLIAMS CONDITIONS OF APPROVAL 1) A minimum set-back of 27 feet shall be permanently maintained as a fish and wildlife habitat area buffer associated with the shoreline. This buffer shall be measured perpendicularly from the ordinary high water mark along the shoreline (the top of the bulkhead wall) . 2) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the Critical Area Administrator, however, since the buffer currently exists in a degraded condition, applicant is encouraged, though not required, to enhance the buffer through additional plantings. 3) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the Canty (i.e. adjusted to 27 foot setbacl ) as part of the triggering permit application. Applicant shall be responsible for contacting and notifying contractor(s) of the above conditions in order to ensure compliance at various stages of c struetion/development.
