HomeMy WebLinkAbout01 0522 17STATE OF WASHINGTON County of Jefferson In the Matter of Establishing the Ocean } Grove No Shooting Areas } ORDINANCE NO. 01-0522-17 WHEREAS, the Jefferson County Board of County Commissioners makes the following Findings of Fact with respect to this particular No Shooting Area petition and review process: 1. On April 16, 2007, Ordinance No. 02-0416-07 was adopted by Jefferson County, codified under the Health and Safety provisions of Jefferson County Code Chapter 8.50, which specifies the process to create or alter no shooting areas in accordance with RCW 9.41.300(2)(a) "where there is a reasonable likelihood that humans, domestic animals, or property may be jeopardized;" and 2. Jefferson County Code Chapter 8.50 specifies procedures for establishing, altering or dissolving no shooting areas in specifically described unincorporated areas of Jefferson County, including initiation by petition filed by at least 20 elector -residents of each voting precinct in the area under consideration, or by a majority vote of the Board of County Commissioners; and 3. In three separate occasions, on November 24, November 27 and December 18, 2014, residents in Ocean Grove called JeffCom 911 to report safety concerns stemming from shooting on a residential property on Combs Street within the subdivision. The shooting incidents were investigated by the Jefferson County Sheriffs Office, but found to be within a legal shooting zone. 4. Pursuant to JCC 8.50.050, on April 10, 2015 a petition was filed by residents with the clerk of the Board of County Commissioners requesting that a no shooting area be created coterminous with the plats of Ocean Grove Estates and Ocean Grove No. 2 located southeast of Beckett Point within voting Precinct #105, and coterminous with the plat of Ocean Grove No. 3, located northeast of Beckett Point, also within voting Precinct #105; and 5. The County Auditor, upon reviewing the petition, certified it met the requirement of having at least 20 valid signatures from eligible electors within the one area including Ocean Grove Estates and Ocean Grove No. 2, thus meeting the petition requirements of JCC 8.50.050(1)(a); and 6. The County Auditor, upon reviewing the petition found there were insufficient signatures from eligible electors within Ocean Grove No. 3 to meet the petition requirements of JCC 8.50.050(1)(a); and 7. Pursuant to JCC 8.50.050(1)(b), the Board of County Commissioners may themselves propose the boundaries of a no shooting area; and 8. On April 3, 2017, the Board of County Commissioners passed a Motion to consider a no shooting area in Ocean Grove No. 3, having determined that in Ocean Grove No. 3 Ordinance No. 01-0522-17 Re: Ocean Grove No Shooting Areas there is a reasonable likelihood that humans, domestic animals, or property may be jeopardized; and 9. On April 17, 2017, the Board of County Commissioners approved a legal notice, published on April 19 and April 26, announcing a public hearing to be conducted on May 22, 2017; and 10. On April 19, 2017, the County sent letters to Point No Point and Point Elliott Treaty tribes pursuant to JCC 8.50.050, inviting the tribes to identify their concerns and inviting their participation regarding the potential establishment of the Ocean Grove No Shooting Areas, including an invitation to participate in the May 22, 2017, public hearing; and 11. On May 22, 2017, the Board of County Commissioners held the public hearing on the proposed No Shooting Areas in Ocean Grove Estates and Ocean Grove No. 2, and in Ocean Grove No. 3, and oral and written testimony was received by the Board; and 12. Based on the evidence and testimony present at the hearing on May 22, 2017, the Board of County Commissioners find that: a. A definable threat to the public health, safety or general welfare exists in the proposed No Shooting Area in Ocean Grove Estates and Ocean Grove No. 2, because there is a reasonable likelihood that humans, domestic animals, or property may be jeopardized; and b. A definable threat to the public health, safety or general welfare exists in the proposed No Shooting Area in Ocean Grove No. 3, because there is a reasonable likelihood that humans, domestic animals, or property may be jeopardized; and c. The legal description of the proposed boundaries of the No Shooting Areas in Ocean Grove Estates and Ocean Grove No. 2, and in Ocean Grove No.3 below and the map in Attachment A are sufficient to satisfy the requirements of JCC 8.50.050(3); and d. Formation of No Shooting Areas in Ocean Grove Estates and Ocean Grove No. 2 and in Ocean Grove No.3 would be beneficial to the public health, safety or general welfare; and 13. In accordance with RCW 9.41.300(2)(a) and JCC 8.50.050(6), the Board of County Commissioners finds the location of the proposed No Shooting Areas in Ocean Grove Estates and Ocean Grove No. 2, and in Ocean Grove No. 3 are both regions of unincorporated Jefferson County where there is a reasonable likelihood that the health and safety of humans, domestic animals, or property may be jeopardized by the