Dear Ms. Hoskins:
I write on behalf of Residents of Squamish Harbor concerning your ongoing activities by Douglas
McCrae and Washington Shellfish, Inc., installing a new geoduck operation on Parcel 821334073,
in Squamish Harbor. This installation is being done without a Shoreline Conditional Use Permit
as required by Jefferson County's new Shoreline Master Program. We ask that the County take
action to halt all activity at this property.
While Mr. McCrae installed approximately 0.5 acres of geoducks on parcel 821334073 in 2013,
he did not have approval to do so from the Corps of Engineers. He has recently applied to the
U.S. Army Corps of Engineers to expand the geoduck operation on this parcel to a total of 5.3
acres. As explained in the attached letter being sent to the Corps' reviewing biologist,Pamela
Sanguinetti, we strongly believe that the proposed operation is not allowed under the Corps' NWP
48 for geoduck aquaculture.
More importantly for the County's perspective, it is important to understand that the Corps has
not issued a permit decision on Mr. McCrae's application. Prior to the Corps approving his
application under NWP 48,the Corps must first seek and obtain approval from the federal ESA
agencies(National Marine Fisheries Service and U.S. Fish and Wildlife Service)as well as
approval from the Department of Ecology that the operation satisfies Section 401 of the Clean
Water Act. Thus, because Mr. McCrae did not have all necessary permits for a geoduck operation
on parcel 821334073 prior to February 21, 2014,the operation requires a Shoreline Conditional
Use Permit.
We ask therefore that Jefferson County take action to enforce its Shoreline Master Program and
immediately halt all ongoing and unpermitted activity on this property.

I write on behalf of Residents of Squamish Harbor concerning your ongoing review of an
application by Douglas McCrae and Washington Shellfish, Inc., for construction and operation of
a geoduck farm on Parcel 821334073, in Squamish Harbor. I believe you have been in email
communication with several of my clients concerning this application.
We strongly believe that this application is not eligible for coverage under NWP 48 for at least
two reasons. First, this is an entirely new geoduck operation that was started well after the
February 21, 2012, re-issuance of NWP 48. You have received a signed statement from at least
eight adjacent homeowners attesting that this parcel was not planted with geoducks, or other
shellfish,prior to March 2007 as required for an"expansion"under NWP 48. While the
application states that there was 0.5 acres planted with geoducks(but no other species)prior to
March 2007, this is not correct. The 0.5 acres of geoducks were planted in 2013. There is no
evidence of any type of commercial shellfish operation on this parcel until 2013. Unless the
applicant can demonstrate that the parcel was planted prior to March 12, 2007, it is not eligible
under NWP 48.
Second,even if,for the sake ofargument, a portion of the parcel had been planted with shellfish
prior to March 2007 the operation may not be expanded under the re-issued NWP 48 because it
does not have the necessary permit authorization from Jefferson County. NWP 48 requires all
expansions of existing shellfish operations to obtain valid authorization(e.g. a lease or permit)
from the appropriate state or local government agency. As of February 21, 2014, all new geoduck
operations located in the"Shoreline Residential"district in Jefferson County require a Shoreline
Conditional Use Permit under Jefferson County's Shoreline Management Master Program
Article 8, Section 2(B). As the attached map shows,Parcel 821334073, is located with the
Shoreline Residential environment. Because the applicant has not obtained or applied for a valid
SCUP from Jefferson County, even ifthere had been an existing operation on the parcel prior to

March 2007 approval of an expanded operation under NWP-48 is not appropriate.
In closing,because parcel 821334073 was not planted for commercial shellfish operations prior
to March 2007, it is not a valid existing ongoing operation. We ask therefore that the Corps
cease reviewing the application under NWP 48, and halt all ongoing activities on the property.
