The size determines whether a Stormwater Site Plan is required in conjunction with a stand-alone stormwater management permit application, building permit application, or other land use approval application that involves stormwater review. Finally, the access road behind the two parking spaces requires a 26' aisle width for two- way access or 23' for one-way access.This is for stalls with a 90 degree parking angle. If the road is intended for two-way access,then the aisle is too narrow. THIS ACCESS DRIVES SERVES THE ROAD SHOP, PIT AND SOLID WASTE DROP BOX. THE PARKING SPACES THAT ARE SHOWN CAN BE MOVED TO THE WEST, TO ACHIEVE CLEARANCE. THEY MAY ALSO BE ANGLED FOR EASIER IN AND OUT. WE CAN RESOLVE THIS POINT, TO COMPLY WITH THIS REQUIREMENT. 18.20.300 Recycling collection facilities and recycling centers.0 SHARE 1 (1) Recycling Collection Facilities. Recycling collection facilities provide a neighborhood drop-off point for temporary storage of recyclables but without processing thereof. The following standards apply to all recycling collection facilities: (a)Weather protection of recyclable items shall be ensured by using weatherproof containers or by providing a roof over the storage area,where necessary to avoid adverse impacts; RECYCLING BINS ARE WEATHER PROTECTED CONTAINERS WITH TOPS. (b)Only recyclable materials shall be collected and stored at such collection points. Except for initial sorting and bundling, all other processing of such materials shall be conducted off-site; and RECYCLING BINS ARE HAULED OFF SITE TO THE JC TRANSFER STATION ON COUNTY LANDFILL ROAD FOR SORTING PRIOR TO SHIPPING (c)All deposited material shall be contained wholly within the recycling box or facility. No litter shall be allowed to accumulate outside the recycling box or facility. The recycling box or facility shall be kept clean and free of odors or pests. General Permit Conditions A. The holder of this permit shall comply with WAC 173-350-310 for Intermediate Solid Waste Handling Facilities and Jefferson County Code 8.10.310 for Intermediate Solid Waste Handling, as well as all applicable local, state and federal regulations. Where any conflicts between any regulations exist, the more stringent shall apply. It is the responsibility of the permittee to remain informed of these regulations. B. All conditions of this permit shall be binding in order for the permit to remain valid. The permittee shall bear responsibility for the actions and omissions of all facility agents and contractors. This condition shall remain in effect for the life of the facility, including closure activities. C. The permittee shall allow authorized representatives of Jefferson County Public Health or the State Department of Ecology to inspect the facility, equipment and records at any reasonable times, regardless of prior knowledge of the inspection. D. The permittee shall notify Jefferson County Public Health's Solid Waste office immediately of any spills, releases, contaminations, or threats to human health or the environment, while taking all necessary measures to protect the same. E. The Health Department may suspend or revoke this permit if the permittee: • fails to adhere to the terms of this permit and the approved plan of operation, • fails to meet all applicable regulations, or • fails to provide all information that could be deemed pertinent to the issuance of the permit in an accurate, complete form. F. If Jefferson County Public Health determines Jefferson County Public Works has violated or is violating a term of this permit, notification of the violation and an opportunity for voluntary correction will be provided. G. Any Jefferson County Public Health action to enforce this permit shall be subject to the notice and hearing provisions of Jefferson County Ordinance Chapter 8.10.950. H. Jefferson County Public Works shall file an application for renewal of this permit no later than 30 days prior to the expiration of the permit. All terms and conditions of this permit shall continue in force and effect until Jefferson County Public Health issues the renewal permit, formally denies the permit, or issues a new permit for the facility under WAC 173-350-310. I. Should either party wish to amend this permit, it shall give notice to the other of the requested changes. The parties shall work together toward an agreement on permit revisions. If they do not reach agreement, and Jefferson County Public Health unilaterally changes the permit, the change will be subject to the appeal procedure outlined in Jefferson County Code 8.10.950(7). Specific Permit Conditions A. The permittee is authorized to operate an Intermediate Solid Waste Handling facility following the plan of operations approved 2010 and amendments. Only activities detailed in this plan are approved. B. The plan of operations is to be posted in the work place where personnel can readily refer to it and shall be provided upon request to Jefferson County Public Health. C. The permittee is charged with informing all agents and contractors of the conditions of the plan of operations. D. This permit or a valid copy shall be displayed in a manner which allows easy access by facility personnel. Section 3. Minimum