As a result of Recreation and Conservation Funding Board funding approval via Resolution #2015-07 for RCO
project #14-1395 [Aquatic Lands Enhancement Account and RCO Recreation Grant — Trails], the following
sections of the project agreement are modified by this amendment:
• Section C. Project Description.
• Section F. Project Funding, of the Project Agreement, is modified with funding from approved project #14-
1395 as described in the table below.
• Section I. Special Conditions, of the Project Agreement, modify condition 2 and add condition 3.
• Eligible Scope Activities Report

Agreement Description
Jefferson County will use this grant to construct a 3/4 -mile section of the Olympic Discovery Trail and restore estuary
and marine riparian habitat at Discovery Bay, Jefferson County. The constructed trail will be a 10' wide, paved, multiuse
trail extending from Old Gardner Road south to Salmon Creek. The project will also restore approximately 30 -acres of
nearby and adjacent shoreline by removing a railroad trestle, industrial fill, shoreline armoring, a defunct tide gate, and
part of an old railroad grade; clean 2 -acres of beach; and create a 1 -acre estuary where an artificial, freshwater pond
now exists. Interpretive signing and kiosks is also a component of the project. The project supports both outdoor
recreation and habitation conservation at Discovery Bay.

Special Conditions
1. Special Condition for EO 05-05 Exemption due to Sect 106:
This project is subject to the National Historic Preservation Act, Section 106, and therefore appears to be exempt from
Governor's Executive Order 05-05 Archaeological and Cultural Resources (EO 05-05) as described in Section 9 of this
project agreement. In order for this project to be exempt from EO 05-05, the Section 106 Area of Potential Effect (APE)
must include all ground -disturbing activities subject to this project agreement, including any staging area. The sponsor is
encouraged to work with the federal permitting agency to align the Section 106 APE with the scope of work subject to
this project agreement. If the APE does not include all ground -disturbing activities subject to this project agreement,
promptly notify the RCO grant manager, as this will require RCO to initiate cultural resources consultation following EO
05-05 for those activities not included in the federal APE. Completion of this consultation and a Notice to Proceed from
RCO will be required before these ground -disturbing activities can begin.
2. Special Condition for Control and Tenure Requirements:
1) Washington State Department of Transportation Right of Way:
The RCO and the Sponsor acknowledge that the Washington State Department of Transportation (WSDOT) lease
for trail right of way (number TR -03-13571) does not conform to the RCFB's Control and Tenure Policies because it
does not meet the minimum required 25 year term. RCO is waiving the Control and Tenure requirements of Section
22 B of this agreement for this project located on (WSDOT) non -sponsor owned land. Therefore, as conditions of
this agreement:
a) The Sponsor shall not begin construction of the project within the leased area, nor be reimbursed by RCO for
project expenses, until the WSDOT lease is executed and received and accepted by RCO.
b) Should the WSDOT lease be terminated or the leased property be used for purposes that restrict, limit or
preclude recreational trail use of the project area prior to 25 years after RCO's final reimbursement for the
project, the leased land will be deemed a conversion under and subject to Section 23 of the Standard Terms and
Conditions of this agreement and the Sponsor will be responsible for remedying the conversion following RCFB
policies and procedures.
2) Washington State Department of Fish and Wildlife Right of Wad
The Sponsor has not met RCO's control and tenure requirements per Section 22 B of this agreement for property
owned by the Washington State Department of Fish and Wildlife. No requests for reimbursement be made
expenditures related to project work on Washington State Department of Fish and Wildlife property until RCO's
control and tenure requirements are met.
3. Special Condition for Submitting Electronic Shape File:
Upon completion of the project and before final reimbursement, the sponsor shall provide RCO with an electronic shape
file depicting the trail and/or trailhead constructed with RCO grant assistance for inclusion into Washington State's Trail
Database.

Statement of Issue:
Through this Amendment to Project Agreement, the Recreation Et Conservation Office (RCO)
has consolidated three existing grants for the Discovery Bay Shoreline Restoration Et Trail
Construction. The three existing grants are the 2012 ALEA, the 2014 ALEA, and the 2014 RRG.
Analysis/Strategic Goals/Pro's Et Con's:
This Amendment to Project Agreement is intended to reduce paperwork and save time.
Fiscal Impact/Cost Benefit Analysis:
There are no changes to the funding amounts of the grants associated with this Amendment of
Project Agreement.
Recommendation:
Sign and return 3 copies of the attached RCO Amendment of Project Agreement to Public
Works. One completed agreement will be returned to the BOCC.
