MINUTES
Week of June 18, 2001
The meeting was called to order at 10:00 a.m by Commissioner Dan Tittemess.
Commissioner Richard Wojt was present. Commissioner Glen Huntingford was not present. The Board
dismissed the Commissioners' and County Administrator's briefings until next week.
PUBLIC COMMENT PERIOD: The Board opened an abbreviated comment period because
of the time. The only person that spoke asked if they could speak during the 11:00 a.m. discussion. The
Board agreed that they could speak then.
APPROVAL AND ADOPTION OF THE CONSENT AGENDA: Commissioner Wojt
moved to adopt and approve all of the items on the Consent Agenda as submitted. Commissioner Titterness
seconded the motion. The motion carried.

for bid award that is to the best advantage of the County. Commissioner Titterness seconded the motion.
The motion carried.
BID CALL and Approval of Construction Plans re: Lindsay Hill Road Restoration
Project #X01386; Sealed Bids Accepted until 10:00 a.m., Monday, July 16, 2001 and Opened and
Read Shortly Thereafter in the County Commissioners Chambers: Commissioner Wojt moved to
approve the bid call and the construction plans for the Lindsay Hill Road restoration project as submitted.
Commissioner Titterness seconded the motion which carried.
Request for Overnight Parking at East Beach, Marrowstone Island on Saturday, July
28, 2001; Roberta Hendrix: After reviewing this request for overnight parking at the East Beach County
Park, Commissioner Wojt moved to approve the request as submitted. Commissioner Titterness seconded
the motion which carried by a unanimous vote.
Discussion re: Traffic Safety Class: Deputy County Administrator, David Goldsmith,
reported that this traffic safety class program is an effort to reduce the number of cases going to court for
traffic infractions. Prosecution on traffic infractions can be deferred if the person takes the class. In
addition, the violation will not go on the person's driving record if they don't have any other driving
problems for a year following their participation in the class. The Court has the authority to allow this
program and to pass the fees on to the citizens involved. Sheriff Pete Piccini advised that the Traffic Safety
Coordinator in his office teaches this class. This is a good program and it has worked in other counties.
David Goldsmith noted that once the program is established, the County can send employees who have off
duty driving problems to it. Currently the County can take disciplinary action on an employee who has
driving problems when they are off duty. This will be an alternative to that action.

Resolution Rescinding and Invalidating Resolution #71-00, a Resolution Adopted
August 7, 2000 Statutory Vacation, Pursuant to the Non-User Statute of Certain Portions o£Julian
Street, Charles Avenue, and a Portion o£Alley Block 22 in the Eisenbeis Bay View Addition Plat;
Mark Hering and Marie Campanoli, Petitioners: County Administrator Charles Saddler advised that
this is the continuation of a discussion about an issue that has been going on for several months. In an
effort to avoid a lawsuit, the Board was asked to defer action on this resolution for two weeks to allow the
parties to negotiate. Deputy Prosecuting Attorney David Alvarez reported that nothing has happened with
those negotiations, and he recommended that this resolution not be approved or considered again by the
Board. He feels the County should go ahead with the summary judgment motion that has been prepared.
If the Board rescinds the resolution, the County has been assured another law suit will be filed.
Commissioner Titterness asked if there is a change to the value of parcels adjacent to a statutorily vacated
area? Assessor Jack Westerman reported that the assessment was not changed on the lots next to these
alleys. He advised that in some circumstances, where the vacated streets and alleys enlarge the adjacent
parcel, there is an increase in the parcel assessment. Commissioner Titterness asked if the County (the
Public) has any rights to the property that was statutorily vacated? David Alvarez advised that any right
the public may have had was lost in 1895. Malcolm Harris, Attorney, advised that he agrees with Mr.
Alvarez' opinion. Commissioner Wojt moved to deny this resolution to rescind Resolution No. 71-00.
Commissioner Titterness seconded the motion which carried.
Discussion re: 1) H.J. Carroll Park Caretaker's/Maintenance Project; and 2) Execution
o£CONTRACT with Viking Fence: Public Works Director Frank Gifford reviewed the plans for the
park including the maintenance and caretaker's areas. The access for the caretaker residence will come off
an existing street. The fencing surrounds the maintenance facility and another section surrounds the
caretaker's residence. This plan has been reviewed by the H.J. Carroll Park Committee.
Frank Gifford asked if the Board would approve the fencing contract? Commissioner Wojt moved to
approve the contract with Viking Fence Company as submitted. Commissioner Titterness seconded the
motion which carried.
Warren Steurer, Parks & Recreation Manager, reported that Jack (H.J.) Carroll donated $40,000 to the
park, of which $3,000 was held back for maintenance. The basketball court plans have been finalized and
the project will be implemented. Valerie Green, Architectural Coordinator, advised that there is one
more construction project at the park to come before the Board. It will be the last contract for the
caretakers/maintenance building. Warren Steurer advised that there will be a ceremony at the park this
week to recognize the people who have made donations to the park.

