Week of April 18, 1983
The meeting came to order at 10:00 a.m. All members were
present.
Proposed Revision to Sportsmen's Club Lease: Bob Ricketts told
the Board that the 60 -day termination notice c ause in the new lease,
which was not a part of the old lease, is not satisfactory to the Club
because the improvements made by the Club could be in jeopardy.. -.improve-
ments are made on the assumption that they will be used for the full term
of the lease. The Board could not foresee that a termination would be
instigated unless it became absolutely necessary for the County to use
the property, in which case, action to terminate the lease could be
started even if the termination clause is not in the lease. However, the
Board agreed to discuss removing the clause from the lease with the
Prosecuting Attorney.
.Resume for Director of Public Works Position: Robert Leach
submitted his resume, stating that he would like to e considered for
the position when the current Director retires.
Approval of Minutes: The minutes for the week of April 11, 1983
were approved and signe on t e motion by Commissioner Brown, seconded by
Commissioner Pitts. Unanimous.
Aerial Application of Herbicides: Alice Lumbard reminded the
Board of their agreement, when she me—F-w-i-EN them approximately one year
ago, to begin reviewing Forest Practices Permit applications which
involved herbicide spraying and to publish notice of any spraying in the
legal notices in the newspaper. Ms. Lumbard asked to see any permit
applications which had been reviewed, and noted that no notices had been
published in the newspaper. It was reported that the Planning Department
has not received any applications for review. Ms. Lumbard presented per-
mits for Crown Z and Pope & Talbot to spray which she obtained from the
Department of Natural Resources. The review period for these permits is
past.
Ms. Lumbard and others present requested that the Board appeal these per-
mits, obtaining a stop -work -order at least until it can be determined
what effects the proposed spraying might have on water sheds, etc. Com-
missioner Brown explained that if the County caused a stop -work -order to
be issued, then lost the appeal in the review process, the County could
be liable for monetary damages for delaying the work.
It was pointed out that the Forest Practices regulations stipulate an
environmental review where spraying will involve spraying of a class 1,
2 or 3 water source, but no such protection is offered to class 4 water
sources or to individual wells. Another regulation exempts spraying of
less than 40 acres from the permit process. There was lengthy discussion
regarding the effectiveness of spraying for vegetation control, the
possible health effects of 2,4D, and the lack of funds to conduct thorough
research regarding the effects on people of spraying.
Commissioner Pitts asked those present to collect and present information
regarding the effects of herbicides. Ms. Lumbard said information has
been provided, and that their primary request at this time is for the

right to control what affects their property and families. Chairman
O'Meara stated that the County cannot directly control spraying on
private property.
It was determined that no letter was sent to DNR last year requesting
reinstatement of the County to the review process of permit applications
for spraying. The Board told those present that they will see that
this reinstatement occurs, and will investigate the legal possibilities
of controlling spraying.
Liquor License; Geoduck Tavern: Following the motion by Com-
missioner Pitts, seconded y Commissioner Brown, Chairman O'Meara signed
approvalof the application for a change in corporate officers for this
tavern.
Agreement; SR101/Clearwater Road Improvements: Agreement
#GC -7309, with the Department of Transportation, or re ocation of this
intersection and improvements to SR101 was approved and signed by motion
of Commissioner Brown, seconded by Commissioner Pitts, unanimously
passed.
Non -Exclusive Franchise; PUD #1: Concluding action taken last
week, Commissioner Pitts made a motion to approve and sign Resolution
No. 30-83 granting a non-exclusive franchise for installation and main-
tenance of the Glen Cove water system. Commissioner Brown seconded the
motion. Unanimous.
Hearing Notice; Intent to Vacate: Commissioner Pitts seconded
Commissioner rown s motion to approv-e--a-n-d sign Resolution No. 31-83
which set a hearing date of May 9, 1983 at 11:00 a.m. regarding a portion
of McMinn Road. Unanimous.
Hearing Notice; Budget Appropriation, Civil Service Commission:
The motion by Commissioner Brown to sign Resolution No. 32-83, setting
the hearing for May 2, 1983 at 10:00 a.m., was secondedy� Commissioner
Pitts and unanimously passed.
Special Occasion Liquor License; Harbormaster Restaurant: At
the request ot restaurant management, and on the motion by Commissioner
Pitts, seconded by Commissioner Brown, Chairman O'Meara signed a letter
to the Liquor Control Board approving a license for May 5, 1983.
The meeting was recessed until Tuesday, April 21, 1983, at
which time all members were present. Following a Public Works staff
meeting, the Board met in executive session with the Prosecuting
Attorney regarding a legal matter.
Soldiers' & Sailors' Relief Fund Application: Commissioner
Pitts made the motion, seconded y Commissioner -Tr -own, to approve payment
of $65.00 for Elmer Assmen. Unanimous.
Repair of VFW Hall Roof: Commissioner Brown made a motion to
accept the proposal rom vergreen State Roof Co. to repair and seal for
$1,730.00 plus tax. Commissioner Pitts seconded the motion. Unanimous.
Hiller Short Plat: Betty Hiller reported that she is unable
to obtain an easement rom t e adjacent property -owner to provide access
from Flagler Road to lot 1 of this proposed short plat. Therefore, in
order to complete and record the short plat, she will grant an easement
for ingress and egress across her property from East Marrowstone Road.
She requested the Board's permission to make this a 10 -foot easement
rather than the required 30 -foot easement. Following discussion, the
Board stated that they would accept a 20 -foot easement.
Interview for Shorelines Commission Position: Diane Schonians
met with the Board to discuss Ler interest in serving on the Shorelines
Commission.
The meeting was recessed. On Wednesday, April 20, 1983, the

Commissioners conducted the Health Board meeting.
Liquor License Application; Parents Without Partners: This
application for a special occasion license for May 7, 1983 was approved
by motion of Commissioner Pitts, seconded by Commissioner Brown. Unanimous.
BUSINESS FROM COUNTY DEPARTMENTS:
Public Applications (2) to Open Rights -of -Way; Charlie Wines: Gary
Works re: Rowe presented these applications, one for portions of Cowlitz
4/18/83 and Longview Streets and one for a portion of South Street,
all in Trails' End Homesites. In each case, the application
is to provide driveway access to a homesite. The Board asked
Mr. Rowe to inspect the sites and report back to them before
they take action.
Beaver Valley Intersection: Mr. Rowe reported that DOT has
aareed to provide all the materials for lighting the intersection
and the County will install the lighting. He also noted that
the County will dig the trench for utilities (power and tele-
phone).
