SEATTLE WA 98119 Project Description: residence w detached bedroom cottage Site Address: FORT GATE RD NORDLAND, WA 98358 Legal Description: Subdivision KILISUT REEF EST Block Lot 3 S-T-R: 19-30-01 E Parcel # 021191015 FINDINGS In accordance with the authority provided under subsection 4 . 101 and the requirement contained in Subsection 5. 402 of the Jefferson County Interim Critical Areas Ordinance, the Critical Areas Administrator enters the following findings of fact relating to the referenced application: 1) The application was reviewed by Jefferson County Permit Center staff on 10\20\94 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: landslide hazard area, fish and wildlife habitat area. 2) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 11/29/94 and confirmed the existence of the following critical areas and/or their associated buffers on the property: landslide hazard area, fish and wildlife habitat area. 3) County staff conducted a site visit on 11/29/94 and found the bank to be approximately 30-35 feet above the shoreline and to have moderate slopes composed predominantly of sand. Staff believes this bank is stable since it has apparently sloughed-off in recent times, reached an angle of repose and has been colonized by grasses and other other upland vegetation. A minimum set-back required for a landlside hazard area buffer is 30 feet. Proposed development is in excess of 80 feet from the top of the bank, and therefore well clear of the buffer area. CAR94-0142 • 4) The fish and wildlife habitat area is entirely associated with the shoreline. The minimum buffer for fish and wildlife habitat area along the shoreline is 30 feet as measured from the beginning of the vegetation line along the beach. In this instance, the required fish and wildlife habitat area buffer is entirely contained within the landslide hazard area and its associated buffer and needs no additional consideration. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the applicant complying with the following conditions. Any deviation from these conditions shall result in this waiver being revoked by the Critical Area Administrator and the application becoming subject to further review under the Interim Critical Areas Ordinance. CAR94-0142 Page: 3 CAR94-0142 DONALD MCLAREN CONDITIONS OF APPROVAL 1) A minimum buffer of 30 feet shall be maintained from the top of the bank along the shoreline above the landslide hazard area. 2) Landslide hazard area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. 3) No alteration shall be made to the landslide hazard area buffer without prior authorization by the Critical Area Administrator. 4) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application.
