HomeMy WebLinkAboutBLD1996-00035 CONDITIONS OF APPROVAL T & W STAKE & LATH MILL JAMES TESTER The following conditions of approval are binding, and commit the applicant to: (a) the proposed project as submitted; (b) the applicable development standards outlined in Section 14 of the Jefferson County Zoning Code; and, (c) the following: 1 . This approval is good only as long as : the applicant continues to reside on the property, retain an ownership interest in the business and remain an employee of the business; or, the applicant sells the business together with the residence and the remaining portion of the property to an owner who will reside on the property, have an ownership interest in the business and be an employee of the business. 2 . The primary use of the property shall be residential; the business shall be a secondary use. 3 . Home businesses shall be fully enclosed within the primary residential structure and/or associated out-buildings. Out- buildings used for the business, shall not exceed 2,500 square feet. The total lot coverage for the home business uses shall not exceed 30 percent of the parcel size, except if the parcel in which the home business is located is 5 acres or greater, shall not be subject to the 2 ,500 square foot criteria. 4. At least one (1) person engaged in the operation must reside on the remise and must be the owner or lessee of the property. The maximum number of persons employed on the site shall be limited to no more than ten ( 10) persons including family members, whichever is less. 5 . No outside storage of materials, goods, supplies or equipment, nor outside display of any kind, unless otherwise screened from public and neighborhood view. 6. Home businesses shall not be subdivided or otherwise apportioned from the residential property for the purpose of sale, lease, or rent. 7. Noise levels generated shall not be in excess of levels allowable in residential neighborhoods as per WAC 173-60 as adopted by Jefferson County Resolution No. 67-85. 8 . Home businesses shall maintain business hours that are not disruptive to the normal use of adjacent residential properties . Hours of operation shall be as follows: 4 Earliest start time: 4:00 a.m. Latest finish time: 6:00 p.m. Permitted days of operation: Monday through Saturday. Prohibited on Sundays and national holidays. NOTE: Due to the nature of the business, the proponent may operate on weekends and holidays, provided that it will not be disruptive to the normal use of adjacent residential properties. 9 . The underlying zoning designation shall remain light industrial/commercial use. 10 . One wall sign and one free-standing sign identifying the business shall be permitted. The sign shall be no greater than 8 square feet per sign. Signs shall be located on the premise and no part thereof shall be lighted or consist of banners, streamers , or similar moving devices. 11 . All parking for the home business shall be located on-site in such a manner that no off-premise parking will be necessary. Parking shall be consistent with the requirements for home businesses found in Section 13 of the Jefferson County Zoning Code which requires one (1) parking space for each guest room. 12 . Access shall be designed in such a manner that traffic entering or leaving the site shall be traveling in a forward motion where possible and shall not create a hazard as determined by the Jefferson County Department of Public Works. 13 . Lighting on the site shall not adversely affect surrounding properties or adjoining rights-of-way. 14 . Noxious fumes or odors created by the home businesses shall not be permitted. 15 . Home businesses shall not adversely affect the use or enjoyment of surrounding properties and shall maintain the character of the area in which they are located. 16 . The applicant is required to comply with all applicable Washington Department of Health and Jefferson County Health Department requirements for on-site sewage and potable water. 17 . This approval is subject to the above-stated conditions. By accepting this approval , the applicant agrees that these conditions are reasonable. Failure to comply with these conditions may result in the revocation of this approval. The applicant shall record a copy of these conditions as deed restrictions against the property with the Jefferson County Auditor's Office. 5 • Complaints on Home Businesses registered by an interested party directly affected by the activities of a home business, on home businesses shall be received by the Department of Development Review. The Department shall investigate the complaint and inform the owner of the business of the complaint. If the complaint is determined to be valid by the Director of Planning and the owner chooses to remedy the complaint, he or she shall be given 15 days from the date of notification to do so. In the event the complaint in not remedied by the owner, the Jefferson County Hearing Examiner shall hold a public hearing to review the complaint. Public Notice shall be provided for this hearing consistent with the requirements of Section 19 of the Jefferson County Zoning Code. Should the Hearing Examiner find the complaint to be valid, all cost associated with the public hearing shall be borne by the permit holder. The Hearing Examiner may revoke a Home Business permit for noncompliance with the conditions set forth in approving the permit and may add conditions, if, during the conduct of a home business, it is determined that additional conditions or restrictions are necessary in order to ensure that the criteria set forth in Section 14. 30, and the development standards in Section 14 . 40 above are met. Where the recision of a Home Business permit is prohibited by State and Federal Law, the Hearing Examiner may suspend the permit until such time as all valid complaints are remedied. Appeals of Administrative Determination made by the Development Review Division, may be appealed to the Hearing Examiner by the applicant, a public agency, or any interested person as defined herein below, no later than fourteen (14) days following the decision of the Department by notice in writing to the Development Review Division. This approval provides a basis upon which a building permit can be issued. Once a building permit is issued, construction may begin. Prior to occupancy or use of the facilities a final inspection must be conducted to confirm that all conditions and requirements have been met. Upon demonstration that all conditions have been met, a Certificate of Occupancy will be issued by the Jefferson County Building Official .
