Sullivan District No. 3 Commissioner: Kathleen Kler County Administrator: Philip Morley Clerk of the Board: Erin Lundgren MINUTES Week of November 28, 2016 Madam Chair Kathleen Kler called the meeting to order at the appointed time in the presence of Commissioner David Sullivan. Commissioner Phil Johnson was absent. PUBLIC COMMENT PERIOD: The following is a summary of comments made by citizens in attendance at the meeting and reflect their personal opinions: • A citizen stated: 1) His opinion on President -Elect Donald Trump's cabinet choices; 2) He attended a Cascadia meeting; and 3) Jefferson County appears to be doing a reasonable job; • A citizen congratulated Madam Chair Kler for receiving The Leader's People's Choice Award for "Best Elected Official;" • A citizen: 1) Reported on the recent rally held at the Haller Fountain steps regarding President -Elect Donald Trump; and 2) Requested that Jefferson County create and approve a proclamation that reflects a speech recently made by the Mayor of New York City; and • A citizen commented on earthquakes and the devastation one could have on Port Townsend and our County. He gave statistics of an earthquake in New Zealand. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Sullivan moved to approve all the items on the Consent Agenda as presented. Madam Chair Kler seconded the motion. The motion carried. 1. AGREEMENT re: Emergency Management Director; In the Amount of $75,509.16 per Year plus Benefits; Jefferson County Administrator; Lynn Sterbenz 2. AGREEMENT, Change Order No. 3 re: Undie Road Surfacing Project No. 18020070; A Reduction of $11,058.27 for a Total Amount of $916,446.42; Jefferson County Public Works; Interwest Construction, Inc. 3. AGREEMENT re: Undie Road Bypass; DNR FR -F 4200 and 4210 Road Surfacing, Project No. 18020070; In the Amount $78,025; Jefferson County Public Works; Interwest Construction, Inc. 4. AGREEMENT re: 2016 Community Services Grant Funding; In the Amount of $4,766; Jefferson County Administrator; Jefferson County Fair Association 5. Allocation Request re: Mental Health and Chemical Dependency Funding for 2017; Jefferson County 1/101h of 1% Funds, (Hargrove Fund); $433,265.71 6. Appointment to Fill a vacancy on the Port Ludlow Drainage District Governing Body; Donald E. Forbes to Serve the Remainder of a Six (6) Year Term Until the Next Special District General Election in February, 2018 7. Payment of Jefferson County Payroll Warrants Dated November 18, 2016 Totaling $63,686.70 and A/P Warrants Done by Payroll Dated November 18, 2016 Totaling $18,780.70 COMMISSIONERS BRIEFING SESSION: The Commissioners reported on their meeting schedules and discussed Calendar Coordination and Miscellaneous Items. Calendar Coordination: Below is a list of the upcoming meetings and events the Commissioners will be attending in the near future: • Navy Environmental Impact Statement (EIS) Public Meeting at the Gardiner Community Center. • Behavioral Health Organization (BHO) meeting • Final Election Certification • Opiod Steering Committee • The Leader Open House • Courthouse Emergency Action Plan training • Port Ludlow Village Council meeting • Quilcene Museum reception • North Olympic Development Council meeting Miscellaneous Items: • Port Ludlow; tree harvest. Port Ludlow Associates will not be conducting further timber clearing to allow for the potential settlement negotiations to continue. • Washington State Department of Natural Resources (DNR): DNR to address the Marbled Murrelet habitat. The meeting was recessed at 9:39 a.m. and reconvened at 10:00 a.m. with Madam Chair Kler and Commissioner Sullivan present. UPDATE: Washington State Department of Natural Resources (DNR) 3.d Quarter County Income Report. Regional Manager Mona Griswold, State Lands Assistant Drew Rosanbalm and other DNR staff were present to brief the Commissioners on the 3rd Quarter County Income Report. The Washington State DNR manages approximately 14,717 acres of State Forest Transfer and Purchase Lands that benefit Jefferson County. Mr. Rosanbalm stated that these lands generated $1,498,000 in the first three quarters of calendar year 2016. It is anticipated that the County will reach $1,698,000 at the close of the 2016 calendar year. Mr. Rosanbalm noted that this represents an $87,000 increase from the 2016 year-end projection as quoted in the July 2016 Income Report. Mr. Rosanbalm stated that the next value under contract after 2016 is estimated at $1,055,000. He then reported on the