discharge of firearms; and 14. Upon conclusion of the public hearing the Board of County Commissioners reviewed the record, deliberated and voted to establish the Ocean Grove No Shooting Areas boundaries as described below and as shown on the Map in Attachment A; and 15. The creation of the Ocean Grove No Shooting Areas has been completed in a manner consistent with Ordinance #02-0416-07 and Jefferson County Code Chapter 8.50; 2 Ordinance No. 01-0522-17 Re: Ocean Grove No Shooting Areas NOW, THEREFORE, BE IT ORDAINED as follows: Section One: The following language shall be added to the Jefferson County Code at Chapter 8.50 JCC: Ocean Grove: The area described below is hereby established as a no shooting area as provided in Article I of this chapter. Albert Balch and Harry Cotton's Ocean Grove Estates, as per plat recorded in Volume 4 of Plats, Page 20, records of Jefferson County, Washington; TOGETHER WITH Albert Balch and Harry Cotton's Ocean Grove Estates No. 2, as per plat recorded in Volume 4 of Plats, Page 27, records of Jefferson County, Washington; TOGETHER WITH that portion of Government Lot 4, Section 24, Township 30 North, Range 2 West, W.M., not included in said Albert Balch and Harry Cotton's Ocean Grove Estates and in Albert Balch and Harry Cotton's Ocean Grove Estates No. 2. TOGETHER WITH that portion of Lot 5 of survey recorded in Volume 11 of Surveys, Page 54, under Auditor's File Number 328912, located within Government Lot 5, Section 24, Township 30 North, Range 2 West, W.M., described as follows: Beginning at the Northwest corner of said Lot 5; Thence proceeding on a bearing of S 88° 30' 34" East 67.21 feet along the North line of said Lot 5 to the Southwest corner of Lot 12, plat of Ocean Grove No. 2, Volume 4 of Plats, Page 27, records of Jefferson County; Thence continuing South 88° 30' 34" East 76.22 feet to the Southeast corner of said Lot 12; Thence turning South 26° 34' 58" West 166.11 feet to a rebar and cap marked "Parrish, LS 29535"; Thence continuing South 26° 34' 58" West 9.07 feet; Thence North 83° 52' 04" West 69.36 feet to the West boundary of said Lot 5; Thence North 01' 29' 25" East 8.53 feet to a rebar and cap marked "Parrish, LS 29535" and the West line of said Lot 5; Thence along the West line of Lot 5 North 01' 29' 25" East 144.51 feet to the Point of Beginning; 3 Ordinance No. 01-0522-17 Re: Ocean Grove No Shooting Areas TOGETHER WITH Albert Balch and Harry Cotton's Ocean Grove Estates No. 3, as per plat recorded in Volume 4 of Plats, Page 31 and amended in Volume 6 of Plats, Page 138-139, records of Jefferson County, Washington. All situated in Jefferson County, State of Washington. Section Two: The following map is hereby made part of the Jefferson County Code at Chapter 8.50. See: Attachment A — Ocean Grove No Shooting Areas Map. Section Three: Should there be any discrepancy or disagreement between the metes and bounds description found in Section One above and the boundary of the Ocean Grove No Shooting Areas as reflected on the map made Attachment A to this Ordinance, then the text of the metes and bounds description shall be deemed controlling. Section Four: Consistent with RCW 9.41.300(2)(a) and JCC 8.50.030, nothing in this Ordinance is intended to abridge the right of the individual guaranteed by Article I, Section 24 of the State Constitution to bear arms in defense of self or others. Section Five: The penalty for violation of this Ordinance is provided in JCC 8.50.60 and is consistent with state law. Section Six: This Ordinance shall become effective 30 days after adoption. ANALYSIS: On April 10, 2015 pursuant to JCC 8.50.050(1)(a), a petition was submitted to the Board of County Commissioners by residents of the Ocean Grove area located in voting Precinct #105. The petition asked the Commissioners to establish a no shooting area coterminous with the plats of Ocean Grove Estates and Ocean Grove No. 2 located southeast of Beckett Point, and coterminous with the plat of Ocean Grove No. 3, located northeast of Beckett Point. The County Auditor, upon reviewing the petition, certified it met the requirement of having at least 20 valid signatures from eligible electors within the one area including Ocean Grove Estates and Ocean Grove No. 2. The County Auditor also found there were insufficient signatures from eligible electors within Ocean Grove No. 3 to meet the petition requirements of JCC 8.50.050(1)(a). On April 3, 2017, pursuant to JCC 8.50.050(1)(b), the Board of County Commissioners passed a Motion to consider a no shooting area in Ocean Grove No. 3. Pursuant to state law (RCW 9.41.300) and county code (Chapter 8.50 JCC) the county can restrict the discharge of firearms where there is a reasonable likelihood that humans, domestic animals, or property may be jeopardized. The public hearing is to take public testimony from all interested persons for or against establishing the Ocean Grove No Shooting Areas. Written public comments will also be accepted any time up through the close of the public hearing, addressed to the BoCC at P.O. Box 1220, Port