Performance Standards A. Per WAC 173-350-040, the permittee and all agents or contractors shall: 1) Design, construct, operate, and close the facility in a manner that does not pose a threat to human health or the environment; 2) Comply with chapter 90.48 RCW, Water Pollution Control and implementing regulations, including chapter 173-200 WAC, Water Quality Standards for Ground Waters of the State of Washington; 3) Conform to the approved local comprehensive solid waste management plan prepared in accordance with Chapter 70.95 RCW, Solid Waste Management— Reduction and Recycling; and 4) Not cause any violation of emission standards or ambient air quality standards at the property boundary of the facility and comply with Chapter 70.94 RCW, Washington Clean Air Act. 5) Comply with all other applicable local, state and federal laws and regulations. B. Ensure that containers and tanks holding MRW are maintained in good condition(e.g., no severe rusting or apparent structural defects); v. Provide secondary containment for containers and tanks capable of storing fifty-five gallons or more of liquid MRW; vi. Ensure the facility meets the performance standards of WAC 173-350- 040; vii. Notify the department and the jurisdictional health department of any failure to comply with the terms and conditions of this subsection within twenty-four hours of knowledge of an incident; viii. Allow inspections by the department and jurisdictional health department at reasonable times; ix. Maintain records of the amount and type of MRW received, and the final disposition of the MRW by amount and type; and x. Prepare and submit a copy of an annual report to the jurisdictional health department and the department by April 1st on forms supplied by the department. The annual report shall cover the facility's activities during the previous calendar year. C. The permittee and all agents or contractors shall meet the operating standards of WAC 173-350-310(5)to control dust, nuisance odors and attraction of vectors. Section 4. Reporting A. Jefferson County Public Works shall maintain daily operating records on the weights and types of wastes received or removed from the facility. Facility inspection reports shall be maintained in the operating record. Significant deviations from the plan of operation shall be noted in the operating record. Records shall be kept for a minimum of five years and shall be available upon request by the jurisdictional health department for inspection purposes. B. No conditional use permit can be granted unless consistency with the performance standards of JCC 18.20, the development standards of JCC 18.30, the procedural requirements of JCC 18.40.280, and the approval criteria of JCC 18.40.530, and other applicable requirements of the UDC have been satisfied. Approval of the conditional use is effective for three(3) years from the date of original approval. If a building permit has not been issued within the three(3) year period, the conditional use approval will expire. The following questions will assist in the evaluation of the conditional use request: 1. Describe the requested conditional use. The installation of a 275 S.F. Attendant Office. Also, upgrades to an existing shipping container to serve as a Household Hazardous Waste collection station. Utility improvements such as a septic tank and a transport line to the existing septic system location onsite on the adjacent county parcel to the east. 2. Explain how the conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of development in the vicinity and with the physical characteristics of the subject property. This drop box site has been in service for several decades to serve the Quilcene area. This County parcel is 15.22 acres and includes a gravel pit. The adjacent County Parcel which serves as Road Shop and Fueling Station, is 9.65 acres in area and together form a contiguous County site. The site is buffered on all sides by wooded areas. 3. Describe the infrastructure including but not limited to roads, fire protection,water, wastewater disposal, and stormwater control which will serve the requested conditional use. These two County Parcels are served by an existing access drive from US Highway 101. The Solid Waste site (#702231010) has a 2"water service supplied by the JC PUD#1 Quilcene water system. Connection to this water source is subject to confirmation of potable water availability. A Restrictive Covenant shall be executed by the BoCC to provide for the septic transport line to the adjacent County parcel to the east(#70224205). 4. Describe the location,size, and height of buildings,structures,signage,walls and fences, and screening vegetation for the use. This site is fenced with a 6'-0"tall chain link fence and gate, which will remain in place. The proposed replacement of the Attendant Office is a 275 S.F. modular office, and 11'-6"tall. The Environmental Center, for the collection of household hazardous waste is 560 S.F. and is 9'-6"tall. 5. Describe any noise, smoke, dust, fumes, vibrations, odors, outdoor lights or other impacts will be generated by the conditional use. . This facility produces moderate impacts that are listed under item#5. The site is operated on a part time basis, three afternoons a week, plus all day on Saturday. Setbacks and the wooded buffer effectively block any disturbance generated from Solid Waste operations. 