• Thank you for coming and participating in your government at work! The next open house and public hearing regarding the Comprehensive Plan and Code Updates will
occur Thursday, April 19, 2018 at 5:30 pm at the Quilcene Community Center. The verbal record will remain open until April 19th and written testimony will be accepted until 5 pm, Friday, April 20th. All
written testimony should be directed to plancomm@co.jefferson.wa.us or to the Jefferson County DCD, 621 Sheridan Street, Port Townsend, WA 98368.

1) An optional time period dedicated to listening to the
public, not a question and answer session. The Planning
Commission is not required to provide response;

We have updated our request letter with your clarifications. We would like to see Jefferson County follow other neighboring
counties, & consider
marijuana production & processing to be an industrial use, not an agricultural use, & only allow it in zones consistent with that
characterization.

RE: Revised Jefferson County Code Revision Requests
Dear Mr. Peterson:
We would like to request changing the Jefferson County Marijuana policy codes to be consistent with our
neighboring counties, & completely eliminate cannabis grow and processing facilities in Rural Residential
Zones R1:5, R1-10 and R1:20, (with no CUP options), allowing them only in Industrial Zones.
We believe the easiest way to make this change is to follow Skagit County’s lead:
“Skagit County considers marijuana production & processing to be an industrial use, not an agricultural
use, and only allows it in zones consistent with that characterization.” (Quoted from Skagit County Permit
Guidance for Recreational & Medical Marijuana, updated 8/7/2015)
An example of requested wording changes in the Jefferson County Code is the following, and these changes
could be made throughout the County Code:
JCC 18.20.295 Recreational Marijuana/Cannabis (3) Use Zones (a) Production

a. Production. Allowed as a yes use in agricultural zoning district, rural industrial zoning districts.
Allowed as a conditional discretionary (C (d)) use in (remove: rural residential zoning districts)
forest resource zoning districts. Prohibited in (add: rural residential), rural commercial, urban
commercial, urban public, urban residential, county waste management essential public facility
(CWMEPF) and mineral resource lands (MRL), parks, preserves and recreation (PPR) and Port
Ludlow master plan resort zoning districts.
Supporting our request is RCW.36.70A.100 from Washington State:
36.70A.100 Comprehensive plans - Must be coordinated.
“ The compressive plan of each county or city that is adopted pursuant to RCW 36.70A.040 shall be
coordinated with, and consistent with, the comprehensive plans adopted pursuant to RCW.36.70A.040 of other
counties or cities with which the county or city has, in part, common boarders or other regional issues.”
The following four counties, Kitsap, Mason, Whatcom and Skagit, have common boarders or related
regional issues and all prohibit cannabis growing & processing facilities in Rural Residential. We include
these as examples of ways to change the Jefferson County Code:
KITSAP COUNTY (our neighbor to the Southeast)
PROHIBITS THESE FACILITIES IN RURAL RESIDENTIAL
Grow Facilities are only allowed in:
1. Urban Industrial
2. Rural Employment Center
3. 12 Trees Employment Center
4. Business Center
Processing Facilities are only allowed in:
1. Business Center
2. Business Park
3. Urban Industrial
4. Rural Employment Center
5. 12 Trees Employment Center
MASON COUNTY (our neighbor directly to the South)
PROHIBITS THESE FACILITIES IN RURAL RESIDENTIAL
Only allowed in :
1. General Commercial
2. Mixed Uses
3. Business Park
4. Highway Commercial
5. Commercial Industrial
6. Rural Commercial
WHATCOM COUNTY (our neighbor to the North, bordering Canada)
PROHIBITS THESES FACILITIES IN RURL RESIDENTIAL
Only allowed in:
1. General Commercial
2. Light Industrial
3. Rural Industrial
4. Manufacturing
5. Heavy Impact Industrial
SKAGIT COUNTY (our Northeast neighbor)
PROHIBITS THESES FACILITIES IN RURAL RESIDENTIAL
Only allowed in:
1. Bayview Ridge Light Industrial
2. Bayview Ridge Heavy Industrial

3. Urban Reserve Commercial-Industrial
4. Agricultural/Natural Resource Lands (in a structure existing
before January 1, 2014)

We suggest following the guidelines implemented by Skagit County:

The Washington State mandate for consistency is as follows: RCW 36.70A.100 Comprehensive plans - Must be coordinated. “ The comprehensive plan of each county or city that is adopted pursuant to RCW 36.70A.040 shall be coordinated with, and consistent with, the comprehen-sive plans adopted pursuant to RCW 36.70A.040 of other counties or cities with which the county or city has, in part, common borders or other regional issues.”
The following five counties, Clallam, Kitsap, Mason, Whatcom and Skagit, have common borders or related regional issues and all prohibit cannabis
growing & processing facilities in Rural Residential. We include Whatcom
County as an example for changing the Jefferson County Code:
WHATCOM COUNTY (our neighbor to the North) prohibits these facilities in Ru-
ral Residential and only allows them in the following zones:
1. General Commercial
2. Light Industrial
3. Rural Industrial
4. Manufacturing
5. Heavy Impact Industrial
Therefore, Marrowstone Island Coalition requests the following wording changes to the Jefferson County Code: JCC 18.20.295 Recreational Marijuana/Cannabis (3) Use Zones (a) Production. Allowed as a yes use in agricultural zoning district, rural industri-
al and urban industrial zoning districts. Allowed as a conditional discretionary (C(d)) use in [remove: rural residential zoning districts and] forest resource
zoning districts. Prohibited in [add: rural residential] rural commercial, urban
commercial, urban public, urban residential, county waste management essential
public facility (CWMEPF) and mineral resource lands (MRL), parks, preserves
and recreation (PPR) and Port Ludlow master plan resort zoning districts.
(b) Processing. Allowed as yes use in rural industrial and urban industrial zoning
districts. Allowed as a conditional discretionary (C(d)) use on agricultural re-
source lands. Allowed as conditional discretionary (C(d)) with a cottage industry
permit in forest resource lands. [remove: and rural residential zoning dis-tricts]. Prohibited in [add: rural residential], rural commercial zoning districts,
urban commercial, urban public, urban residential, county waste management essential public facility (CWMEPF) and mineral resource lands (MRL), parks, preserves and recreation (PPR) and Port Ludlow master plan resort zoning dis-tricts. (c) Retailing. Allowed as a yes use in neighborhood/visitor (NC), general cross-roads (GC), rural village center (RVC), urban commercial (UC) and urban indus-trial (ULI) zoning districts. Allowed as a conditional discretionary (C(d)) use on agricultural resource lands. Allowed as conditional discretionary (C(d)) with a cot-
tage industry permit in forest resource [remove: and rural residential] zoning
districts. Prohibited in [add: rural residential], convenience crossroads (CC),
visitor-oriented commercial (VOC), urban public, urban residential, county waste management essential public facility (CWMEPF) and mineral resource lands (MRL), parks, preserves and recreation (PPR) and Port Ludlow master plan re-sort zoning districts.
In addition, in JCC 18.20.295 Recreational Marijuana/Cannabis
(4) (a)(i)(A)(I)(B)(c)(f)(h) remove all rural residential references.
The Marrowstone Island Coalition is a group of 25 concerned residents support-
ed by 160 residents who attended the hearing in opposition to Austin Smith’s
proposal for a cannabis greenhouse on Marrowstone Island.
