Cooperative Agreement Between
Washington State University 4-H Youth Development
And
Jefferson County
THIS AGREEMENT, made and entered into by and between Washington State University 4-H Youth
Development, an institution of higher education and an agency of the State of Washington hereafter
referred to as "WSU", and Jefferson County.
Purpose: WSU and Jefferson County wish to provide a setting for young people and adults to work
together to experience adventure -based education through the 4-H Challenge Program.
I. WSU and Jefferson County mutually agree to:
1. Enroll all youth and adults in 4-H and maintain record of those who participate in
Challenge 'activities.
2. WSU provides standard Challenge Course forms for day use, group enrollment, participant
health and release records, Facilitator and leader forms, and screening/ background check
forms; Jefferson County insures the timely completion of all WSU forms and provides to
WSU for storage and archive.
3. Participate in Washington State 4-H Challenge management group.
4. WSU 4-H and Jefferson County will be identified in all promotional materials.
5. All facilitators must have a 4-H approved training and certification in the proper
procedures and protocols for facilitating groups through the 4-H Challenge Course.
Facilitator Record must be maintained.
6. Have Jefferson County's facilitator certification and re -certification system approved by
WSU 4-H.
7. After the program is solidly established, provide a certified facilitator to become part of the
statewide safety inspection team.
8. WSU and Jefferson County will agree upon fees and fiscal systems in writing.
II. WSU Agrees to:
1. Provide curriculum for the adult leaders of the 4-H Challenge program.
2. Provide training to adult volunteers for leading programs on the Challenge Course and
other 4-H Challenge activities with certain expenses for the 4-H Challenge training to be
negotiated between Jefferson County and WSU.
3. Cover enrolled WSU 4-H volunteers with liability insurance and L&I medical coverage in
accordance with Washington State 4-H Youth Development Program Policy, publication
EM 0758 which is granted it's legal authority from the Washington Tort Claims Law.
III. Jefferson County agrees to provide the following services to the Washington State 4-H
Youth Development Program:
1. Access to the Jefferson County Challenge Course for 4-H activities and training.
2. Access to all Challenge Course equipment and agreed upon buildings.
3. Maintain the Challenge Course and equipment in accordance with ACCT and WSU
standards.
4. Have inspected on a periodic basis the Challenge Course equipment and program by
the 4-H Challenge Safety Committee as per University established procedures.
Jefferson County will cover inspector's fees and expenses.
5. Maintain all records, except those maintained by WSU 4-H, needed for the WSU 4-
H inspection team
6. Provide a place to archive course records.
7. Check all day use forms for maintenance needs observed and first aid equipment
used and respond where appropriate.
8. Obtain accident/injury event insurance for all youth and their leaders who
participate in Challenge program at the course. (Actual premiums to be paid by
participants.)
9. Jefferson County L&I insurance will be the first payee for Jefferson County
employees.
10. Provide trained facilitators and arrange and schedule facilitators and groups on the
Challenge Course.
IV. Mutual Hold Harmless:
Each party to this agreement shall indemnify and hold harmless the other party
to this agreement from all claims, costs, damages, or expenses arising out of the
negligence of that party. In the case of negligence of both parties, any damages
allowed shall be levied in the proportion to the percentage of negligence
attributable to each party. In no event shall a party be responsible for the acts
and omissions of the other party or it's officers, employees, and agents.

VI. Termination
No alteration or variation of terms of this agreement shall be valid unless made
in writing and signed by the parties hereto. Oral understandings or agreements
not incorporated herein shall not be binding. This writing constitutes the
complete and final agreement of the parties with respect to the subject matter.
This agreement may be terminated by either party by giving thirty days notice in
writing to the other party.
VII. ALTERNATIVE DISPUTE RESOLUTION
Parties to this agreement agree that all disputed under the terms of this
agreement shall be resolved in the following manner. If Parties mutually agree
there is a dispute about the terms of this agreement, each party shall appoint one
member to a dispute resolution committee. Those two members shall determine
the dispute in any manner they believe appropriate. Parties agree the decision of
the decision -makers shall be final and binding on making services in this
section. Nothing in this agreement prevents the Parties from following an
applicable Washington State Law.
VIII. Nondiscrimination
Title VI of the Civil Rights Act of 1964 (Public Law 88-352;42USC.2000d-1)
provides that no person in the United States shall, on the grounds of race, color,
or national origin, be excluded from participation in, be denied the benefits of,
or be subjected to discrimination under any program or activity receiving
Federal financial assistance. Title IX of the Education Amendments of 1972
(Public Law 92-318,20 USC 1681-1686), prohibits the exclusion of persons on
the basis of sex from any education program or activity receiving Federal
financial assistance. By acceptance of this agreement all parties will comply
with all the laws applicable regarding nondiscrimination.
IX. Notices
All official notices required under this agreement shall be given as follows:
