1.) The applicant shall ensure that all shoreline permit conditions are followed and shall
provide the contractor with a copy of the shoreline permit. Failure to comply with
conditions in the shoreline conditional use permit shall render the project non-compliant
with those permit conditions.
2.) The applicant shall ensure that the Inadvertent Discovery Plan for archaeological and
cultural resources is provided to the contractor prior to beginning any work on this project.
3.) The site plan, as submitted with the building application on August 10, 2016, has been
reviewed for consistency under the UDC, and has been approved by Jefferson County
Department of Community Development. Any modifications, changes, and/or additions to
the stamped, approved site plan dated August 23, 2016 shall be resubmitted for review
and approval by Jefferson County Department of Community Development.
4.) This approval is for a tram to an existing deck on the shoreline only. Any future permits
on this site are subject to review for consistency with applicable codes and ordinances
and does not preclude review and conditions which may be placed on future permits.
5.) The project shall adhere to the Best Management Practices (BMPs)to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.

1GEOTECHNICAL REPORT PREPARED BY ASPECT CONSULTING AND THAT THE

PROJECT DESCRIPTION:
SHORELINE CONDITIONAL (ADMINISTRATIVE) USE application to construct a tram to the beach. The tram will have
two rails with a six-foot-wide footprint and will be 49 feet in length. An upper landing is proposed and the tram will end at
an existing deck on the beach. The tram would provide handicapped access to the beach. The applicant has submitted
a habitat management plan and a geotechnical report in support of the application.
PROJECT LOCATION: 510 Adelma Beach Road, Port Townsend, Washington
WATERBODY AND/OR ASSOCIATED WETLANDS: DISCOVERY BAY
SHORELINE OF STATE-WIDE SIGNIFICANCE: NO
SHORELINE DESIGNATION: SHORELINE RESIDENTIAL
Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of
the Jefferson County Shoreline Management Master Program and the following conditions:
Conditions:
1. The applicant shall not begin any work approved under this conditional use permit until written authorization to
proceed has been obtained from Ecology.
2. Prior to constructing the structure, the applicant shall obtain a building permit from Jefferson County Department of
Community Development. Stamped, engineered drawings shall be included in the building application submittal.
3. Substantial progress towards completion of the project shall be performed within two years of the issuance of the
permit.
4. If a Hydraulic Project Approval (HPA) is required from the Washington Department of Fish and Wildlife, the applicant
shall adhere to all HPA requirements.
5. Temporary erosion control measures shall be in place prior to construction, and all applicable stormwater best
management practices(BMPs), such as silt fencing or hay bales, shall be used to prevent erosion. The project shall
adhere to BMPs to control stormwater, erosion and sediment during construction. BMPs shall address permanent
measures to stabilize soil exposed during construction.
6. All development shall be constructed to comply with the 2012 Washington Department of Ecology Stormwater
Management Manual for Western Washington.
7. The applicant shall comply with recommendations in the geotechnical report, including but not limited to:
a. piles shall be driven to a depth of at least 20 feet;
b. deep-rooting plants shall be maintained along a 15-foot-wide vegetated swath at the crest of the slope;
c. woven jute-map shall be used in areas of vegetation clearing (or areas that erode)to help hold the slope
stable until vegetation takes root;
d. construction area shall not be left un-compacted and exposed to moisture;
e. work shall be scheduled to minimize the time the slope is exposed; and
f. project geologist shall be on-site during construction, as appropriate, to ensure the tram is installed per
guidance in the geotechnical report.
8. Prior to receiving a building final, a letter prepared by the project geologist is required that states the tram was
constructed based on recommendations in the geotechnical report.

9. The applicant shall implement theigigation, as presented in the Habitat Manage t Plan, except that the 12
Oregon stonecrop (Sedum oreganum) 1 the 12 spreading stonecrop (Sedum diver) shall be replaced with 24 •
coastal strawberry(Fragaria chiloensis) for a total of 52 native plants installed in the mitigation area.
10. The applicant shall insure that the attached Inadvertent Discovery Plan prepared by Jamestown S'Klallam Tribe is
provided to the contractor. In the event that any archaeological artifacts or human remains area found, the applicant is
required to implement the plan, including but not limited to, immediately stopping all work and contacting all applicable
agencies and tribes.
11. Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate
review from this Department.
12. Construction shall be in substantial compliance with the site plan submitted on June 23, 2016 as it exists now or is
hereafter amended by Jefferson County and/or the Washington Department of Ecology.
13. No fill or other material may be placed in the waters or intertidal areas of Jefferson County.
Findings:
1.) The findings for this application are presented in the staff report dated July 5, 2016.
2.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal
ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58.
Development pursuant to this permit shall be undertaken subject to the applicable policies and performance
standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified
Development Code.
If during excavation or development of the site an area of potential archaeological significance is uncovered, all
activity in the immediate area shall be halted, and the Administrator shall be notified at once.
The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon
became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the
ESA, any person may bring lawsuit against any individual or agency that"takes" listed species(defined as
causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries
Service can levy penalties. Portions of Jefferson County, including marine environments are included as
"critical habitat"for listed species. Development of property along any marine shoreline, freshwater shoreline,
or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage
habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are
advised to do the following:
-All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters
- Remove minimal vegetation for site development, especially large trees
-Allow trees that have fallen into surface waters to remain there
-Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into
surface waters or roadside ditches
The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an
eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald
eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take"
occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law
a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and
Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project.
Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with
Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a
professional fisheries habitat biologist, and following the recommendations for site development provided by
the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish
and Wildlife Service.
