DATE: May 16th, 2017 Section JCC 18.40.520(2) of the Jefferson County Unified Development Code stipulates criteria for determining whether a Conditional Discretionary"C(d)" Use Permit shall be processed as a Type II or Type III permit. Prior to referring the Conditional Use Permit to the Hearing Examiner, the Administrator shall make one of the following findings: (a)(i) In the exclusive, discretionary judgment of the Administrator, the application involves potentially significant issues relating to location, design, configuration, and potential impacts to surrounding properties and the community that can be more appropriately considered and addressed through an open record hearing before the Jefferson County Hearing Examiner; or (a)(ii) In the exclusive, discretionary judgment of the Administrator, the application seeks approval of a use involving complex legal issues necessitating special expertise in the decision-maker. Staff Findings Proposal for a conditional (discretionary) use permit for Olympus Gardens, Washington State Liquor and Cannabis Board License#412943 for Tier 3, 10,000 square foot of canopy for production and a cottage industry permit for processing of recreational marijuana(The type of processing will be for flower and dry sifted hash) in a rural residential 1:10 zone on Marrowstone Island, case MLA17-00019. Production and processing will take place entirely inside a 10,080 square foot, 23 foot tall greenhouse, being reviewed under building permit BLD17-00093. Type A full screen landscaping is required to screen use from the road and adjacent parcels. Project shall comply with all applicable JCC sections, including JCC 18.20.295 Recreation Marijuana. The project is exempt from SEPA review under WAC 197-11-800(1)(b)(iii) and JCC 18.40.750(1)(c). g or ''rr # _l _- Pagcj3 1 - of 2 Public Comment: One hundred and three (103) total comments were received from adjacent property owners, agencies or the general public. Comments were mostly from the general public/citizens of Marrowstone Island, and were opposed to the project for a variety of reasons, including the size and industrial nature of the proposed greenhouse, potential impacts to ground water aquifers and other critical areas, odors and smells, security concerns, light pollution and impacts to property values. A full list of the comments and the subjects of their concerns has been attached to this memo. Staff Conclusion Because this application involves potentially significant impacts to the surrounding properties and the community, as well as size, design and location concerns, staff concludes that the above criteria under JCC 18.40.520(2)(a)(i) apply and therefore recommends that MLA17-00019 be processed as a Type III Conditional "C" Use Permit with a Public Hearing and a Decision by the Jefferson County Hearings Examiner.
