This is to confirm final action by the Jefferson County Hearing Examiner regarding the above Variance application. On May 21, 1996, the Jefferson County Hearing Examiner reviewed the Staff report including a recommendation and attached exhibits and testimony in a public hearing. Hearing Examiner Decision: On June 4, 1996 the Hearing Examiner recommended the following: Approve the modified variance with Conditions. Appeal Process: Pursuant to Ordinance 1-0318-91 Jefferson County Hearing Examiner Ordinance Section 14 Appeal of Examiner Final Decision, final decisions of the Examiner may be appealed to the Board of County Commissioners by any aggrieved party or agency within fourteen(14) days. The appellant must file a written notice of appeal by June 25, 1996 at 5:00 pm at the Jefferson County Permit Center, 621 Sheridan Street, Port Townsend, WA 98368. • If you have any questions regarding the proposal, Hearing Examiner Recommendation or the appeal process, please call the Jefferson County Permit Center at 379.4463. The variance criteria are met as noted above and in the Staff Report. RECOMMENDATION Based on the Findings and Conclusions above, it is the recommendation of the Hearing Examiner to GRANT the variance subject to the following conditions : 1 . The requested variance from the rear setback requirement of five (5) feet shall be reduced to a four (4) foot setback. 2 . The required variance from the front setback requirement of twenty (20) feet shall be reduced to a ten (10) foot setback. 3 . The responsibility of noise attenuation shall be the responsibility of the applicant'. As such, design and construction of the residence shall minimize noise impacts . 4 . A restrictive covenant tying the two separate tax parcels together as one building lot shall be submitted to the Planning Department for review and approval . The restrictive covenant shall be recorded with the County Auditor prior to issuance of any building permits for the proposed residence. DATED this 4th day of June, 1996.
