RE: BDN Shine Road Geoduck Aquaculture Farm
Dear Ms. Charnas and Mr. Greetham:
This letter is submitted on behalf of BDN, LLC, responding to your letter dated April 21,
2017. As acknowledged in your letter, the County's position regarding the permit requirements
for BDN's geoduck aquaculture farm and the applicability of the County's 2014 revisions to its
shoreline master program, as stated in your letter, is a significant departure from the County's
previous interpretation of its code in regards to the project.
Within the next couple days, BDN will be submitting a letter to the Department of
Community Development and County Prosecutor's Office responding to the substantive claims
made in the letter regarding BDN's claims concerning vested rights and other legal principles
relevant to its project. However, we seek clarification regarding whether the County's
determination is final, as defined in Jefferson County Code ("JCC") § 18.40.320. In the event
that the County's decision is final, please provide notice of the County's final decision as
required pursuant to JCC § 18.40.320(3). Alternatively, BDN can request a code inteipietation
pursuant to JCC § 18.40.350 et seq. if the County prefers a more formal process than the
conversations to date.
