Analysis/Strategic Goals/Pro's 8t Con's: Jefferson County was awarded a loan of $10,000,000 by the PWTFB in 2012 for development of the Port Hadlock Wastewater System which has an estimated startup cost of approximately $45,000,000 for the Core 1t Rhody service areas. The County has used approximately $1,676,155 of the loan combined with an EPA grant of $970,000 to complete the plans and specifications for the wastewater treatment plant and wastewater re -use facility and to complete permitting and land acquisition. This loan extension is for 18 months to allow the County time to seek grants and appropriations from State and Federal sources that would allow the project to advance. Further information and detail can be found on page 2 of the Amendment. Fiscal Impact/Cost Benefit Analysis: This Amendment is for time only and so there is no new fiscal impact. Amendment Purpose: The purpose of this amendment is to extend the project completion date of the Public Works Trust Fund Loan Number PC 12-951-052. The Board, defined as the Washington State Public Works Board, and Borrower/Contractor acknowledge and accept the terms of this Agreement/Contract As Amended and have executed this Agreement/Contract Amendment on the date below to start as of the date and year referenced above. The rights and obligations of both parties to this Agreement/Contract As Amended are governed by this Agreement/Contract Amendment and the following other documents incorporated by reference: Amendment Terms and Conditions. A copy of this Agreement/Contract Amendment shall be attached to and made a part of the original Agreement/Contract between the Board and the Borrower/Contractor. This amendment was approved by the Public Works Board, a department of the State of Washington, (hereinafter referred to as the "Board"). The Board found the extension was necessary for the following reason: Lack of Complete Funding for Construction - State and federal grant/appropriation assistance is required to construct the new sewer system and treatment facilities in an affordable manner. When the County began the planning process, federal and state grants/appropriations were available to assist in bringing important infrastructure projects to life. Jefferson County has complied with Growth Management, worked within its own means and with funding partners (Rep. Norm Dicks office for federal appropriation, USDA -Rural Development, WA Dept. of Ecology and PWTF) to bring the project to its current position. Now a significant grant or federal/state appropriation is required to be able to complete the entire funding package. Once this significant grant/appropriation is secured, the County can proceed to partner with local property owners to establish a Local Improvement District (LID) and will again be eligible to work with low-interest funding programs (USDA -Rural Development, Dept. of Ecology and Community Development Block Grant) to complete the funding package and proceed with construction. Unfortunately, the County has been notified that the project is not eligible for funding program grants until the LID has been established. The collection system costs were tested with the property values with the Special Benefit Study completed in late 2013. It was found that property values had not rebounded. The combination suggested that the formation of an LID to fund the collection system was not feasible at that time. And funding programs require the formation of an LID in order to apply for grants. The Board and the Jefferson County (hereinafter referred to as the "Borrower/Contractor') agree to amend the Public Works Trust Fund Loan Agreement/Contract Number PC 12-951-052 as described below. Time of Performance Section of the Agreement/Contract Number PC 12-951-052 is amended to read as follows: The Borrower/Contractor shall begin the activities identified within Attachment I: Scope of Work no later than three (3) months after Agreement/Contract execution, and reach project completion no later than 6/5/2018. Failure to meet Time of Performance shall constitute default of this Agreement/Contract. In the event of extenuating circumstances, the Borrower/Contractor may request, in writing, that the Board extend the deadline for project completion. The Board may, by a two-thirds vote, extend the deadline.
