I also have concerns regarding the site's security. Security is essential to marijuana production facilities, yet applicant Olympus Gardens (currently licensed for a facility in Silverdale), has multiple security violations as listed on the Washington State Liquor and Cannabis Board's website (http://lcb.wa.gov/records/freguently-requested-lists). The response time by fire and ambulance services to the north end of Marrowstone Island can be 20 minutes. I believe that the production and processing of commercial marijuana is fundamentally incompatible with land use zoned as "rural residential", and instead, belongs in areas zoned for agricultural or industrial use. The required fencing and lighting, among other security measures, clearly differentiates marijuana growth and processing from other agricultural enterprises, making it uniquely obtrusive and adversely impacting the character and aesthetics of residential communities. Odors and volatile organic compounds (VOCs) can be expected to degrade air quality, while fertilizer and pesticide runoff can potentially contaminate the aquifer and on-site stream. Many Marrowstone Island residents are entirely or partially dependent upon well water, and there do not appear to be any regulations in place to ensure that the operation is strictly organic. All these factors will predictably result in devaluation of surrounding residential properties. It appears that this proposal for a "cottage industry permit" under Jefferson County Code (JCC) 18.20.170 is in direct conflict with the conditions set forth in Washington Administrative Code (WAC) 314-55-015(5) for marijuana production and processing. JCC 18.20.170 (3)(a) and (3)(n) state that all cottage industries shall "be operated by at least one full-time, bona fide resident in a single-family residence of the parcel on which the proposed use is being requested"; and that the enterprise must be "an accessory use to the residential use of a dwelling unit." Conversely, WAC 314-55-015(5) states that the WSLCB "will not approve any marijuana license for a '9 2`. location where law enforcement access, without notice or cause, is limited. This includes a personal residence." This proposal, for a 78x140, (i.e., 10,920 square foot), greenhouse/canopy does not conform to JCC 18.20.170 (3)(o), which states that "any new structure constructed to accommodate the cottage industry shall be limited in scale so that it is in character with neighboring properties. In no case shall more than five thousand(5,000) square feet of total building area on the property be devoted to the cottage industry." The proposed facility is more than double that limit. There are only a few commercial structures on Marrowstone Island, and none come anywhere close to approximating this in scale. This proposal is clearly not "in character with neighboring properties" or consistent with scale of other commercial enterprises on the Island. A final concern that I would like to bring to your attention, is that there are four fines and two written warnings associated with Olympus Garden's marijuana license. This track record suggests a high probability of continued violations, and does not bode well for making a good neighbor. I strongly urge the County to deny this permit, and I respectfully request that I receive notice of any hearings or decisions related to this proposed facility. Since then our family has become possibly the largest landowner on Marrowstone Island with approximately 130 acres ownership in four different parcels. The largest parcel is just east of the proposed marijuana growing project. As manager of these properties I am strongly opposed to this marijuana growing project based on several environmental issues: water use, pesticide and chemical runoff, noise and odor concerns. Many island residents feel the time frame for comments was too short for a project this size. They also question the lack of notice given to them. He has received his license from the Washington State Liquor Board and put up a Notice sign which was only found by and observant person walking. We have lived on Marrowstone since 1977. When we purchase property, we were made aware of the Marrowstone Island Community Development Plan which has a well thought out policy regarding Commerce and Industry on the island. It does not seem possible that Mr. Smith's operation would be compliant with this policy. We do own property very close to 9272 Flagler Road, but our land is on Swartz Road. There is an area of poor drainage to the back of our land and also in the area of the proposed growing and processing operation. It is my understanding that septic tanks are not to be used in marijuana growing. I do request a hearing to determine if this person has the right to bring his business on to the island. Marrowstone Island is a dose-knit rural residential community,with only single-point access to mainland services. Applicant Olympus Gardens is seeking to establish a 10,000 square foot marijuana production facility on land currently classified as rural residential.It is my understanding that a commercial venture on rural residential lands is subject to rigorous county scrutiny regarding potential impacts to both immediate neighbors as well as the community as a whole. Based upon(but not limited to)the following,I believe the above land-use application requires a public hearing because: 1. Size and scope of this proposal is beyond the definition ofJefco.codes 18.10.030 and 18.20.170 pertaining to cottage industry: • Application does not meet the existing county definition of"limited,small-scale activity". • Proposed business would be within sight of the entrance to Fort Flagler State Park: a destination that routinely hosts activities induding scout camps,religious retreats,high-school band practice,and family camping.With or without advertising,the presence of a marijuana producer in this community would be out of character with existing land uses,and(per county code)"would adversely impact the(rural) residential character of the surrounding community". 2. Security concerns.Marrowstone Community Organization(MICA)recently hosted presentations from both the county sheriff and the fire department.Primary concerns were slow response times due to our island's limited access,in combination with limited available manpower for timely response. 