ESTABLISHING INTERIM URBAN GROWTH }
AREAS }
ORDINANCE NO. 04-0228-94
Section 1.00: Amendment to Section 4 of the Jefferson County Interim Urban Growth
Areas Ordinance (Ordinance No. 02-0110-94): Section 4 of the Jefferson County Interim
Urban Growth Areas Ordinance (Ordinance No. 02-0110-94) is hereby replaced by the
following amendatory language:
Section 4.00 Subdivision Densities Outside of Interim Urban Growth Areas:
All new subdivisions occurring outside of Interim Urban Growth Areas
and within areas currently designated "Suburban" and "Rural" under the
Jefferson County Comprehensive Plan shall be designed in such a
manner that each residential parcel created has a minimum lot area of one
acre in size. Lot area calculations are exclusive of road rights-of-way,
road easements, community well site easements and similar community
encumbrances or dedications as portrayed on the plat. Drainage and
utility easements, however, may be included as part of lot area
calculations.
Section 2.00: Severability: If any section, subsection, or other portion of this ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such section, subsection, or portion shall be deemed a separate portion of this ordinance
and such holding shall not affect the validity of the remaining portions of this
ordinance.
Section 3.00: Effective Date: This ordinance shall not become effective until ten (10)
days following the date of adoption set forth in Section 4.00 below.
