HomeMy WebLinkAbout040918_ra03JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Philip Morley, County Administrator Mark McCauley, Central Services Director DATE: April 9, 2018 RE: Six Potential Appointments to the Review Committee on Commercial Shooting Facilities STATEMENT OF ISSUE: The Board of County Commissioners will consider six potential appointments to a Review Committee, pursuant to the county's ordinance establishing a moratorium on permits for siting or modifying commercial shooting facilities in unincorporated Jefferson County (Ordinance 05- 1218-17 as amended by Ordinance 01-0220-18). ANALYSIS: Pursuant to the moratorium ordinance, the purpose of the Review Committee is to: (a) Study the safety, environmental and land use impacts of commercial shooting facilities and reasonable measures to address those impacts, including among other measures whether there should be an amendment to the No Shooting Areas Ordinance, Chapter 8.50 JCC to allow indoor commercial shooting facilities in No Shooting Areas; and, (b) Provide input to the County as the County generates and recommends a draft ordinance. Within 120 days of the Review Committee's establishment, a draft shooting facility ordinance for existing and new commercial shooting facilities in unincorporated Jefferson County will be forwarded to the Planning Commission (if within its jurisdiction), or to the Board of County Commissioners. The Review Committee will be appointed by the Board of County Commissioners and composed as follows: • a resident or property owner from each of the three districts of Jefferson County; • one at large Jefferson County resident or property owner appointed by the BoCC. • a representative of each current commercial shooting facility in unincorporated Jefferson County; • one representative of tribal interests, if interested; and 1 of 7 the director of the department of community development or the director's designee (chair); Jefferson County Sheriff or the Sheriff's designee; and Jefferson County Director of Environmental Health or the director's designee; Both the Jefferson County Prosecuting Attorney (or designee), and C. Vargas and Associates, the firm hired to provide technical support to the County and the Review Committee, shall be ex officio members of the Review Committee, but shall not be required to attend every meeting of the Review Committee. All Review Committee meetings are subject to the Open Public Meetings Act, Chapter 42.30 RCW. Jefferson County government is fortunate to serve an involved and civic -minded community. Thirteen individuals have graciously volunteered to fill four Review Committee seats: seats from each Commissioner District 1, 2 and 3, plus one At Large seat. In addition, the Jefferson County Sportsmen's Association has nominated an individual to represent the county's one existing commercial shooting facility. In making appointments from these individuals, the Board seeks to create a balanced Review Committee that includes a wide range of knowledge and diverse perspectives, without giving any one perspective dominance. The table on the next page lists the community volunteers, with yellow highlights showing staff's suggestions for including diversity and balance in the Committee. Two well-qualified individuals have been nominated by tribes, the Vice -Chairman of the Hoh Indian Tribe, and the Wildlife Program Manager of the Point No Point Treaty Council: Tribal Melvinjohn Ashue, Tribe Vice -Chairman Hoh Indian Tribe Representative Tim Cullinan, Wildlife Program Mgr Point No Point Treaty Council, and by Jamestown S'Klallam Tribe Nominating letters for both individuals are attached to this Agenda Request for the Board's consideration. The Board can appoint one tribal representative for the Review Committee. FISCAL IMPACT: None from making appointments. Costs are associated with completing the work plan pursuant to the ordinance. RECOMMENDATION: Staff recommends that the Board of County Commissioners review the mix of individuals who have volunteered or been nominated, consider staff's suggestions, ask questions, and pass a motion to make appointments to these six seats of the Review Committee (District 1, District 2, District 3, At -Large, Existing commercial shooting facility, and Tribal Interests), or if not prepared to make appointments now, give direction to staff for further information the Board may request. We would like to nominate Melvinjohn Ashue the Vice - Chairman for the Hoh tribe to participate in this committee. Melvinjohn Ashue already participates in meetings in Jefferson County and would like to continue to have him work with the county on different issues or concerns that may affect the county the Tribe is located in. BOX 1220 APR 0 2 2018 Port Townsend, WA 98368A S < . f, �LE ���i l� ig M Dear Commissioners, The Point No Point Treaty Council (PNPTC) is writing to submit the nomination of Tim Cullinan to be appointed as the representative of Tribal interests on Jefferson County's Review Committee to study the safety, environmental, and land use impacts of commercial shooting facilities and to advise the County regarding regulation of such facilities. The PNPTC is a natural resource management organization that provides professional resource management services to the Port Gamble S'Klallam and Jamestown Tribes to fulfill the requirements placed upon them by the U.S. Supreme Court in U.S. v. Washington (the "Boldt Decision"). The Treaty Council confirms the reserved rights established in the 1855 Treaty of Point No Point, and implements goals set by member Tribes for resource conservation, management, and the protection of treaty rights. All of eastern Jefferson County lies inside the area our member Tribes ceded to the United States in the Treaty, where our Tribes still retain Treaty rights. Mr. Cullinan has a long history of participating in conflict resolution and multi -stakeholder collaborative management. As an early participant in Washington's landmark Timber -Fish - Wildlife Agreement he chaired several committees that guided implementation of new forest practices regulations. He led efforts to develop new consensus -based regulatory protections of wildlife trees and forested wetlands under state forest practices rules. He was an active participant in negotiating environmental protections in Simpson Timber Company's Habitat Conservation Plan under Section 10 of the Endangered Species Act. In 2006 the U.S. Department of Interior appointed him to serve as a member of the Northern Spotted Owl Recovery Team, where he collaborated with state and federal agencies and timber industry interests to develop a draft recovery plan. The Point No Point Treaty Council, on behalf of the Jamestown S'Klallam and Port Gamble S'Klallam Tribes, is pleased to nominate Mr. Cullinan for appointment to Jefferson County's Review Committee.