1. Locating a marijuana production facility already underserved by public services risks creating an attractive nuisance and increased potential for theft in general;regardless of state/county security requirements. 2. Applicant's Washington State license#412943 shows an existing marijuana business in Kitsap County, and lists five(5)security-related violations from 07/14 to 02/16. (ref.WACs;Chapter 314-55;and http://lcb.wa.gov/records/frequently-requested-lists).Applicant's demonstrated lack of attention to security issues raises serious concerns for our semi-isolated island community. 3. Jefferson County Department of Community Development Attention: Pat Hopper 621 Sheridan StreetJEFFERSON COUNTY DCD Port Townsend,WA 98368 Dear Pat, I am writing to add my voice to the chorus of Marrowstone Island residents in opposition to the application for an industrial Marijuana growing and processing facility on our island. The reasons for opposing the facility and operation are many and are broadly shared by the population of Marrowstone. A large contingent from Marrowstone provided public comments opposing the application at today's County Commissioner's meeting,as you may know. We hope the Department of Community Development is aware of this broad,multifaceted opposition. It is important to note, however,that our neighborhood reaction is based on concerns about our environment and community and not out of opposition to such a business anywhere in Jefferson County. If a more appropriate site can be found on the mainland,we would not oppose the application (see P.S.below). To summarize my concerns: The industrial Marijuana facility, operation, and apparent plans for further development, are fundamentally at odds with the nature of our rural residential community. The Marrowstone Island Community Development Plan (still in force with the county) is clear on many of these issues. A business of this size and nature is not appropriate for our island or the site. The environmental impacts of the large industrial operation are also fundamentally at odds with the nature of the island and its physical and community structure. The pollution risks to the air and aquifer are extreme. In addition,there are many negative secondary effects on humans and wildlife from industrial noise, chemical usage,lighting,odors,and the risks that water contamination will eventually affect the aquaculture industry on the island and nearby. The impact to the community is negative across a broad range of issues not limited to safety,property value declines,and unreasonable demands on resources such as public water and power,law enforcement,and fire safety. The applicant has a history of bad behavior and violations of the conditions and regulations he is supposed to operate under. A similar operation he owned in Silverdale was shut down after several violations. His agents have lq 2t �g recently been trying to manipulate the public comment process by putting out words to the effect that'it's a done deal, comments are a waste of time'. The application includes the interesting detail that the workers will live on- site. This gives us full time resident workers,probably doubling as armed guards, and a Tier 3 industrial farm all relying on a three bedroom septic system existing on the property. One must assume this element of his plan is an attempt to appear in compliance with the "cottage industry" component of the Marrowstone Community Development Plan. But it only adds risk and subtracts credibility in the eyes of the island community. Altogether this creates additional concern and tangible risk that his hoped-for operation on Marrowstone will not be run in a manner consistent with the needs of our community or our environment. The fact that he has chosen Marrowstone at all,given our fragile environment, community needs and concerns, and history of opposing similar industrial operations on the island,shows how much he is at odds with the place and people comprising Marrowstone. This is the most compelling evidence that the applicant and his business are better suited for a location much more removed from rural residential communities and delicate environmental circumstances. We hope you and your Department agree. Our request is that the application be denied, or at the very least,be elevated in review status to give people further opportunity,via a public hearing,to voice their concerns. We also are concerned that such an operation would be exempt from a SEPA review. Perhaps DCD can help our community understand that circumstance as well. I strongly object to the lack of public notice and the short time line for public comment. The Cottage-Industry-Permit that allows a 10,080 square foot structure that is 23 feet tall is not compatible with the rural environment of open spaces on Marrowstone Island. These kinds of businesses should be confined to areas that welcome industrial development. The environmental impact of high water use, runoff from pesticides and other chemicals is unacceptable on this small island. A similar proposal on Gybe Ho Rd. was recently defeated. I also question the validity of applicants who do not live on Marrowstone and have no vested interest in our rural community. I request a public hearing regarding the permits proposed by Case Numbers: ZON17-00002 and ZON17-00003 for a: "Tier 3, 10,000 square foot of canopy for production and a cottage industry permit for processing of recreational marijuana (The type of processing will be for flower and dry sifted hash) in a rural residential 1:10 zone on Marrowstone Island, case MLA17-00019. Production and processing will take place entirely inside a 10,080 square foot, 23 foot tall greenhouse, being reviewed under building permit BLD17-00093.Type A full screen landscaping is required to screen use from the road and adjacent parcels. Project shall comply with all applicable JCC sections, including JCC 18.20.295 Recreation Marijuana.The project is exempt from SEPA review under WAC 197-11-800(1)(b)(iii) and JCC 18.40.750(1)(c)." Citizens were given two weeks,after two inconspicuous notices were posted,to submit comment on this application. Given the level of controversy in this county over industrial marijuana