HomeMy WebLinkAbout07 0706 92ORDINANCE NO. 07-0706-92 AN ORDINANCE AMENDING ORDINANCE NO. 5-90 ESTABLISHING BOATING REGULATIONS BOATING SAFETY PROGRAM WHEREAS, Jefferson County has adopted Ordinance No. 5-90 to establish boating regulations in the County to promote safety and enjoyment of persons using the water of this County, and WHEREAS, certain waters within this County have been subjected to increasing use for recreational purposes such that conflicts between various uses may create the potential for hazards on the water, and WHEREAS, these conflicts may be chiefly attributed to unregulated speed of vessels on certain identified waters; and WHEREAS, it has been brought to the attention of the County Commis- sioners that certain sections of Ordinance 5-90 need to be amended in order to better meet the needs of the citizens with regard to vessel speeds on these identified waters. NOW, THEREFORE, BE IT ORDAINED BY THE JEFFERSON COUNTY BOARD OF COMMISSIONERS that the below noted sections of Or- dinance No. 5-90 are to be amended to read as follows: be unlawful or in excess hundred and Section 11. Speed Limit. Except as permitted in Section 22, it shall for any person to operate a vessel at a speed sufficient to create a wake of seven (7) nautical miles per hour, whichever is less, within one fifty feet (150') of any shoreline, pier, breakwater or restricted area. However, in instances where steerage may be lost due to high winds or excessive currents, a vessel may exceed seven (7) knots to such speed as may be sufficient for safe operation of the vessel, leaving the least wake possible. ADD THE FOLLOWING PARAGRAPH: PROVIDED, that the area of Port Ludlow Bay southerly of a line extending due east from the southern tip of Burner Point to the east shore of Port Ludlow Bay is hereby declared a Restricted Area and the boat speed in that Restricted Area shall be five nautical miles per hour. Section 27. Special Rules - Jefferson County Lakes. For the purpose of this section the definition of the word vessel shah include seaplanes. (1) It shall be unlawful to operate any vessel on the waters of any lake in Jefferson County at a rate of speed greater than ten (10) miles per hour. (2) Any person violating this Section shall be guilty of a misdemeanor and may be punished by a fine of up to Two Hundred Fifty Dollars ($250.00) and/or ninety (90) days in the County Jail. ADD THE FOLLOWING SUBSECTIONS: (3) Except during takeoffs or landings it shall be unlawful to taxi se~iplanes on the waters of any lake in Jefferson County at a rate of speed greater than ten (10) miles per hour. Ordinance No. 07-0706-92: Amending Ordinance No. 5-90 Page: 2 (4) (5) During takeoffs or landings it shall be unlawful to operate seaplanes closer than five hundred (500) feet to water-skiers, swimmers or vessels. Except in an emergency, it shall be unlawful to operate a seaplane on the waters of any lake in Jefferson County that has a straight line shore to shore length of less than five thousand (5,000) feet. The intent of this section is to include all lakes existing in Jefferson County at the time of adoption of this ordinance. This ordinance amends the noted sections of Ordinance No. 5-90 and shall become effective the 20th day of July , 1992. DATED this 6th day of July, 1992. Lorna L.