current and future timber sales and harvests. Ms. Griswold stated that she realizes how important timber income is to Jefferson County and that her team is striving to inform the Commissioner's about how much timber revenue to expect and when to expect it. Page 2 Commissioners Meeting Minutes of November 28, 2016 EXECUTIVE SESSION. • An Executive Session was scheduled from 10:45 a.m. to 11:30 a.m. with the County Administrator, Community Development Director, Prosecuting Attorney and Outside Legal Counsel regarding Attorney -Client Privilege, Potential Litigation under exemption RCW 42.30.110(1)(i) as outlined in the Open Public Meetings Act. The actual period of time the Board met in Executive Session on this topic was from 10:46 a.m. to 11:37 a.m. At the conclusion of the Executive Session the Board resumed the regular meeting. The meeting was recessed at 11:37 a.m. and reconvened at 1:32 p.m. with Madam Chair Kler and Commissioner Sullivan present. CLOSED SESSION: A Closed Session was scheduled from 1:30 p.m. to 1:45 p.m. with the County Administrator and the Clerk of the Board/Human Resources Manager to Discuss Strategy or Position for Collective Bargaining, Professional Negotiations or Grievance or Mediation Proceedings under exemption RCW 42.30.140(4)(b) as outlined in the Open Public Meetings Act. The actual period of time the Board met in Closed Session on this topic was from 1:32 p.m. to 1:57 p.m. At the conclusion of the Closed Session the Board resumed the regular meeting. COUNTYADMINISTRATOR BRIEFING SESSION: County Administrator Philip Morley reviewed the following with the Board. Miscellaneous Items — continued: • Whatcom County vs. Hirst: Department of Community Development (DCD) Director Patty Charnas was present to brief the Board on a recent court decision regarding Whatcom County vs. Hirst and how it may impact Jefferson County. Director Charnas stated that Washington State Association of Counties (WSAC) Policy Director Laura Berg notified her about the decision and potential impacts and informed Director Charnas that the House Local Government and Agricultural and Natural Resources will be holding a joint hearing on December 1, 2016 on the Hirst Decision regarding exempt wells. Commissioner Sullivan and Director Charnas participated in a conference call on November 25, 2016 and were briefed on what was known at the time. An article published by the Municipal Research and Services Center on this topic was distributed. At the request of the Commissioners, Director Charnas will be participating in a meeting prior to the hearing on December 1, 2016 and will report back with new information. • Jefferson County Hazard Mitigation Plan; Commissioner Sullivan will review the Plan prior to Emergency Management Director Bob Hamlin's retirement at the end of December 2016. • 2017 Budget Memo; County Administrator Morley reviewed some of the key additions to the budget and is continuing to work on this. A hearing on the 2017 Budget is tentatively set for December 5, 2016. • The new Emergency Management Director will start on December 5, 2016. • Behavioral Health Organization (BHO); restorative facilitation meetings are currently underway. • In January, the Prothman Group will be conducting a search to fill the Civil Deputy Prosecutor and Central Services Director positions. • Courthouse security; incidents from citizens that raise anxiety and push the need for security. • West End Sheriff Deputies; Sheriff Stanko stopped in at the meeting and briefly discussed the recent deputy hires for our West End and commented on how well they are doing. Page 3 Commissioners Meeting Minutes of November 28, 2016 • Planning Commission meeting request; based on the topic, the request for a meeting will be referred to the Department of Community Development. • County Administrator Morley urged the Commissioners to meet and discuss various issues with Commissioner -elect Kate Dean prior to her swearing-in. • Kittitas County proclamation; Madam Chair Kler would like Jefferson County to issue a similar proclamation regarding fears resulting from a Donald Trump presidency. Commissioner Sullivan stated he is not in favor of a proclamation which outlines things we are already doing as a County and prefers the "wait-and-see" approach. Madam Chair Kler will conduct further research. • Madam Chair Kler is addressing a request regarding human rights. • Jefferson County Tri -Area Foodbank; meeting to be planned to address potential use for a nearby parcel.
