PIc 7.-'1-~~ 1 2 3 4 5 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 STATE OF WASHINGTON COUNTY OF JEFFERSON An ordinance conserving, on ) an interim basis, mineral lands) of long-term commercial signi- ) ficance, as required by Chapter) 36.70A.170 RCW ) Ordinance No. 06-0705-94 The Jefferson County Board of Commissioners enter the following findings: section 1.00 Desiqnation of Interim Mineral Lands of Long-Term Commercial Siqnificance Any lot, tract, parcel, or site currently operating under a Surface Mining Permit issued by the washington State Department of Natural Resources, and at least one half (1/2) mile outside of any Interim Urban Growth Area boundary, is hereby designated as interim mineral land of long-term commercial significance (henceforth "designated land") . Section 2.00 Removal of Designation Designations shall lapse upon closure of the mining site to which the designation pertains in accordance with the Surface Mining Reclamation Act, RCW 78.44, section 3.00 Regulations No designated land shall be subdivided to a lot size of less than ten (10) acres, nor shall more than one residence be built per lot, section 4.00 Riqht to Extract Minerals The County guarantees the right to mine on designated lands. Upon issuance by the County of any development approval on any parcel within three hundred (300) feet of designated lands, the County shall place notice on the title of said parcel indicating that it is near land on which activities incompatible with residential development may occur. section 5.00 Voluntarv Desiqnation Owners of land not designated under section 1,00 may petition for designation as mineral land, thereby subjecting their land to the regulations of section 3.00 and the protections of section 4.00, provided said land 1. is at least one half (1/2) mile from any Interim Urban Growth Area, comprises at least ten (10) acres, and possesses high potential for mineral deposits according to: 2. 3. a. U.S. Soil Conservation Service: Soil Survey of Jefferson County, or written testimony from a qualified geologist. c. section 6.00 Severability If any section, subsection, or other portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such section, subsection, or portion shall be deemed a separate portion of this ordinance and such holding shall not affect the validity of the remaining portions of this ordinance. section 7.00 Effective Date This ordinance shall not become effective until ten (10) days following the date of adoption set forth in section 8.00 below.
