Commissioner Dan Titterness and Commissioner Richard Wojt were both present. APPROVAL OF MINUTES: Commissioner Wojt moved to approve the minutes of the September 17, 2001 as presented. Commissioner Titterness seconded the motion which carried by a unanimous vote. The Board met in EXECUTIVE SESSION with the County Administrator and the Deputy County Administrator regarding collective bargaining from 9:00-9:29 a.m. Discussion re: Labor Agreement in the Sheriff's Office; Teamsters Local 589: Commissioner Titterness moved to approve the economic provisions of the Teamsters labor agreement for the Sheriff' s Office Corrections, Dispatch and Administrative staff, contingent on the contract language changes being approved by the Union. Commissioner Wojt seconded the motion which carried by a unanimous vote. PUBLIC COMMENT PERIOD: One comment was made asking for information about how the process for setting up the Tri Area Planning Group will proceed, including the selection process and the work product of the group. APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Wojt moved to approve all of the items on the Consent Agenda as submitted. DEPARTMENT OF COMMUNITY DEVELOPMENT Discussion re: Advertising for Membership on Forest Land Task Force: Director of Community Development A1 Scalf advised that the Board directed DCD to establish this task force to investigate issues related to incompatible land uses between existing small parcels and adjacent forest lands pursuant to Comprehensive Plan Action Item # 13 on page 4-43. The stakeholder group includes: Timber company representatives, landowners, environmental groups, and other parties. The advertisement for members will be county-wide and will be posted at the Community Centers, on the web site and at WSU. Commissioner Wojt pointed out that there was a Forest Lands Resource Committee in 1990 when the County started GMA planning. Al Scalf said that he will get a list of the members. The issue that requires the re-activation of this committee was brought forward by Green Crow and other timber owners. The development of small parcels adjacent to forest lands and the setbacks required will be reviewed. The broad issue is the impact to parcels adjacent to forest lands. There are 330,000 acres of forest lands countywide. This could impact 9,000 acres. Chairman Huntingford asked about the number of citizens on the task force? Will there be a core group to work on the issues? Al Scalfreported that the advertisement could be placed to see how many people are interested before the Board decides the size of the committee which will review uses, development and performance standards. Commissioner Titterness asked how much work a consultant would have to do? Al Scalf answered that it's not a small amount of work. His preliminary guess would be $10,000 to$20,000 worth of consultant work. Commissioner Titterness asked if this amount is in the budget for 2001 or included in the 2002 request? Al Scalf advised that it is not budgeted. Chairman Huntingford said that he feels alternative 2 (Direct staff to look at this issue in the context of their entire work plan and prepare a schedule for initiation and completion by removing other work plan items) would work with assistance from a consultant. Commissioner Titterness moved to approve moving this forward as stated in alternative 2 with assistance from a consultant. Chairman Huntingford added that he wants DCD to come back to the Board with a plan for the work to be done with the help of a consultant. Commissioner Wojt seconded the motion which carried by a unanimous vote. Page 2 Commissioners Meeting Minutes: Week of October 1, 2001 Discussion re: Eastview Industrial Plat: A1 Scalf explained that he and Associate Planner Randy Kline reviewed the record and found exhibits from Comprehensive Plan adoption process. This property was zoned heavy industrial in 1994 because it is adjacent to the Port Townsend Paper Mill property. It was down zoned during the Comprehensive Plan adoption process. In their research, they didn't find any discussion or decisions specifically about this plat, but it is included in every reference to the Mill property. The property was platted in 1978-79. On April 21, 1998 the Board directed that 292 acres be left as heavy industrial and the Eastview Industrial Plat was included in that zoning. Now there are 283 acres in that heavy industrial area with the difference being the Eastview Industrial Plat. He then reviewed the process to change mapping errors. He advised that he feels this is a mapping error. Deputy Prosecuting Attorney David Alvarez stated that in the OEC appeal to the Western Washington Growth Management Hearings Board, the underlying designation of 600 acres in the County was faulted for lack of public process. This particular issue hasn't been brought up previously in the context of mapping less acres. It isn't clear why the 9 acres was omitted and he isn't sure if it was a policy decision or a mapping error. Changing a mapping error is always riskier than saying that the Eastview Plat can meet the logical out of boundary standards. This would be accomplished by proving that the built environment in the Eastview Industrial Plat was in place 1990. He is not sure if it would meet this criteria, but said that he would prefer that the County take that route if possible. Chairman Huntingford asked what that route would be? David Alvarez explained that the LAMIRD process would be completed in 2002. Chairman Huntingford explained that currently this property is zoned residential, 1 residence per 20 acres. Commissioner Titterness said that he feels a mapping error was made. Charles Saddler pointed out that it is difficult because we're speculating on what happened a number of years ago. On April 13, 1998, the documents indicate that the "heavy industrial zone should include the whole property." The next day, the Board directed staff to "leave it all as heavy industry, unchanged from the 292 acres." Staff must have taken the instructions to mean only the Port Townsend Paper Company site. The landfill site on the hill is not included either. David Alvarez noted that mapping errors have to be created by inaccurate information or technical errors on the part of the County. Charles Saddler stated that in his opinion this is a technical error because the Board's directions are 292.4 acres and that isn't what was zoned. The Board directed that DCD staff prepare a draft ordinance (per LMP 1.5.3) to correct this mapping error and start the process to include a public hearing. Al Scalfwill check to see when in the process this Board driven ordinance would need to be reviewed by the Planning Commission. Page 3 Commissioners Meeting Minutes: Week of October 1, 2001 The Board then met to review preliminary 2002 budgets from 11:30 a.m. to Noon for the following offices: Prosecuting Attorney, Coroner, Crime Victims Services, and the Jefferson County Drug Fund, and then from 1:30 to 5 p.m. for Central Services, Equipment Rental, Information Services, IDMS, Facilities Management, County Building, Construction and Renovation, Capital Improvement, Brinnon Facility, Distressed County Public Facilities, and the Conservation Futures Fund.