Discussion re: Creating a New Division for Natural Resource Management within Health
and Human Services Department: Environmental Health Specialist David Christensen advised that the
previous discussion about the creation of the Natural Resource Division needs to be clarified. The funding
request is for $40,000 annually. The confusion came from the use of the term "seed" money. This is an
annual funding request to allow this program to grow. There are many grant opportunities and many
programs that require continual County input. Charles Saddler advised that the request is for $40,000
annually through 2003 and then the program will be reviewed.
Commissioner Tittemess asked if creating this division will provide enough savings in other departments so
that cuts can be made? Charles Saddler answered that he doubts if the savings will be enough to allow cuts
in other budgets. This position will be assigned work that the other departments have been doing. This will
take a significant workload of added responsibilities off of the Environmental Health Department and will
allow them to focus on their own work. Right now the Environmental Health Director is spending about
15% of his time on water and septic issues and with the shift of this work he will be able to spend about
50% of his time on these matters, as well as working on ways to streamline and improve processes in
Environmental Health.
Commissioner Woj t moved to accept the staff recommendation to create a Natural Resources Division
within the Health Department. Commissioner Titterness seconded the motion. The Health and Human
Services Department will put forward a budget amendment to accommodate this division at the appropriate
time. Commissioner Titterness called for a vote on the motion. Commissioner Wojt and Commissioner
Titterness voted for the motion. The motion carried.

Policy and Procedures
1. PURPOSE
The purpose of this policy and procedure is to provide information on the
philosophy and operation of the Jefferson County Traffic Safety Class.
2. POLICY STATEMENT
Jefferson County Sheriff's Department and the Port Townsend Police Department
are committed to the safety and well being of their citizens and visitors. An
integral part of traffic safety is enforcement of the legal rules of our roadways.
Another part, of equal importance, is the prevention of traffic violations One
contributor to illegal and unsafe vehicle maneuvers on our roadways is lack of
knowledge of safe driving practices, laws governing motor vehicles, and proper
use of motor vehicle safety features. In keeping with Jefferson County law
enforcement's commitment to community safety, the operation of a traffic safety
class is an excellent way to provide assistance to the public in gaining their
compliance with traffic laws and their dedication to safe driving practices.
Jefferson County's Traffic Safety Class will create an opportunity for positive
interaction between law enforcement and the citizens of this county. We believe
that education is a venue for positive law enforcement that will lead to a safer and
healthier community by making the roadways safer for everyone. The objective
of the Jefferson County Traffic Safety Class is to make operators of motor
vehicles more aware of traffic laws, safe practices, and operation of vehicular
safety features.
The resources of the criminal justice system are finite Thus, the actions of law
enforcement agencies that affect the community must be carefully planned and
coordinated to assure efficiency Educating the population that disregards traffic
regulations may reduce future traffic problems and contribute to the welfare of the
community. The Jefferson County Traffic Safety Class is designed to provide
those individuals who have been cited for violating minor traffic laws and those
who hold suspended operators' licenses an opportunity to improve their
knowledge and understanding of traffic laws, accepted practices, and vehicle
safety features. It also gives them additional motivation to be better drivers by
keeping the violation off their driving record or by seeking outlined avenues to
regain a legal motor vehicle operator license. The advantage to the taxpayer and
the legal system is that diversion results in less use of the court and incarceration
systems. That allows the enforcement systems to redirect limited resources to
achieve greater effectiveness in dealing with other important issues.