grows in areas zoned Rural Residential I would have liked more timely and louder notice.There were 611 months between the initial contact with the county and when it was announced to island residents. We are approaching the 2018 revision of the Jefferson County Comprehensive Plan. According to the website,http://speakupjeffco.com/. . . "A rural quality of life is what attracts many people to Jefferson County and is the very thing we want to protect.The Comprehensive Plan preserves and promotes those community values that affect that quality of life.The Plan directs more intensive development to appropriate areas while protecting and conserving environmentally sensitive areas like wetlands, as well as natural resources, rural character, and open space lands." It's a worthy goal,to protect our way of life here. All these factors will predictably result in devaluation of surrounding residential properties. It appears that this proposal for a "cottage industry permit" under Jefferson County Code (JCC) 18.20.170 is in direct conflict with the conditions set forth in Washington Administrative Code (WAC) 314-55-015(5) for marijuana production and processing. JCC 18.20.170 (3)(a) and (3)(n) state that all cottage industries shall "be operated by at least one full-time, bona fide resident in a single-family residence of the parcel on which the proposed use is being requested"; and that the enterprise must be "an accessory use to the residential use of a dwelling unit." Conversely, WAC 314-55-015(5) states that the WSLCB "will not approve any marijuana license for a '9 2`. location where law enforcement access, without notice or cause, is limited. This includes a personal residence." This proposal, for a 78x140, (i.e., 10,920 square foot), greenhouse/canopy does not conform to JCC 18.20.170 (3)(o), which states that "any new structure constructed to accommodate the cottage industry shall be limited in scale so that it is in character with neighboring properties. He has received his license from the Washington State Liquor Board and put up a Notice sign which was only found by and observant person walking. We have lived on Marrowstone since 1977. When we purchase property, we were made aware of the Marrowstone Island Community Development Plan which has a well thought out policy regarding Commerce and Industry on the island. It does not seem possible that Mr. Smith's operation would be compliant with this policy. We do own property very close to 9272 Flagler Road, but our land is on Swartz Road. There is an area of poor drainage to the back of our land and also in the area of the proposed growing and processing operation. It is my understanding that septic tanks are not to be used in marijuana growing. I do request a hearing to determine if this person has the right to bring his business on to the island. The reasons for opposing the facility and operation are many and are broadly shared by the population of Marrowstone. A large contingent from Marrowstone provided public comments opposing the application at today's County Commissioner's meeting,as you may know. We hope the Department of Community Development is aware of this broad,multifaceted opposition. It is important to note, however,that our neighborhood reaction is based on concerns about our environment and community and not out of opposition to such a business anywhere in Jefferson County. If a more appropriate site can be found on the mainland,we would not oppose the application (see P.S.below). To summarize my concerns: The industrial Marijuana facility, operation, and apparent plans for further development, are fundamentally at odds with the nature of our rural residential community. The Marrowstone Island Community Development Plan (still in force with the county) is clear on many of these issues. A business of this size and nature is not appropriate for our island or the site. The environmental impacts of the large industrial operation are also fundamentally at odds with the nature of the island and its physical and community structure. The pollution risks to the air and aquifer are extreme. In addition,there are many negative secondary effects on humans and wildlife from industrial noise, chemical usage,lighting,odors,and the risks that water contamination will eventually affect the aquaculture industry on the island and nearby. The impact to the community is negative across a broad range of issues not limited to safety,property value declines,and unreasonable demands on resources such as public water and power,law enforcement,and fire safety. The applicant has a history of bad behavior and violations of the conditions and regulations he is supposed to operate under. A similar operation he owned in Silverdale was shut down after several violations. His agents have lq 2t �g recently been trying to manipulate the public comment process by putting out words to the effect that'it's a done deal, comments are a waste of time'. The application includes the interesting detail that the workers will live on- site. This gives us full time resident workers,probably doubling as armed guards, and a Tier 3 industrial farm all relying on a three bedroom septic system existing on the property. One must assume this element of his plan is an attempt to appear in compliance with the "cottage industry" component of the Marrowstone Community Development Plan. But it only adds risk and subtracts credibility in the eyes of the island community. Altogether this creates additional concern and tangible risk that his hoped-for operation on Marrowstone will not be run in a manner consistent with the needs of our community or our environment. The fact that he has chosen Marrowstone at all,given our fragile environment, community needs and concerns, and history of opposing similar industrial operations on the island,shows how much he is at odds with the place and people comprising Marrowstone. This is the most compelling evidence that the applicant and his business are better suited for a location much more removed from rural residential communities and delicate environmental circumstances. Our request is that the application be denied, or at the very least,be elevated in review status to give people further opportunity,via a public hearing,to voice their concerns.
