Sullivan District No. 3 Commissioner: Kathleen Kier County Administrator: Philip Morley Clerk of the Board: Erin Lundgren MINUTES Week of November 21, 2016 Madam Chair Kathleen Kler called the meeting to order at the appointed time in the presence of Commissioner David Sullivan and Commissioner Phil Johnson. PUBLIC COMMENT PERIOD: The following is a summary of comments made by citizens in attendance at the meeting and reflect their personal opinions: • A citizen thanked Madam Chair Kler for attending a Port Ludlow Roadway Safety forum and thanked the Board for the work they do for the citizens; • Four (4) citizens commented on the Presidential Election outcome; • A citizen submitted a court's decision on Whatcom County versus Hirst. He is concerned about what the decision may mean for Jefferson County; • A citizen stated there will be a rally in Port Townsend at the Haller Fountain November 28, 2016 at 11:00 a.m. for those who wish to voice their feelings about how new President -Elect Donald Trump will lead America; and • A citizen stated that laws need to be enforced not only at the national level, but at the local level as well. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Johnson moved to approve all the items on the Consent Agenda as presented. Commissioner Sullivan seconded the motion which carried by a unanimous vote. 1. HEARING NOTICE re: 2017 Budget; Hearing Scheduled for December 5, 2016 at 10:00 a.m. in the Commissioners' Chambers 2. RESOLUTION NO. 45-16 re: Declare Certain County Property as Surplus and Sell to Government Agency; City of Port Townsend 3. AGREEMENT, Amendment No. 2 re: Amending Conditions for Disbursement of Funds from the Jefferson County Veterans Assistance Fund; No Dollar Amount, Policy Change Only; Jefferson County Veterans Service Officers Association (SOA) 4. AGREEMENT re: East Quilcene Road Paving, M.P. 0.40 — M.P. 0.55, Project No. 18020110, County Road No. 327508; In the Amount of $77,607: Jefferson County Public Works; Lakeside Industries, Inc. 5. Payment of Jefferson County A/P Warrants Done by Payroll Dated November 5, 2016 Totaling $128,699.86 APPROVAL of MINUTES: Commissioner Sullivan moved to approve the corrected Regular Meeting Minutes of November 7, 2016. Commissioner Johnson seconded the motion which carried by a unanimous vote. COMMISSIONERS BRIEFING SESSION: The Commissioners reported on their meeting schedules. The meeting was recessed at 9:49 a.m. and reconvened at 10:02 a.m. with all three Commissioners present. HEARING re: Setting the 2017Ad Valorem Tax Levies for Jefferson County Levy in 2016 and Collection in 2017: Assessor Jeff Chapman and Assessor Technician Lauralee Kiesel were present for the hearing. County Administrator Philip Morley explained that per state law, Jefferson County is required to set levies in property tax for the Road Fund, Conservation Futures Fund and the General Fund. The RCW requires that Commissioners hold a public hearing on the 2017 Ad Valorem Tax Levies for levy in 2016 and collection in 2017. He distributed a packet to the Commissioners which reorder the proposed resolutions in an order more suitable for adoption. County Administrator Morley explained Implicit Price Deflator (IPD). He stated that in municipalities where the IPD is less than 1%, if there is a finding of substantial need, the County can go above the IPD and assess a full I% increase in property tax, separate from new construction. He stated that the first three proposed resolutions are establishing substantial need. Since 2010, the County has diverted $720,000 from the Road Levy fund to the General Fund for the Sheriff's Department road enforcement activities. County Administrator Morley reviewed the proposed resolution for the diversion, in addition to the other proposed budget resolutions. The Road Fund levy of $4,311,861.52 is an increase of $42,691.70, which is a one percent increase from the previous year. The General Fund levy in the amount of $7,707,370.33 is an increase of $76,310.60, which is a one percent increase from the previous year. County Administrator Morley stated that the Conservation Futures Fund did not take its allotted one percent in previous years, which rolled over into banked capacity. Assessor Jeff Chapman has determined there is 2.25% of County Conservations Futures Fund Levy Banked Capacity, which for 2017 taxes is calculated to be $5,031.82. County Administrator Morley stated that each year the Conservation Futures Advisory Board comes forward with meritorious projects that far exceed funding provided. Projects have to be either scaled back or wait one or more years to be funded. Page 2 Commissioners Meeting Minutes of November 21, 2016 Commissioner Sullivan noted that Conservation Futures projects are often matched, and have been a contributing factor to the increase of jobs in Jefferson County. It also prevented sprawl in the Urban Growth Areas (UGA). Madam Chair Kler opened up the hearing for public testimony. Hearing no comments for or against setting the 2017 Ad Valorem Tax Levies for Jefferson County Levy in 2016 and Collection in 2017, she closed the hearing. Commissioner Sullivan moved to approve RESOLUTION NO. 46-16 re: Finding a Substantial Need and Adopting the Limit Factor for the Jefferson County General Fund Property Tax Levy. Commissioner Johnson seconded the motion which carried by a unanimous vote. Commissioner Johnson moved to approve RESOLUTION NO. 47-16 re: Finding a Substantial Need and Adopting the Limit Factor for the Jefferson County Road Fund Property Tax Levy. