INTERLOCAL COOPERATION AGREEMENT BETWEEN JEFFERSON COUNTY,
THE CITY OF PORT TOWNSEND, AND OLYMPIC COMMUNITY ACTION
PROGRAMS FOR THE PURPOSE OF ADMINISTERING SURCHARGE FUNDS
GENERATED AS A RESULT OF ESSHB 2163.
This agreement is entered into between Jefferson County, the City of Port Townsend, and
Olympic Community Action Programs for the purpose of insuring proper use of funds
created through the surcharge of ten dollars for each document recorded through the
County Auditor's office to fund homeless housing throughout Jefferson County.
WHEREAS, The Washington State Legislature passed Substitute House Bill 2163 during
the 59th Legislative Session and Governor Christine Gregoire signed the bill on May 16'
2005; and,
WHEREAS, this bill authorizes a ten dollar surcharge on documents recorded through
the County Auditor's office for the purpose of providing funds for homeless housing
programs; and,
WHEREAS, Olympic Community Action Programs currently serves as the lead agency
for shelter service funds, lead agency for Continuum -of -Care McKinney Funds, and as
the administering agency for related housing funding;
NOW THEREFORE, in consideration of the mutual housing benefits for homeless
persons living throughout the entire Jefferson County area, the above partners agree as
follows:
A. The purpose of this agreement shall be to provide for the administration and
revenue generated from the recording surcharge authorized under the
provisions of Substitute House Bill 2163.
B. That portion of the revenue generated fro the surcharge that is allocable to
homeless needs within Jefferson County shall be collected by the Jefferson
County Auditor and held in a single Fund by the Jefferson County
Treasurer, to be drawn upon the administering agency designed below, for
use as provided under the terms of this agreement.
C. Olympic Community Action Programs, a non-profit Washington
Corporation, having its principal offices at 823 Commerce Loop, Port
Townsend, Washington, is designated as the administering agency for the
administration and expenditure of the funds collected from the recording
surcharge, to be used for the following purposes:

Create a homeless task force which in turn will develop a ten-year
homeless housing plan for Jefferson County's jurisdictional area,
consistent with the states temporary guidelines for 2005 and in
accordance with SSHB2163 and continuing reports as required by
the state of Washington.
2. To enhance existing homeless programs and develop new homeless
facilities that is consistent with the needs of the ten-year plan.
3. To facilitate the use of additional resources in addition to SSHB2163
funds as they relate to the development of projects that will reduce
homeless populations in Jefferson County.
Olympic Community Action Programs shall administer and expand these funds to serve
homeless people and families in need throughout the incorporated and unincorporated
areas of Jefferson County.
Olympic Community Action Programs may per Sections 10, 11, and 12 prepare
applications for grants from the state homeless housing grant fund as well as other funds
which will be agreed to under a separate agreement between Port Townsend, Jefferson
County and Olympic Community Action Programs.
D. This agreement shall remain in full force and effect until:
1. Olympic Community Action Programs provides at least (30) days
prior, written notice to the county of its intention to terminate its
service as the administering agency; or,
2. The parties agree in writing to terminate the agreement upon not less
than ninety (90) days prior, written notice to Olympic Community
Action Programs, whichever occurs first.
E. Olympic Community Action Programs shall at least annually provide
Jefferson County with a written summary of the funds expended under the
terms of this agreement.
F. For the purposes of R.C.W. 39.34.030(4)(a), the Jefferson County Board of
Commissioners is designated as the administrator responsible for
overseeing and administering the joint or cooperative undertaking
contemplated by this agreement (i.e., the joint designation of an

administering agency to administer and expend the revenues generated by
the recording surcharge as provided in this agreement). The parties by
reason of this joint or cooperative undertaking shall acquire no property. If
for any reason funds from ESSHB2163 are designated or included in the
acquisition of property it will be covered under a separate agreement
between the parties.
G. In its administration of the funds authorized herein, Olympic Community
Action Programs shall make not less than 10% of the revenue generated on
an annual basis available to other qualified not-for-profit organizations
administering such programs as are specified in the enabling legislation.

Earlier this year the Washington State Legislature adopted (and the Governor
signed into law) what is commonly known as ESSHB 2163 (enclosed). As you
may know, this legislation directs counties to collect in addition to the surcharge
authorized in RCW 36.22.178 an additional surcharge of $10.00 (ten dollars) by
the county auditor for recording of real property documents. The end purpose is
to dedicate these funds to help reduce homelessness in Jefferson County by 50
percent based on a 10 year plan developed by a task force and approved by Port
Townsend and the County Council.
Of the funds collected in this manner, the auditor retains 2 (two) percent for
collection of the fee. Of the remainder, 40% is deposited into the Washington
Homeless housing account. The remaining 60% is to be deposited into a fund
that must be used by the county to help accomplish the goals set out to end
homelessness. Of that 60% the county may retain 6 (six) percent to cover its
administrative costs. The balance of these funds is to be used by the county and
its cities. (If they so choose to operate their own homeless housing plan)
As you are aware, Olympic Community Action Programs (OlyCAP) has been an
active participant in Jefferson County for more than 30 (thirty) years serving low
income and homeless populations.
As the county's lead agency for the Continuum of Care process for addressing
homelessness and affordable housing we are acutely aware of the needs of the
county and the community at large for additional shelter facilities. After last years
homeless count it was determined that our first priority would be to establish a
"Helping people to help themselves...
shelter for adult men over the age of 18. We have been and continue to pursue
a location for the establishment of such a facility. The implementation of ESSHB
2163 fits directly into the ongoing goals of the Continuum of Care Plan and will
provide needed funding to implement strategic goals that have been set forth.
OlyCAP is proud of its achievements in the past 38 years and at the same time
we realize there remains much to do. We continue to see shrinking federal
resources for such things as Emergency Food and Shelter Program funds,
McKinney Grants funds, and others. The ESSHB 2163 is our State's attempt to
address some of these needs.
For your consideration, I have attached a copy of a suggested agreement
between the County of Jefferson and its community action agency, OlyCAP.
This suggested agreement is patterned on our existing agreement with Jefferson
County to administer SHB 2060.
OlyCAP appreciates and respects its standing partnerships with Jefferson
County. It is our continuing commitment to our community to exercise our
statutory responsibilities and the implementation of this new act in a way that it
best serves the interest of the entire county. We welcome the opportunity to

ANALYSIS:
OlyCAP has drafted an agreement with Jefferson County, City of Port Townsend and OlyCAP to use funds
collected by the Jefferson County Auditor's Office ($10.00 Surcharge for Recording of Real Property
Documents) to establish a homeless shelter for adult men over the age of 18.
