process (SUB94-0019) . However, a new plot plan was submitted by
Mr. James C. Tracy, applicant's representative via fax on
05/30/95. The new plot plan indicates that due to site
constraints, the new mobile home would encroach on the buffer by
25 feet for a distance equal to the length of the mobile home
(56 ft) . This encroachment would be equivalent to 1400 square
feet.
5) Based on the conversation which staff had with Mr. Tracy on
06/02/95, staff learned that a strip of natural vegetation
exists along the river bank but that the area to the west of
the existing out-buildings is cleared and is used as a parking
area. Staff explained that this site was not field-checked, and
that existing cleared areas within buffers are allowed to
remain in their present condition. However, regarding the 1400
square feet of encroachment by the mobile home, this area can
be added to the buffer elsewhere on the property if feasible.
Buffer averaging is allowed under subsection 10. 510 of the
Ordinance as long as the buffer is not reduced by more than
50%. Applicant's proposal would be a 25% buffer reduction.
This waiver from the provisions of the Jefferson County
Interim Critical Areas Ordinance is granted subject to the
applicant complying with the following conditions. Any
deviation from these conditions shall result in this waiver
being revoked by the Critical Area Administrator and the
application becoming subject to further review under the
Interim Critical Areas Ordinance. Please sign and return to
