ORDINANCE NO. 04-0614-93
WHEREAS, R.C.W. 7.75, et.seq. authorizes the creation of alternative
dispute resolution centers to provide speedy, cost effective, non-judicial resolution of
disputes; and,
WHEREAS, Jefferson County pursuant to Resolution No. 42-93 of the
Board of County Commissioners has recognized the Peninsula Dispute Resolution
Center as the dispute resolution center for Jefferson County; and,
WHEREAS, R.C.W. 7.75.035 authorizes the Board of County
Commissioners to impose a surcharge on court filing fees for the purpose of funding
dispute resolution centers. The monies collected pursuant to this authority must be
used solely for dispute resolution centers established under R.C.W. 7.75, et. seq.;
and,
WHEREAS, R.C.W. 26.12.220 authorizes the Board of County
Commissioners to impose a fee on the issuance of marriage licenses, not to exceed
eight (8) dollars to pay the expenses of family court under Chapter 26.12 RCW and
to contract with a public or private agency or person to provide family court
services; and,
NOw, THEREFORE, BE IT ORDAINED by the Board of County Commis-
sioners of Jefferson County, Washington:
WHEREAS, RCW 26.12 authorizes the use of mediation services such as
those provided by the Peninsula Dispute Resolution Center for family court pur-
poses.
SECTION 1. PURPOSE: The purpose of this ordinance is to impose the following
surcharges:
A surcharge of ten (10) dollars on each civil filing fee in the District
Court of Jefferson County.
A surcharge of fifteen (15) dollars shall be imposed on each filing fee for
small claims actions in District Court.
A additional fee of eight (8) dollars shall be charged on each marriage
license.

SECTION 2. EFFECTIVE DATE:
The surcharges and additional fee authorized hereunder shall commence ten (10)
days after this Ordinance has been approved by the Board of County Commis-
sioners pursuant to R.C.W. 7.75.020 (2). Upon approval, the Clerk of the Board is
directed to forthwith notify the Clerk of the District Court and the Auditor of Jeffer-
son County of the Board's approval. Said notification shall be in writing and
shall advise the Clerk of the District Court and the Auditor of the effective date of
the surcharges and fee increase.
SECTION 3. COLLECTION AND IMPLEMENTATION:
Surcharges imposed shall be collected by the Clerk of the Court and remitted to the
County Treasurer for deposit in a separate account to be used solely for dispute
resolution centers established under R.C.W. 7.75, etseq. The additional fee on
marriage licenses shall be collected and deposited in the same manner as other
County funds are collected and deposited, and shall be maintained in a separate
account to be used as provided in R.C.W. 26.12.220. Upon a schedule established
by the Treasurer, said funds shall be disbursed to the Dispute Resolution Center
authorized by the Board of Commissioners.
SECTION 4. SEVERABILITY.
If any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is
for any reason held to be invalid or unconstitutional, such invalidity or uncon-
stitutionality shall not affect the validity or constitutionality of the remaining portions
of this ordinance; it being herein expressly declared that this chapter and each
section, sub-section, paragraph, sentence, clause and phrase thereof would have been
adopted irrespective of the fact that anyone (1) or more other sections, subsections,
paragraphs, sentences, clauses, or phrases be declared invalid or
unconstitutional.
