That is still my strong view. In this email, however, I want to draw your attention to documents that show that even under a vested rights theory, any possible claims to vested rights for geoduck farming in Squamish Harbor were extinguished by canceled, withdrawn, incomplete, or inaccurate JARPAs. Attached are county documents ("Hoskins ltrs") that span the mysterious reversal ofthe County's position (from requiring a conditional use permit to not requiring one). Reflecting the reversed position, on December 1, 2014, Anna Bauscher, DCD, emailed to Shine resident Sue Corbett: Jefferson County currently does not have any applications submitted by Brad Nelson for aquaculture. Brad Nelson submitted Joint Aquatic Resources Permit Applications (JARPAs) to the US Army Corps of Engineers for aquaculture in 2013, prior to the current Jefferson County Shoreline Master Program (SMP). Provided these JARPAs were submitted and substantially complete before the effective date of the current SMP, no County permits are required for the proposals reflected in these JARPAs. For information regarding the status of these JARPAs you should contact the US Army Corps of Engineers. The JARPAs in question were not only incomplete, inaccurate, or violated. They were CANCELLED on November 15 and 19, 2015 (see attached "CorpsDocs" bottom of page E and page H), and shown as WITHDRAWN, as of April 28, 2016 (see attached "Withdrawn Apps," an Corps document; withdrawn applications are shown in RED). Thus, as of those dates, there were no even-arguably valid JARPAs for the parcels they cover. At that point, the owners/farmers had no claim whatsoever to be "vested." New JARPAs needed to be filed, and those are clearly subject to the new SMP. In addition, the events that caused the withdrawals also establish why the JARPAs were incomplete or inaccurate or violated. These events include: planting way beyond previously very limited lines of geoducks; planting in native eelgrass; proposing boundaries that contained native eelgrass, and findings by the Army Corps that the biological assessment were deficient. (See attached "CorpsDocs," pages A through H.) Further, one JARPA was deceitful, in that it claimed (without evidence, such as records or receipts)that the entire tract had been planted in the past with geoducks, even though 20 neighbors signed a document, which the county has, saying they had never seen any evidence of geoduck farming. Nor did any JARPA mention the presence of a county boat launch and park, including the JARPA for the tract immediately next to the park--a glaring omission. And then, there are various violations that should disqualify the applicants. TheseLQG ITE 1 2 Page t of 2c1 include: harvesting native geoducks without a permit or notice to the Corps of Engineers or state; destroying native eelgrass; bulldozing vegetation and a parking space on Shine Road less than 30 feet from the shoreline, without a permit; storing, as part of a commercial operation, for at least two months to date, and probably longer, thousands of geoduck tubes on an upland parcel zoned rural residential; building stairs and a large platform/porch on the beach without a permit and ignoring County subsequent stop-work orders. We are prepared to go over each parcel and describe these particular disqualifying events. However, this should not be necessary, as A) by law, no vested rights attach to the SMP to begin with, and B) the JARPAs that were the basis of a vested rights claim were withdrawn, making the "old" applicants become "new" applicants. Thank you for your continued attention to these issues. We urge you to inform all concerned parties that geoduck farming in Squamish Harbor requires a conditional use permit from the County. Your email does not make clear whether your legal consultation occurred before or after this case was reported and able to be analyzed. It will save time and money for all concerned--the county, the JARPA applicant(s), and residents--if we all have an up-to-date understanding of the county's position as to which SMP--the old one or the current one--applies to JARPA applications filed before the effective date of the new SMP (assuming, for the sake of analysis, that they are complete and not misleading). This is especially important, given that the county's position on this question has changed, twice, in the space of a few months. The new case, reported August 25, 2014, is Potala Village Kirkland, LLC v City of Kirkland, Div I, Washington State Court of Appeals. As amplified in the links below, it holds that the common law vested rights doctrine does NOT apply to shoreline permit applications, and neither does RCW 19.27.095. It overrules a 1974 case, Talbot v. Gray, that concerned vesting rights under the Shoreline Management Act and confirms that such rights are now only by statute or ordinance. Ms. Hoskin's letter, however, states that the JARPA permit must be granted (not just applied for) prior to the new SMP, in order for the county process to be avoided. Her letter states that if an activity is not permitted by the Corps of Engineers prior to the new SMP's effective date, a county permit will be required. To quote from her letter: Given all permits for the proposal were not obtained prior to February 21, 2014, the adoption and effective date of the new Shoreline Management Master Program, local permitting for the geoduck farm proposal through Jefferson County DCD is required. The next step for the applicant will be to apply to Jefferson County DCD for a pre-application conference per JCC 18.40.090. Your email below captured much of our discussion, but I have a few oc ctiticns/Ciar lficath ns to your summary of our meeting and the associated next steps. i will follow your outrine below. 1. lNWS•2012-1099 BON,LLC(Mocean Sheiifish)-In our meeting we discussed the limitations to determining the tidal height based on NOAA tide stations(Pt.Townsend station provides the actual tidal height but it is located in AdmiraltyInlet, a different waterbody;Foulweather Bluff is nearby in the Hood Canal but provides the predicted tidal height). We agreed BON shall have a survey completed to definitively determine the e!evatior at the deepest point cf the geoduck plantings. I have attached a letter agreeing to the survey. The survey must be completed by a WA state licensed st rve or. Note,the daytime.mil-al tides start the week o:May. assume 3e sarvey tc duriitg:i3£daytime hours,so please provide the surveyed elevation of the geoduck plantings by May 30,2016. 2. Garten parcels,Tjemsland parcel,BDN parcel and Smersh parcel- I have attached a copy of the Smersh eelgrass survey drawing as a reference for Chris to use. The map shows the lat/long of the planting area but is missing the bat/long of the waterward lease edge,which should also be included. The drawing also does not note ifes grass is on the neighboring parcels and if so,apply a buffer(e.g.,our horizontal/vertical discussion). Chris will be providing a revised amp of the Smersh lease based on his Septemtisurvey. The Corps will re-viewVlis map for Ct^...,_iS`'r;iy with our vision observations on July 1. The Garten, ijemsland,and BDN parcels will be resurveyed at the low tide when eelgrass is visible. The surveys will occur after June 1,2016,and pre-coordinated with the Corps. To determine the edge of the native eelgrass bed,the Corps recommends Confluence use Washington State's DNR methodology. 3. The parcel purchased from Washington Shellfish(821334073): parte'821334011 and par-zet 821334079'purchased from Mocean Shellfish)are all adjacent to each other and within one ownership(BON, LIC). Once the unauthorized activity on the Mocear Shcltfis pa.Cel is resolved,a new application is required to cornbine the three parcels, reflect correct ownership and include both the existing and proposed expansion of the cultivation areas. Prior to submittingthisapplication, I can provide assistance to you. 4. i coordinated your request to keep the incomplete applications open while you acquire the requested information.
