WHEREAS, many persons convicted of committing misdemeanors fail to pay their fines
and costs assessed against them; and
WHEREAS, RCW 10.82.030 provides that any person may be taken into custody for
not paying the fines and costs adjudged against him/her; and
WHEREAS, RCW 10.82.040 allows a defendant committed to jail for failure to pay
fines and costs to perform labor to reduce the amount owing and thereby reduce the length
of such incarceration; and
WHEREAS, RCW 10.82.030 provides that the County legislative authority establish an
amount by which fines and costs shall be reduced for every day a defendant is incarcerated
for non-payment of fines and costs and performs labor; and
WHEREAS, RCW 10.82.030 provides that the County legislative authority establish a
lesser amount by which fines and costs shall be reduced for every day a defendant is
incarcerated and does not perform labor;
NOW, THEREFORE BE IT ORDAINED, by the Board of Jefferson County
Commissioners in consideration of the above:
(1)
For every day a defendant is incarcerated for non-payment of fines and costs
and performs labor as permitted by the Sheriff and not as a community service
obligation, said fines and costs shall be reduced by ...$40.00 .
(2)
For every day a defendant is incarcerated for non-payment of fines and costs
and does not perform labor, said fines and costs shall be reduced by jì25.00.
