NMS Subject: RE: BDN LLC Parcels Attachments*.scannedDoc:pdf: ssanraEalDoc,pdf Robert and Brad, Thank you for coming into our office last week. Your email below captured much of our discussion, but I have a few adfticrislciarations to your summary of or meeting and the associated next steps. i will follow your outilne below, 1. NWS-2012-1099 BUN, LLC(Mocean Sheiifish)- In our meeting we discussed the limitations to determining the tidal height based on NOAA tide stations(Pt.Townsend station provides the actual tidal height but it is located in AdmiraltyInlet, a different waterbody;Foulweather Bluff is nearby in the Hood Canal but provides the predicted tidal height). We agreed BON shall have a survey completed to definitively determine the elevation at the deepest point the geoduck plantings. I have attached a letter agreeing to the survey. The survey must be completed by a WA state licensed saiveyor. Note, the daytime minus tides.start the fifst week of May.,i assume the survey :s to occur durlrig,l:he daytime hours,so please provide the surveyed elevation of the geoduck plantings by May 30,2016. 2. Garten parcels,Tjemsland parcel,BON parcel and Smersh parcel- I have attached a copy of the Smersh eelgrass survey drawing as a reference for Chris to use. The map shows the lat/Iong of the planting area but is missing the lat/long of the waterward lease edge, which should also be included.1 The drawing also does not note if eelgrass is an the neighboring parcels arid if so,apply a buffer(e.g.,our horizontal/vertical discussion). Chris will be providing a revised map of the,Smersh lease based on h's Septe.mtn survey. Tia •`.2. rps will revic.,w this map for coql.sistzhey wlth our vision observations on July 1. The Garten,1 jeinsiand, and BDN parcels will be resurveyed at the low tide when eelgrass is visible. The surveys will occur after June 1,2016, and pre-coordinated with the Corps. To determine the edge of the native eelgrass bed,the Corps recommends Confluence use Washington State's ONR methodology. 3.The parcel purchased from Washington Shellfish(821334073), parc-al 8213340i iznd 8213314f.79fromMoceanShellfish)are all adjacent to each other and within one Pwnership(BON, LLC). Once the unauthorized activity on the Mccear Shellfish parcel is resolved,a new application is required to con-clnc:: die three parcais, refect correct ownership and include both the existing and proposed expanslion of the cultivation areas. Prior to submittingthisapplication, I can provide assistance to you. 4. I coordinated your request to keep the incomplete applications open while you acquire the requested information. However it is standard policy to cancel or withdraw the applications administratively when it is not ciesse for the information to be provided within a 30 day period. We anticipate the Garten,Tjemsland, and Smersh projects will reaarire revsed drawings and app!icatiors. Note Cll of these applications had Ms. Lelt.ir-r.ail as thegerit'ef ecord. And, as explained above, we will require a new application for the three parcels that will be combined into one project area. Kyle Lentx is the agent of record for NWS-2012-1210(WA Shellfish). It makes sense to wait until the survey is completed and approved in the expansion area (parcei 821334011), the unauthorized activity resolved, and then resubmit the application and drawings with appropriate revisions at, that time. i` At this time,we will administratively cancel NWS-2013-1223(Garter)), NWS-2013-1147 1,Tjerrisland), and NWS-2013- 1223 (BDN). However, cancellation of these applications will not preclude you from submittins another application in the futi:re when you have acquired the req-ur.,:sted information. Mocean Notice of Violation. We presented our analysis as to why we believe that BUN has not violated its permit conditions. This conc-,!usion,was supported by depth readings taRen by Confkbence Envirorrnental. Confluence will prepare a map verifying the planted area and corresponding latitude and longitude. It is BUN's position that theplanteciacorrespondswiththetermsof:the permit, which does not inckxie al!rnIteon on the elevation at which geoduck may be planted, other than a limitation that the planting include a 20-foot buffer from existing eelgrass beds, which had been shown at beiow a-2 MLLW elevation on hand-drawn maps. Pam noted that she took Certain depth measurements during the July 1 site visit and agreed to send BUN those readings as well as the methodology used todeterminethetidalelevation. 2.