3. CRITERIA AND ELIGIBILITY FOR ATTENDANCE
Attendance at the Jefferson County Traffic Safety Class is primarily those
individuals who are cited for minor moving violations under Title 46, Chapter 61
of the Revised Code of Washington, those individuals who have been cited for
Driving While License Suspended - Third Degree and wish to regain driving
privileges, and those assigned to the class as a condition of employment. In the
first case, the moving violation must have occurred within the boundaries of
Jefferson or Clallam Counties. A court may order anyone, at its discretion, to
attend Traffic Safety Class. An individual is only eligible to attend traffic school
for the purposes of deferment of a traffic violation or reinstatement of a
suspended license once within a seven-year period. Deferment of a traffic
violation by attendance at Jefferson County's Traffic Safety Class is completely at
the court's discretion. The applicant must first receive permission for the
deferment from the court prior to enrolling in the Class for that purpose.
Persons who have pending charges for Driving While License Suspended - Third
Degree or other criminal traffic offenses must obtain written authorization to
attend Traffic Safety Class from the court with jurisdiction It will be up to that
court to adjudicate the pending charges. The Traffic Safety Class Coordinator
will take no action regarding pending charges other than notification of successful
completion of the Class.
Persons who have been convicted of a sexual predator felony involving a vehicle,
or DUI offense are not eligible to attend the class.
4. PROCEDURE FOR LAW ENFORCEMENT OFFICER
Upon citing an individual for a traffic violation that meets the eligibility criteria
for attendance at the Jefferson County Traffic Safety Class, the law enforcement
officer issuing the citation should give the traffic school brochure to the offender.
The officer should explain that the individual might be eligible to attend the
Traffic Safety Class. The offender should be instructed to read the information
contained on the citation and the brochure If they wish to apply for the traffic
safety class, they must complete the application form contained in the brochure
and follow the directions.
5. DUTIES AND RESPONSIBILITIES OF THE CLASS APPLICANT
An individual who opts to take the Jefferson County Traffic Safety Class must
complete the application form and submit it with the $35 fee to the Sheriff's
Department at 81 Elkins Road. Port Hadlock, WA 98339. The application and fee
must be accompanied by the relevant document:
For a Deferment of an Infraction: A copy of the citation and court order
permitting attendance must accompany the application and fee and must be
received within 30 calendar days following a mitigation or a contested hearing

