As a resident of Griffiths Point Road, I object to the application for shoreline variance SDP17-00005, tax parcel
021324004.
According to the application:
The parcel is constrained by existing onsite septic facilities.
The application for shoreline variance was received 4/4/2017, less than 6 months after the septic permit was
issued on 10/11/2016, and the owner was made aware of the constraints. According to the septic permit, Case
number SEP16-00099, the case conditions explicitly state:
UDC compliance
Approval of this sewage disposal permit does not preclude the permit holder from complying with the
Unified Development Code for other/future development on the site.
No Building Permit Guaranteed
Approval/issuance of a sewage disposal permit or installation of a septic system does not guarantee the
approval of other development or a building permit on this site. Future buildings that require connection to
an on-site sewage system (OSS) shall only be approved if the OSS meets the current standards and codes in
effect at the time of the building application.
The owner received a Site Plan Approval Advance Determination (SPAAD) for single-family residential development
on 6/16/2010, but this expired on 6/16/2015, one year before the owner applied for a septic system permit.
The owner was made aware of the need to comply with current standards and codes. Approval of this application
would be a violation of these standards and/or codes, and could set a dangerous precedent.