Townsend, WA 98368, or by e-mail at jeffbocc ,co.jefferson.wa.us. A map, legal description, and draft ordinance that would establish the proposed Ocean Grove No Shooting Areas has been available for view online at www.co.jefferson.wa.us starting April 19, 2017. To promote active participation of residents and tribal interests, the hearing notice was published twice in the Port Townsend Leader on April 19 and April 26. A letter to invite the input from Treaty Tribes and neighboring tribes was also mailed on April 19. At staff's request, the Sheriff's Office has run a three-year history from the department's incident log of shooting complaints from within the proposed areas, and has prepared a map showing the location of the incidents. A copy of the incident log and associated map is attached to this memo, and is made part of the Public Hearing record. 1 of 4 FISCAL IMPACT: None, other than the minor cost of producing and posting a few signs identifying the No Shooting Areas. RECOMMENDATION: Conduct the public hearing, deliberate on the oral and written testimony, and either adopt the ordinance as presented, or direct staff to prepare further amendments to the ordinance for future BoCC adoption. The Jefferson County Board of County Commissioners (BoCC) will hold a public hearing to consider the Ocean Grove No Shooting Areas, on Monday, May 22, 2017 at 10:00 a.m. The public hearing will take testimony from all interested persons for or against establishing the Ocean Grove No Shooting Areas, which the County Commissioners is considering for possible adoption. Your written or verbal comments are most welcome. Verbal testimony will be accepted at the public hearing. Written testimony will be accepted any time up through the close of the public hearing, addressed to the BoCC at P.O. The proposal to establish the Ocean Grove No Shooting Areas was the subject of a petition by residents of three developed subdivisions: Ocean Grove Estates, Ocean Grove No. 2, and Ocean Grove No. 3. Under state law (RCW 9.41.300) and county code (Chapter 8.50 JCC), the county can restrict the discharge of firearms where there is a reasonable likelihood that humans, domestic animals, or property will be jeopardized. The proposal seeks to protect developed areas by establishing the Ocean Grove No Shooting Areas. Jefferson County would appreciate Tribal input on whether you support, oppose or are neutral on the proposal to establish the Ocean Grove No Shooting Areas. Residents of the three Ocean Grove plats submitted a petition to create a no shooting area within their residential subdivisions. One area of the proposed Ocean Grove No Shooting Areas is coterminous with the plats of Ocean Grove Estates and Ocean Grove No. 2, located southeast of Beckett Point. A second area is coterminous with the plat of Ocean Grove No. 3, located northeast of Beckett Point. A draft ordinance has been prepared for consideration in the event the County Commissioners were to decide, after deliberating on public testimony, to designate a no shooting area. Section One of the draft ordinance would add a section to Chapter 8.50 of the Jefferson County Code (JCC) describing the metes and bounds of the Ocean Grove No Shooting Areas; Section Two would add to JCC Chapter 8.50 a map of the Ocean Grove No Shooting Areas; Section Three states the metes and bounds shall prevail over the map in the event of any discrepancy; Section Four reiterates that nothing in the ordinance is intended to abridge the right of the individual guaranteed by Article I, Section 24 of the State Constitution to bear arms in defense of self or others; Section Five references the penalty provisions found in JCC 8.50.060; and Section Six sets an effective date for the ordinance of 30 days after its adoption. We got review back from auditor's office last week. Haven't had a chance to really analyze the options to put before you. What I wanted to do was give you a heads up about this issue. In the larger area, there are a sufficient amount of signatures. Look at it, consider alternatives, hold a public hearing. The second area where there is insufficient signatures, not sure if we would send petitioners out for more signatures, or the other alternative is if the Commissioners want to initiate under your own authority, we can consider that under your own initiative. Other option would be to say sorry not sufficient for this area, not proceeding on it at this time. Not asking for direction because I haven't done analysis to give you a staff recommendation. Sullivan noted DNR property between the two pieces and it goes down to the water, steep bank in a certain area and recent fire in discovery bay. If this is a homeowners association, surprised its not in their covenant, or they can make their own rule? Morley- pertain to citizens that don't live there? Kler — can they post? It involves two regions of Precinct 105, which is, in general, Cape George. There were some unusual wrinkles that I worked out with Betty Johnson, the Elections Administrator and it was decided that I would write to the County Administrator on behalf of the Auditor's Office. Thus this unusually long email. There are a two items that need to be addressed in reference to the Ocean Grove No Shooting Zone petition the Auditor's Office received on 4/13/2015. 