before a court that permitted attendance at Traffic Safety Class as an option. The
traffic offender must pay an administrative fee to the court, successfully complete
the Traffic Safety Class and not receive any further moving vehicle citations for
one year from date of the completion of the class in order to have a ticket
dismissed.
For Reinstatement of a Suspended Driver's License: A copy of the
participant's driving record, obtained from the Department of Licensing, must
accompany the application and fee. An applicant with pending criminal traffic
charges shall obtain written authorization for attendance from the court with
jurisdiction. An individual who has a suspended license in the third degree may
apply for the Traffic Safety Class as part of the Jefferson County Driver License
Restoration Program. To qualify for this program, the offender must be currently
employed, attend the 6-hour traffic safety class, and attend an additional 2-hour
session that will focus on their driver license history problems.
As a condition of employment: A copy of the letter requiring attendance
at the Jefferson County Traffic Safety Class from the participant's employer must
accompany the application and fee.
Failure to comply with directions will result in the automatic rejection of the
application
Individuals applying for the Traffic Safety Class will be notified within ten
calendar days of the receipt of their paperwork as to whether or not they have
been accepted. The acceptance letter will specify the date, time, and location of
the class.
The same fees shall apply to all individuals independent of their residency status
or reason for taking the class The Jefferson County Traffic Safety Class program
will attempt to deliver a certificate of completion to the class participant, but is
not responsible for insuring that a third party receive notification of completion.
The Traffic Safety Class will begin promptly at 8:30 AM and end at 3:00 PM with
a 30-minute lunch break. Breaks will be given at the discretion of the instructor.
Individuals attending Jefferson County's Traffic Safety Class may not be under
the influence of alcohol or other drugs. They must be on time for all segments of
the class, behave and dress appropriately. The class will be a non-smoking
environment. Failure to comply with orders from the instructor will result in
dismissal without refund.
6. DUTIES AND RESPONSIBILITIES OF THE COORDINATOR
The Coordinator of the Jefferson County Traffic Safety Task Force shall serve as
the Coordinator of the Jefferson County Traffic Safety Class. He or she shall be
responsible for the overall operation of the program It shall be the Coordinator's
responsibility to insure that the program is operated in accordance with the policy

and procedures contained within this section. The Coordinator shall be the
primary instructor of the Traffic Safety Class and may utilize the available
resources in order to maintain a high standard of quality in the level of instruction.
In addition to those procedures listed above, the Coordinator shall provide the
appropriate Court with a list of those with citations who did or did not
successfully complete the Traffic Safety Class on their assigned date The
notification will occur within ten days of the class.
The Coordinator is responsible for keeping records of all those who apply for the
Traffic Safety Class, as well as those who do or do not attend. The Coordinator
shall be responsible for maintaining a positive working relationship with court
and law enforcement personnel.
The Coordinator shall be responsible for developing and revi sing, as necessary,
the Traffic Safety Class curriculum. The contents of the class should reflect the
needs of the participants and cooperating agencies in addition to current
information on safe driving practices and equipment, so as to provide the
informauon necessary to promote legal and safe driving in our community.
Any and all funds received as application and rescheduling fees shall be used
solely for funding the operation of the Traffic Safety Program.
7. PROCEDURE FOR PROCESSING CLASS APPLICATIONS
Application for the Traffic Safety Class may be made through the mail or in
person at the Jefferson County Sheriff's Office during regular business hours.
Payment must accompany the application To process an application, make sure
that the applicant has completed the form and has a copy of either the ticket and
court order, their driver license history from the Department of Licensing, or a
copy of the notice from their employer requiring them to take the class. Upon
payment for the class, the applicant should be given a receipt. If a check or
money order was received as remittance, the number of the check or money order
should be noted on the receipt. If payment is in the form of a check other than
that of the applicant, a note should be entered in the memo section of their file
indicating the name and address of the person who signed the check.
A copy of the receipt and the completed application form must be routed to the
Traffic Safety Class Coordinator. If the applicant is a traffic offender, the case
number must be written in the upper right hand corner of the completed
application form. The staff member who processes the application should
complete the information blocks on the lower part of the form Under the
information block labeled "mode", the processor should indicate whether it was
cash, a check or money order. If it is a check or money order, the number of said
item must be indicated. The receipt number must be written under the
information block labeled "number".

After the application is processed, an acceptance letter is given to the person
either by mail or in person. The Traffic Safety Class Coordinator is only
responsible for providing a letter of confirmation for attendance. The program
has no obligation or responsibility for providing any additional communication on
behalf of the attendee to any court, jurisdiction, agency, business, or employer.
8. RESCHEDULING AND OTHER EXCEPTIONS
An individual who wishes to reschedule their date of attendance may do so in
person, by mail, or by telephone. The fee for rescheduling is $10. If a person is
rescheduled, a note should be made in the memo section of their file and new
letter of acceptance be issued to them and a copy sent to the Traffic Safety Class
Coordinator. As a general policy, an individual should not be rescheduled more
than twice.
