HomeMy WebLinkAbout020518_ca17Consent Agenda JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS CONSENT AGENDA REQUEST r TO: Board of County Commissioners FROM: Philip Morley, County Administrator Erin Lundgren, Clerk of the Board/Hum n R urces Manager DATE: February 5, 2018 RE: Motion to Ratify 2018 Step Increases for County Employees in UFCW Local 21 STATEMENT OF ISSUE: The County Commissioners are asked to adopt a motion ratifying 2018 step increases for County employees who are members of United Food and Commercial Workers (UFCW) Local 21. On January 8, 2018 the County wrote to the UFCW voluntarily offering to provide steps in 2018, and on January 25, the UFCW agreed, as shown in Attachment 1. ANALYSIS: The County's most recent collective bargaining agreement with the UFCW expired on December 31, 2017. Section 13.1 of that agreement states, "there is no dynamic status quo regarding wages and steps beyond the term of this Agreement." This means that unless and until the County and the UFCW reached an agreement otherwise, staff in that bargaining unit could not receive step increases. Attached to this Agenda Request is a January 8, 2018 letter authorized by the County and sent on our behalf by Labor Consultant Robert Braun, offering to the UFCW the County's voluntary willingness to continue employee annual steps in 2018, while labor negotiations continue for a new collective bargaining agreement. The offer was accepted and signed on behalf of UFCW Negotiator Matt Wood on January 25, 2018, signifying that the UFCW agrees to this interim process of allowing steps in 2018 while collective bargaining for a new labor agreement continues. On the basis of the written offer and acceptance of 2018 steps, and after first consulting with County Commission Chair David Sullivan, on January 29, 2018 the County Administrator sent a memo to all directors and elected officials advising them to process steps for employees with January anniversary dates, for inclusion in January's pay. The memo also stated that the County Commissioners would have the opportunity to pass a motion to ratify this action at their regular meeting on February 5, 2018. A copy of the Administrator's memo is included as Attachment 2. FISCAL IMPACT: Steps are included in the adopted 2018 County Budget. RECOMMENDATION: Staff recommends the County Commissioners pass the following motion: "The Jefferson County Board of Commissioners ratifies providing steps in 2018 to County employees in UFCW Local 21 for eligible employees on their anniversary dates, voluntarily offered by the County and accepted by the UFCW; and the Board ratifies the January 29, 2018 memorandum from the County Administrator to all County Departments and Branches and the County Auditor." Accordingly, with the CBA expired the County has no legal authority to advance employees who are eligible for step advancement after December 31, 2017. Of course, should the parties agree to steps and retroactive application all employees eligible would then receive the contract steps as in the expired agreement or in the new one so it is not a matter of employees getting recognition at bargaining it is a matter of timing and agreement of the parties. For 2018 the County is willing to continue the stapes as set out in the expired agreement however. we believe the proper course of action is to have the Union agree to that interim process while the 2018 bargaining continues. Please sign and return this tetter to me signifying that on an interim basis the Union does not object to the County's desire to continue wage steps for eligible employees' per the expired CBA while bargaining continues. The County Auditor's Office is authorized to include eligible steps in the compensation for January and subsequent months of 2018. The County's collective bargaining agreement with the UFCW expired on December 31, 2017. Section 13.1 of that agreement states, "there is no dynamic status quo regarding wages and steps beyond the term of this Agreement." This means that unless and until the County and the UFCW reach an agreement otherwise, staff in that bargaining unit cannot receive step increases. The UFCW's acceptance of the County's offer of steps in 2018 came after the County Commissioners' last meeting this month, held on January 22, 2018. The next regularly scheduled Commissioner meeting is on February 5, which is when January wages are distributed to employees. In order to assure smooth operations, and after first consulting with County Commission Chair David Sullivan, I am writing to authorize including steps earned on employees' January anniversary dates in January's pay. The County Commissioners will have the opportunity to pass a motion to ratify this action at their next regular meeting on February 5, 2018.
