The proposal is required to comply with the Jefferson County Shoreline Secondary and Substantial Development Permit (SDP 03-17) approved November 5, 2004 by the Hearing Examiner subject to 20 conditions of approval (listed below). 1. Prior to issuance of the Jefferson County Building Permit, the applicant will be required to submit the following: i. A small parcel Drainage and Erosion Control Plan as required by the Jefferson County UDC and described in UDC 3.6.10.f. Once the subject permit has been issued, the applicant shall fully implement the provisions of the submitted Drainage and Erosion Control Plan; and ii. A revegetation plan that indicates native plant species to be used for the purpose of shore bank retention, locations of plantings, and timelines for planting. This permit does not authorize the removal of any trees. 2. Proper disposal of construction debris must be on land in such a manner that debris cannot enter the water body or cause water quality degradation of state waters. 3. All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance with the Best Management Practices approved by the Washington Department of Fish and Wildlife. 4. In order to minimize visual impact, the pier, ramp, and float shall be constructed to harmonize with the local shoreline environment to the maximum extent practicable. This includes utilizing appropriate color(s), texture, non-reflective materials, and other design characteristics. 5. Construction shall be in substantial compliance with the site plans submitted to Jefferson County during the permit process as they exist now or are hereafter amended by Jefferson County and/or the Washington State Department of Ecology. 6. No fill or other material may be placed in the waters or inter tidal areas of Jefferson County. 7. Work within the jurisdiction of the Shoreline Program other than as described above shall receive separate review from this office. 8. Substantial progress towards completion of the project shall be performed within two years of the issuance of the permit. 9. Prior to construction, the proponent shall contact the Jefferson County Department of Community Development at (360) 379-4450 with estimated project timelines for monitoring and plan compliance. 10. Prior to the onset of construction, the applicant shall provide the Department of Community Development with the name and address of the contractor carrying out the project. 11. The applicant shall comply with the requirements of the Hydraulic Project Approval #ST-F7590-01 issued on June 23, 2004 from the Washington Department of Fish and Wildlife. The proponent shall notify the US Army Corps of Engineers (COE) prior to commencing construction of the pier, ramp, and float to ensure that the requirements of the Section 10 Permit of the 1899 Rivers and Harbors Act are met. Contact the US Army Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more information. 13. A building permit is required from the Jefferson County Department of Community Development prior to the construction of the pier, ramp, and float. This shall include engineered stamped plans to ensure that the design of the over-water structure is safe in this marine environment. 14. Prior to the issuance of a building permit for the pier, ramp, and float, the applicant shall submit a landscaping plan to DCD and Randi Thurston WDFW for review and approval. At a minimum the plan shall be for two 3-4 foot wide by 15-20 foot long areas located at the top of the bank as specified by the Corp of Engineers Permit(Log item 10). This area shall be comprised of native shrubs planted on 3 foot centers and native trees planted on 10 foot centers, and with a minimum 80 percent survival rate after five years. 15. Prior to the issuance of a building permit for the structure (pier, ramp, and float), a flood certificate meeting the requirements of the Jefferson County Flood Damage Prevention Ordinance (Ordinance No. 18-1120-95) shall be submitted to DCD for review and approval. This shall include ensuring that the structure has low flood damage potential, proper anchoring, and elevated or flood-proofed utilities. 16. Utility service for the pier and dock shall be on or under the decking. Lighting shall be • • shielded to prevent unnecessary glare off-site and to not impact navigation. No overhead lighting is permitted. 17. Structures, equipment, and materials shall be maintained. Structures, equipment, and materials shall be removed as soon as practicable upon the cessation of a project's operation or the structure becomes so dilapidated that it requires total replacement. If the structure is not maintained or utilized for over one (1) year, it shall be removed regardless of future anticipated use unless prior permission has been granted by the Jefferson County Department of Community Development based on the showing of good cause. 18. Boats that are occupied shall not be permitted to moor at private docks, piers, and floats longer than three (3) days unless pump-out facilities are available in the immediate vicinity. 19. Buoys shall be discernible under normal daylight conditions at a minimum of 100 yards. The buoy shall be marked with the owner's name, address, and phone number. 20. The buoy system shall be adequate to withstand the maximum expected physical stress that the environment and moored craft will place on the buoy. No more than two (2) boats shall be secured by a mooring buoy. 2.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 3.) Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers (COE) in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands.