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Commissioner Sullivan moved to approve RESOLUTION NO. 48-16 re: Finding a Substantial Need and Adopting the Limit Factor for the Jefferson County Conservation Futures Fund Property Tax Levy. Commissioner Johnson seconded the motion which carried by a unanimous vote. Commissioner Johnson moved to approve RESOLUTION NO. 49-16 re: Diversion of Road Levy for Traffic Law Enforcement for the 2017 General Fund Budget. Commissioner Sullivan seconded the motion. Madam Chair Kler noted the impact of a decision to divert $720,000 from an already significantly impacted Public Works budget. She added that the Public Works Director/County Engineer is asking for the Commissioners to be aware that this diversion impacts his budget. Commissioner Sullivan noted that not diverting the funds for Traffic Law Enforcement could be an impact to public safety, and its tough to strike a balance. Madam Chair Kler called fora vote on the motion. The motion was carried by a unanimous vote. Commissioner Sullivan moved to approve RESOLUTION NO. 50-16 re: Increasing the Jefferson County General Fund Levy for 2017 Taxes. Commissioner Johnson seconded the motion which carried by a unanimous vote. Commissioner Johnson moved to approve RESOLUTION NO. 51-16 re: Increasing the Jefferson County Road Levy for 2017 Taxes. Commissioner Sullivan seconded the motion which carried by a unanimous vote. Commissioner Sullivan moved to approve RESOLUTION NO. 52-16 re: Declaration of a Financial Emergency in the Jefferson County Conservation Futures Fund Requiring the use of 2.25% of the Conservation Futures Fund Tax Levy Banked Capacity. Commissioner Johnson seconded the motion. County Administrator Morley noted that Jefferson County goes above and beyond what the state RCW requires for Conservation Futures. He pointed out that page two of the proposed resolution states that by approving the resolution, the County is declaring that an emergency exists. Madam Chair Kler stated that they do not take the term "economic emergency" lightly. She added that as the County's income to provide services required by state and federal government is squeezed, it will be an ongoing emergency until the County is fully funded by state and the federal government for the services they wish the County to Page 3 Commissioners Meeting Minutes of November 21, 2016 provide. Madam Chair Kler called for a vote on the motion. The motion carried by a unanimous vote Commissioner Sullivan moved to approve RESOLUTION NO. 53-16 re: Increasing the Jefferson County Conservation Futures Tax Levy for 2017. Commissioner Johnson seconded the motion which carried by a unanimous vote. Commissioner Sullivan moved to approve sending a LETTER TO ASSESSOR re: 2017 Real and Personal Property Levy and Refund Amount. Commissioner Johnson seconded the motion which carried by a unanimous vote. COMMISSIONERS BRIEFING SESSION -Continued. The Commissioners reported on their meeting schedules. Madam Chair Kler and County Administrator Philip Morley reported on a recent Washington State Association of Counties Conference they attended in Spokane, Washington. The meeting was recessed at 11:02 a.m. and reconvened at 1:33 p.m. with Madam Chair Kler and Commissioner Sullivan present. Commissioner Johnson was absent. COUNTYADMINISTR,4TOR BRIEFING SESSION: County Administrator Philip Morley reviewed the following with the Board. Miscellaneous Items: • The Port Townsend Leader awarded Madam Chair Kler the "Best Elected Official in Jefferson County" award as voted by citizens during their Leader's Choice Contest. • Boards and Commissions; County Administrator Morley will provide a breakdown of the list • Emergency Management Director; County Administrator Morley will publish a press release regarding the hiring of the new Emergency Management Director. • Meeting with Island County Commissioner regarding the Navy Environmental Impact Statement (EIS) on December 5, 2016. • Commissioner -Elect Kate Dean; coordinating her swearing-in ceremony. Calendar Coordination: Below is a list of the upcoming meetings and events the Commissioners will be attending in the near future: • Event at the Fort Worden Commons MEETING CANCELLATION. Madam Chair Kler moved to cancel the December 27, 2016 regularly scheduled Board of County Commissioners' (BOCC) meeting. Commissioner Sullivan seconded the motion. The motion carried. The first BOCC meeting of 2017 will be held on Tuesday, January 3, 2017. Miscellaneous Items: • Mats Mats Quarry; Madam Chair Kler will be removing herself from an in-depth news story. • Government -to -Government meeting with the Hoh Tribe; the planning will be discussed next week. • Brinnon Master Planned Resort • Central Services Director, Civil Deputy Prosecuting Attorney and Central Services Director positions update; Prothman will go out for hire in January 2017. • Gardiner Community Center Board; Facilities staff will be in contact with them. • National Association of Counties (NACo); Madam Chair Kler will speak to Kitsap County regarding who will represent at the next NACo Conference. • Washington State Association of Counties (WSAC); letter of WSAC support to be included in budget.
