HomeMy WebLinkAboutBLD1995-00289 Jefferson County Permit Center December 22 , 1995 621 Sheridan Port Townsend WA 98368 (360) 379-4463 FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE Critical Area Review Case No: CAR95-0081 Date Received: 05/30/95 Applicant ROBERTA BLINDER Mailing Addr: 2008 YACHT RESOLUTE NEWPORT BEACH CA 92660 Project Description: single family residence Site Address: 363 VICTORIA LOOP PORT TOWNSEND, WA 98368 Legal Description: Subdivision CAPE GEORGE COLONY DIV 1 Block 1 Lot 21 S-T-R: 12-30-02 W Parcel # 937800121 FINDINGS In accordance with the authority provided under subsection 4 . 101 and the requirement contained in Subsection 5.402 of the Jefferson County Interim Critical Areas Ordinance, the Critical Areas Administrator enters the following findings of fact relating to the referenced application: 1) The application was reviewed by Jefferson County Permit Center staff on 06/09/95 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: landslide hazard area, fish and wildlife habitat area. 2) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 06/15/95 and confirmed the existence of the following critical areas and/or their associated buffers on the property: landslide hazard area, fish and wildlife habitat area. 3) County staff reviewed this application and found that a geotech report has previously been prepared for the site and was conducted by Northwest Territories, Inc. of Port Angeles. This report is entitled "Bluff and Property Evaluation of Lot 21, Cape George Colony" and was prepared for Viola Sanders by NTI in April 1990. 4) The "Conclusions and Recommendations" setion of this report read as follows: item #4 reads "To maximize longevity, any permanent home should be constructed as far back away from the CAR95-0081 bluff edge as possible. This expedient should provide an approximate 100 foot buffer zone between the house and bluff edge; " item #5 reads "Any home constructed as close as 50 feet from the bluff edge should consider one of modular or similar design that could be relatively easily moved if required. " 5) The applicant has submitted plans which show the nearest corner of the proposed home to be within 70 feet of the top of the bluff. The proposed home is designed to be built upon posts so that it may be moved from site if bluff conditions threaten safety, welfare, or property. 6) According to Subsection 9 . 402 . 2, constructing the home on posts to make it possible to move the structure if necessary, is considered an appropriate mitigating measure as outlined in the recommendations of the geotech report completed by Northwest Territories, Inc. 7) In the opinion of staff, these bluffs remain unstable and may be subject to a catastrophic slide. Staff believes that ground water may be a significant factor in the destabilization of this slope. This factor was not not mentioned in the accompanying NTI report. In addition, the potential for an earthquake of a high magnitude occuring in western Washington in the near future is considered to have a high probability factor by regional experts. 8) The fish and wildlife habitat area is entirely associated with the shoreline. The minimum buffer for fish and wildlife habitat area along the shoreline is 30 feet as measured from the beginning of the vegetation line along the beach. In this instance, the required fish and wildlife habitat area buffer is entirely contained within the landslide hazard area and its associated buffer and needs no additional consideration. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the applicant complying with the following conditions. Any deviation from these conditions shall result in this waiver being revoked by the Critical Area Administrator and the application becoming subject to further review under the Interim Critical Areas Ordinance. CAR95-0081 Page: 3 CAR95-0081 ROBERTA BLINDER CONDITIONS OF APPROVAL 1) A setback (buffer) of 70 feet shall be permanently maintained from the top of the landslide hazard area. All buffers shall be measured perpendicularly from the top of the landslide hazard area. 2) Landslide hazard areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator. 3) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application. Applicant shall be responsible for contacting and notifying contractor(s) of the above conditions in order to ensure compliance at various stages of construction/development.