1. The required warning, per RCW 35.21.005, is not on any of the petition pages. The warning states, in general, that providing false information as part of signing the petition is a misdemeanor. Although it is required, correspondence from the Secretary of State's office indicates this technical deficiency may not be enough to invalidate a petition. The Office of the Secretary of State informed us that "Judges often discount requirements if they deem them to be administrative." This means that where the technical omission does not materially detract from the substance of the petition and its sufficiency, courts will likely deem the petition valid despite the omission. Betty Johnson and I reviewed this omission. I concur that because the signatures check out as valid on this petition, the warning about not giving a false statement does not mar the validity of this particular petition for a no shooting zone. Thus, I agree the warning is reviewed by administrative and, as long as it meets all other requirements this should not keep the petition from being certified as sufficient. But there is another wrinkle. 2. This petition also addresses two different "regions" or portions of Precinct 105 and the regions do not touch and are some distance (perhaps '/4 of a mile) apart. Thus, each region should be addressed separately. a. Ocean Grove Estates and Ocean Grove #2 meets the requirements and can be certified as sufficient. b. Ocean Grove #3 does not meet the requirements in the BOCC resolution since 20 signatures are required and there are only eight (8) signatures on the petition from voters living in the area designated as Ocean Grove #3. As a side note, there is a total of 21 Active registered voters in that area, therefore all but one voter would have to sign this petition to be sufficient. After discussing this with the undersigned, the Auditor's Office is able to certify the Ocean Grove Estates / Ocean Grove #2 designated area as sufficient but not the area indicated as Ocean Grove #3. The other option is for the BOCC to exercise their option in Jefferson County Ordinance No. 02-0416-07 Section S (b), whereby a majority vote of the Board of County Commissioners can make the petition with respect to Ocean Grove #3 a Board -initiated request (as differentiated from one brought by the residents) and have it proceed through the normal process. I would remind the County Administrator and the County Commission that the County Commission will need to make a written finding in the enacting Ordinance (if it is the wish of the BoCC to adopt these two no - shooting zones) that there is at this time in the areas to be included in the no -shoot zone, a reasonable likelihood - % s r of harm to property and harm to human life from the use of firearms in the vicinity of the proposed no shooting zones. I would remind the County Administrator and the County Commission that a precise metes and bounds description will be needed, more precise than what was attached to the petitions. It may be enough to say the land reflected on the recorded plats is to be included in the no shooting zones. It appears there are three plats: Ocean Grove, Ocean Grove #2 and Ocean Grove #3. The recorded plats may be sufficiently precise. The Homeowners' Association may also be of assistance in this regard. I would remind the County Administrator and the County Commission that a single Ordinance can enact two distinct no -shooting zones as long as we have sufficiently precise metes and bounds descriptions to describe the no -shoot zones. Plat of Ocean Grove No. 2, recorded in Jefferson County, Washington, in February 1961 as Volume 4 of Plats, page 27. Plat of Ocean Grove No. 3, recorded in Jefferson County, Washington, in September 1962 as Volume 4 of Plats, page 31. A map of the plats accompanies this request along with signatures of residents who are registered voters. A description of the area is also attached. It should serve as an easily identified demarcation for the sheriff's staff if so needed. The Ocean Grove community has 80 homes with Discovery Bay as the southern border and DNR land as the northern border for Ocean Grove Estates and Ocean Grove #2. It is bisected by Cape George Road. Ocean Grove #3 sits between Discovery Bay and the community drainfield for the Beckett Point Fishermans' Club community. It is bisected by Beckett Point Road. The 61 accompanying signatures represent 44 of the owner -residents. That is 63% of the households that meet the criteria for signing—owner residents and registered voters in the local precinct. The Association Trustees unanimously endorse this request. Our forested, 28 acre greenbelt with hiking trails, and our spacious community drainfield area create potentially dangerous locations for shooting in this residential area. It involves two regions of Precinct 105, which is, in general, Cape George. There were some unusual wrinkles that I worked out with Betty Johnson, the Elections Administrator and it was decided that I would write to the County Administrator on behalf of the Auditor's Office. Thus this unusually long email. There are a two items that need to be addressed in reference to the Ocean Grove No Shooting Zone petition the Auditor's Office received on 4/13/2015. 