Prior to final building occupancy, the proponent shall submit a written letter from Bill Payton L.E.G. of NTI stating that the structure and earthwork have been constructed in accordance with the geotechnical report dated March 28, 2006 and a written letter from David Hanna RE of NTI stating that the Drainage, Erosion and Sediment Control Plan dated April 2006 has been implemented. 2.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top of the Landslide Hazard Area. 3.) A Geotechnical Report was prepared by NTI Engineering, dated March 28, 2006 and submitted in conjunction with this application. The report addressed the stability of the bluff and made recommendations to protect the bluff from further erosion. These recommendation shall be implemented to the maximum extent feasible. 4.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 5.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 6.) All construction activities shall not encroach upon the buffer. This includes the storage or preparation of materials. 7.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 8.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat management plan. 9.) A Drainage, Erosion and Sediment Control Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 10.) Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. 11.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 12.) All new construction shall: a. be anchored to prevent flotation, collapse, or lateral movement of the sturcture. b. be constructed with materials and utility equipment resistant to flood damage and potential damage to adjacent properties. c. be constructed using methods and practices that minimize flood damage. d. have structural components capable of resisting hydrostatic and hydrodynamic loads and the effects of buoyancy. e. electrical, heating, ventilation, plumbing, air-conditioning equipment, and other service facilities shall be designed and/or otherwise elevated or located so as to prevent water from entering or accumulating within the components during conditions of flooding. • 13.) The stormwater runoff tightline shall be designed and placed in order to minimize visual impacts to users of the beach and nearby waters. The stormwater runoff tightline piping must be composed of durable material that is resistant to weakening and damage due to time, weather exposure (including ultraviolet radiation), and impacts from trees, rocks and debris. The corrugated plastic material used for tightline construction in the past is no longer acceptable. More durable plastic or ultraviolet radiation-resistant flexible rubber material shall be required. The applicant/owner and all future owners are responsible for maintaining and protecting the stormwater runoff tightline to the beach against damage due to normal wear, weather exposure, and/or trees, rocks and debris. If and when damage occurs to the tightline that renders it ineffective, the responsible party must execute the necessary repairs as soon as possible and no longer than 30 days. 14.) All disturbed areas including the area where the bluff eroded due to tightline failure shall be re-vegetated with native species trees, shurbs and plants per the re-vegetation plan.
