We have requested new eelgrass surveys and a new application and biological assessment by August 30.We recommended they withdraw their application if they are unable to meet that deadline. We also requested they provide the revised applications to all state and local agencies. We also sent a notice of violation for the Tjemsland Lease for harvest activities completed without permits. We alerted them that further violations would be considered knowing and willful and subject to referral to the Dept. of Justice. I am also preparing a notification of noncompliance for NWS-2012-1099 (previously Mocean Shellfish). We found they had expanded their cultivation into areas not permitted. These areas also contained native eelgrass. I am still reviewing the work on the previously WA Shellfish parcel (NWS-2012-1210). Work is obviously occurring in native eelgrass, but I am considering whether than has been an expansion of the area in cultivation. Let me know if you have any questions. If we remember correctly, you or your colleagues had planned to make a site visit in July to determine the boundary of the eelgrass and the aquaculture farms. If this is correct, has this site visit occurred and are there are any conclusions that were reached in which could be shared with us for our information? We appreciate your time and attention on to this matter.