6. Describe the pedestrian and vehicular traffic and parking area associated with the conditional use. The site is operated the afternoons of Monday, Wednesday, and Friday, as well as all day on Saturday. Parking is provided onsite. The customers drive to the respective part of the site to unload solid waste, recyclables and household hazardous waste. Three new parking spaces are also provided Page 3 • • 7. Will the proposed conditional use result in the siting of an incompatible use adjacent of an airport or airfield? No. There is no airport in the area. 8. Are there any significant adverse impacts on the human and natural environments caused directly by the conditional use? If yes, can these impacts be mitigated? No. This is an attended site, and impacts are mitigated. All waste products are handled properly according to the Solid Waste operations plans. 9. Describe how granting the conditional use will not be materially detrimental to uses or property in the vicinity of the subject parcel. This is a continuation of an existing use. This site provides an essential public service. 10. Describe how granting the conditional use will not be substantially detrimental to the public interest. Granting conditional use will support the continuous operation of this service to the Quilcene area. 11. Does the conditional use have merit and value for the community as a whole? This site provides an essential public service to the southeast portion of Jefferson County.. 12. Describe how the conditional use complies with all other applicable criteria and standards of the Jefferson County Code(JCC) and any other applicable local, state or federal law; and more specifically, conforms to the standards contained in JCC 18.20 and JCC 18.30. This is a County Waste Management Facility as referenced in JCC 18.20. Parking,vegatative buffer, lighting and signage will be upgraded. 13. Describe how the conditional use is consistent with all relevant goals and policies of the Jefferson County Comprehensive Plan. This site has provided an essential public service for decades. This project will maintain and upgrade this use. The household hazardous waste Environmental Center is an upgraded service for the proper disposal of moderate risk household waste. No new clearing, grading, or other ground-disturbing activities are proposed. No processing of the hazardous materials is proposed. The Jefferson County Code is available on-line at http://www.codepublishinq.com/ DEVELOPMENT REVIEW DIVISION Land Use: • Zoning designations— Rural Residential 1:5. • Parcel is mapped as a mineral resource land overlay district. • SEPA (WAC 197-11)—The proposal would be exempt from SEPA review under WAC 197-11- 800(1)(iv). • Permitting process—Conditional use (administrative), per Table 3-1, Chapter 18.15 JCC. Apply for a Type II conditional use, which requires noticing of the application. • Proposal needs to comply with development standards in Chapter 18.30 JCC. Recycling Collection Facilities and Recycling Centers: • Proposal needs to comply with JCC 18.20.300. Stormwater: • Proposed residential development must comply with the Stormwater Management Manual for Western Washington (Washington Department of Ecology, 2012). Show proposed stormwater management on site plan. • Proposed project must comply with JCC 18.20.060 and 18.20.070. Critical Areas: • Proposal is outside of all critical areas, except critical aquifer recharge area (susceptible). The proposal involves hazardous materials so an aquifer recharge area report(JCC 18.22.120(1)) that complies with Articles Ill (Critical Aquifer Recharge Areas) and VIII (Special Reports) will be required at the time of application. A hazardous materials report must be submitted annually to comply with JCC 18.22.130(7). Land Use/Zoning Application and Fees: • Complete Zoning Conditional Use (Administrative)Application includes the following: o Permit Application o Supplemental Conditional Use Application o Site Plan o Detailed Plan Sheets o Stormwater Calculation Worksheet o Aquifer Recharge Area Report • Land use/zoning permitting fees due at the time of application: $1,172.00 ($990.00—conditional use; $159.00 notice of application and notice board; and $23.00 scanning fee). • Other permitting fees (such as building, environmental health) may apply to this application and would be in addition to the land use/zoning fees above. OTHER REGULATORY/LAND USE CONSIDERATIONS • The proposal will be reviewed by Environmental Health for compliance with septic, potable water, and hazardous materials requirements. The discussions at the conference or the information provided by the administrator shall not bind or prohibit the county's future application or enforcement of all applicable laws and regulations. No statement or assurance made by county representatives shall in any way relieve the applicant of his or her duty to submit an application consistent with all relevant requirements of county, state and federal codes, laws, regulations and land use plans.