1. The required warning, per RCW 35.21.005, is not on any of the petition pages. The warning states, in general, that providing false information as part of signing the petition is a misdemeanor. Although it is required, correspondence from the Secretary of State's office indicates this technical deficiency may not be enough to invalidate a petition. The Office of the Secretary of State informed us that "Judges often discount requirements if they deem them to be administrative." This means that where the technical omission does not materially detract from the substance of the petition and its sufficiency, courts will likely deem the petition valid despite the omission. Betty Johnson and I reviewed this omission. I concur that because the signatures check out as valid on this petition, the warning about not giving a false statement does not mar the validity of this particular petition for a no shooting zone. It involves two regions of Precinct 105, which is, in general, Cape George. There were some unusual wrinkles that I worked out with Betty Johnson, the Elections Administrator and it was decided that I would write to the County Administrator on behalf of the Auditor's Office. Thus this unusually long email. There are a two items that need to be addressed in reference to the Ocean Grove No Shooting Zone petition the Auditor's Office received on 4/13/2015. The required warning, per RCW 35.21.005, is not on any of the petition pages. The warning states, in general, that providing false information as part of signing the petition is a misdemeanor. Although it is required, correspondence from the Secretary of State's office indicates this technical deficiency may not be enough to invalidate a petition. The Office of the Secretary of State informed us that "Judges often discount requirements if they deem them to be administrative." This means that where the technical omission does not materially detract from the substance of the petition and its sufficiency, courts will likely deem the petition valid despite the omission. Betty Johnson and I reviewed this omission. I concur that because the signatures check out as valid on this petition, the warning about not giving a false statement does not mar the validity of this particular petition for a no shooting zone. We got review back from auditor's office last week. Haven't had a chance to really analyze the options to put before you. What I wanted to do was give you a heads up about this issue. In the larger area, there are a sufficient amount of signatures. Look at it, consider alternatives, hold a public hearing. The second area where there is insufficient signatures, not sure if we would send petitioners out for more signatures, or the other alternative is if the Commissioners want to initiate under your own authority, we can consider that under your own initiative. Other option would be to say sorry not sufficient for this area, not proceeding on it at this time. Not asking for direction because I haven't done analysis to give you a staff recommendation. Sullivan noted DNR property between the two pieces and it goes down to the water, steep bank in a certain area and recent fire in discovery bay. If this is a homeowners association, surprised its not in their covenant, or they can make their own rule? Morley- pertain to citizens that don't live there? Kler —can they post? In March of 2015, after working closely with the Manager's office to make sure it was done properly, I submitted a No Shooting Zone petition on behalf of the residents of the Ocean Grove community. It had signatures from over 60% of the resident owners. The names have been certified by the Auditor and the Assessor as registered voters in the precinct and as property owners who reside on the property. Boundaries were well identified to facilitate enforcement. That should have made it a routine procedure whereby a hearing is scheduled, held and then a final approving vote is taken by the BOC.. There was one technical glitch in that a portion of the Ocean Grove plats, Ocean Grove 3, is physically separated from Ocean Grove Estates. Ocean Grove 3 does not have enough residences to meet the minimum number of households in a No Shooting Zone. I was assured that the Board of Commissioners was willing to adopt the No Shooting Zone for that area by resolution. In the 17 months since submission, I have made personal inquiry as to the progress and met with the manager and Commissioner Sullivan—all to no apparent avail. I have been told that everything is in order but the hearing is still to be scheduled. I need to report back to my board and community as to what is causing this delay. Thanks for your time.
