THIRD NOTICE OF VIOLATION
RE: 131 HUNT RD, PORT HADLOCK
Dear Ms. House:
Jefferson County Health Department received a complaint April 25,
1994 on the above referenced property. The complaint alleges that
sewage is again surfacing at the site.
The Jefferson County Health Department has made two site visits to
the above referenced property on February 18,1992 and April 15,
1992 in response to complaints received by this office. The
complaints stated that sewage was surfacing at the residence. A
notice of violation was sent to you on April 30, 1992 requiring
you, as the owner of record of the property, to contact this office
to discuss alternatives for the site to repair the failing septic
system.
You contacted this office on July 27,1992 and explained that you
had covered the area with rock and there was no surfacing sewage.
You were informed that covering the site eliminates the immediate
health hazard this does not constitute a permanent solution and
that the system still needs to be repaired. To date you have not
applied for a permit to repair the system. This office can offer
evaluation and design of a system for the site under our water
quality improvement program and low interest loans may be available
to complete the repairs.
This letter constitutes official third notice of violation of the

or upon the surface of the ground.
2) Jefferson County Ordinance No. 2-77, 1.2 Every residence,
place of business or other building or place where persons
congregate, reside or are employed, to which a public sewerage
system is not available, shall be provided with a water -flush
toilet system connected to an on-site disposal system or shall have
an alternative device for the disposal of domestic wastes.
Penalties under Jefferson County Ordinance 2-77 for violation of
these regulations shall, upon conviction, be guilty of a
misdemeanor and subject to a fine of not more than two -hundred and
fifty dollars ($250.00), or by imprisonment for not more than
ninety days, or both such fine and imprisonment. Each day any
person shall continue to violate, or fails to comply with the terms
of these regulations shall constitute a separate offense.
This file has been forwarded to the Jefferson County Prosecutors
Office.
You are required to contact this office with in 10 days to discuss
a repair of the septic system.

explained that a grey water line runs across the rear of the home
and behind the garage. Effluent was observed on the surface of the
ground at that time. It was noted that we had'some heavy rains
over the previous 2 weeks resulting in some localized flooding.

At the time of the investigation I agreed to make another visit to
the site in 20 days to see if the saturation in the area had
dissipated. I explained that if it has not, corrective action will
be required. A second site visit was made April 15, 1992. Sewage
was still on the surface of the ground. Corrective action will be
required on the site to resolve this problem.

repair onsite sewage disposal systems that may impact water
quality. Evaluation and design can be provided at no charge and

Dear Ms. House:
I would like to take this opportunity to clarify a member of
.misconceptions that were apparent in your letter of July 21, 1988
to Mr. Rice of this Department.
I have been in contact with Janet Welch R.S. of the
Jefferson County Water Quality Department who had the discussions
with Mary Jensen. Janet explained that the only usable septic
replacement area was near the well which is why abandonment of
the well was mentioned. This area may represent the only
solution to replacing the existing, failing system and should be
investigated.
State law and Jefferson County ordinance do not make any
differentiation between gray water and sewage. They are both
wastewater and are prohibited from being discharged on the ground
surface. While I agree that some aspects of permitted systems
are grandfathered or exempt from current codes, system failures
are not included in grandfathering.
It will be necessary to alleviate this failure situation in
the best and most expeditious manner. This office is eager to
work with you in whatever way we can to accomplish this task.

I am not aware of any repair options that were presented.
Mary Jensen has told me that a lady has been trying to get
her to abandon the water well. This has nothing to do with
the sewer system.
Mr. Shold, who started all this, agreed to sell me the lot
that is to the left of the lot which the mobile home sits.
When I went to pay for the lot Mr. Shold refused to sell.
This lot would have solved any sewage problem we might have.
Mr. Shold bult a fence and put cattle on the lot. He later
dug an illegal pond and is polluting the creek. Recently
he dug a ditch along the property line exposing the drain
field. The drain was only used for "gray water" and not
for sewage.
Mr. Lewis, from whom I bought the property, had a licenced
contractor install the sewer system which was approved at
that time. I was told by Jefferson County that the "grandfather
clause" applied.
I don't know anything I can do to solve the problem with
out more space to build a better drain field.

Dear Ms. House:
On November 4, 1987, this department responded to a complaint of
an unapproved corrugated wastewater drain pipe allowing
wastewater to surface upon the ground at 131 Hunt Rd., Hadlock.
Our investigation substantiated the complaint.
This situation was referred to the Water Quality Section of the
Jefferson County Planning Department, which has a state grant
allowing no cost assistance and repair designs to those
individuals who have failing sewage disposal systems. Our
department was notified that several repair options were
presented to the occupants, Leroy and Mary Jensen, but no action
was taken.
As per WAC 248-96-05 and Jefferson County Ordinance No. 2-77,
sewage from any on-site sewage system shall not be discharged to
surface water or upon the surface of the ground. You are hereby
instructed to submit a repair design and apply for a sewage
disposal permit within 10 days of receiving this notice. Failure
to comply with this notice may result in this matter being
referred to the county prosecutor for further action.
