HomeMy WebLinkAboutBLD1994-00864 ° r") Jefferson County Permit Center " April 21, 1995 621 Sheridan a 1 4k Port Townsend WA 98368 0 APR MEW 1EW " ) (360) 379-4463 JEFFEOWAY PERMIPMTER FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE Critical Area Review Case No: CAR95-0004 Date Received: 12/21/94 Applicant DAVID BRACKETT Mailing Addr: 80 TROWBRIDGE CT SEQUIM WA 98382 Project Description: single family residence Site Address: 2406 DOSEWALLIPS RD BRINNON, WA 98320 Legal Description: Subdivision Block Lot 08 S-T-R: 28-26-02 W Parcel # 602282003 FINDINGS In accordance with the authority provided under subsection 4.101 and the requirement contained in Subsection 5.402 of the Jefferson County Interim Critical Areas Ordinance, the Critical Areas Administrator enters the following findings of fact relating to the referenced application: 1) The application was reviewed by Jefferson County Permit Center staff on 01/10/95 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: landslide hazard area, fish and wildlife habitat area. 2) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property and confirmed the existence of the following critical areas and/or their associated buffers on the property: landslide hazard area, fish and wildlife habitat area. 3 ) Staff visited site in October of 1994 prior to the applicant's purchase of the subject property. Staff informed applicant that a geotech report would be required for any proposed building site since the entire parcel lies within a mapped landslide hazard area. Rocky Brook, a Type 2 fish bearing stream, lies in the bottom of a canyon, well below the proposed development area. 4) Staff talked to applicant on 01/10/95 and learned that a geologist has visited the site, and that Tillman Engineering is CAR95-0004 coordinating the production of the geotech report. The County building official has notified the applicant that engineering is required for the proposed foundation. 5) On 04/21/95, applicant hand-delivered a geotech report completed by Gerald Thorsen and Associates of Port Townsend, WA. This geotech report states that the slopes associated with this parcel are relatively stable, and recommends engineering on the retaining wall. The County building official also requested engineering on the retaining wall, and this also has been completed and submitted to the County building official. 6) The standard buffer for setback from a landslide hazard area is 30 feet, however, the proposed homesite is not within 30 feet of any natural slopes of greater than 45 degrees. In addition, the applicant has submitted plans for an engineered foundation which were completed by Tillman Engineering, Inc. A landslide hazard area does exist downslope from the building site where the slopes equal or exceed 45 degrees. 7) The fish and wildlife habitat area is entirely associated with the Rocky Brook. The minimum buffer for fish and wildlife habitat area along this Type 2, fishbearing stream is 100 feet as measured from the ordinary high water mark. In this instance, the required fish and wildlife habitat area buffer is entirely contained within the landslide hazard area and its associated buffer and needs no additional consideration. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the applicant complying with the following conditions. Any deviation from these conditions shall result in this waiver being revoked by the Critical Area Administrator and the application becoming subject to further review under the Interim Critical Areas Ordinance. CAR95-0004 Page: 3 CAR95-0004 DAVID BRACKETT CONDITIONS OF APPROVAL 1) A setback (buffer) of 30 feet shall be permanently maintained from the top or edge of those slopes which equal or exceed 45 degrees. These slopes shall be considered to be a landslide hazard area. All buffers shall be measured perpendicularly from the top of the landslide hazard area. 2) Landslide hazard areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator. Selective limbing of trees for purposes of view enhancement, as advised in the accompanying geotech report, is allowed. 3) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application.
