AN ORDINANCE AMENDING ORDINANCE 5-89
PLANNING & BUILDING DEPARTMENT FEE SCHEDULE
PURPOSE AND SCOPE:
The purpose of this ordinance is to amend Planning and Building Depart-
ment Fee Schedule to include fees for new services as follows:
Interim Zoning Applications
SEPA Checklist Fee
SEPA Pending Threshold Notice Boards

Amendment to Ordinance 5-89:
Planning and Building Department Fee Schedule
Revised and Adopted at Public Hearing, August 17, 1992.
The proposed amendment to the Planning and Building Department Fee
Schedule is a response to County implementation of the Emergency
Zoning ordinance and changes in the SEPA ordinance. Three additions
to the existing fee schedule are being requested:
- A $75 fee for Interim Zoning Applications
- A $40 fee for publication of SEPA Pending Threshold
Determination
- A $30 refundable deposit for SEPA Pending Threshold
Determination Notice Boards.
INTERIM ZONING APPLICATIONS
The $75 fee for zone change applications made under the Emergency
Zoning Ordinance (No. 1-0106-92) is designed to replace the
Certificate of Compliance fee charged for administrative reviews
under the old Development Code.
While the Certificate of Compliance base fee was set at $50, and
credited towards any building permit subsequently issued,
additional fees were charged for cases that:
Firstly, required referral to the Planning Commission,
Secondly, required a public hearing.
The referral fee and hearing notice fee were set at $50 each,
giving a total fee of $150 ($100 non-refundable) for cases that
required the Planning Commission to conduct a public hearing.
The proposed $75 fee for Interim Zoning Applications therefore
represents a $25 reduction in non-refundable applicant costs for
a process with similar requirements to that existing under the old
development code.
PUBLICATION OF SEPA PENDING THRESHOLD DETERMINATION
The $50 fee currently charged by the County for the SEPA checklist
review process was adopted prior to the recent amendments to the
SEPA Implementing Ordinance. These changes have increased the
public notification responsibilities of the County through
requiring publication of pending threshold determination notices
in the 'Leader'. These notices have been costing the Planning
Department an average of approximately $30 each, leaving $20 to
cover the costs of administrative review and notice board
production.
Comparing the current fee with other counties in western Washington
reveals the following information:

It should be noted that in addition to having higher SEPA fees than
Jefferson County, none of the other counties listed has equivalent
requirements for publication of pending threshold determinations,
thus these costs are not incurred.
Conversations with Kitsap County Planning staff also revealed that
a forthcoming review of their fee ordinance is expected to result
in their SEPA checklist fee being increased.
SEPA NOTICE BOARDS
The recent amendment to the SEPA implementing ordinance also
required the County to provide notice boards for the petitioner to
post notices of pending threshold determination at a review site.
In order to meet this requirement, the Planning Department arranged
for a number of 2' by 3' wooden notice boards to be constructed by
volunteers. Even allowing for the.fact that no labor was charged
for constructing these boards the average cost in materials was
$6.50 (80 boards being constructed at a total cost of $520.05).
Charging applicants a refundable deposit of $30 for the 3 boards
required for each site would:
Firstly, offset all the material costs associated with constructing
the boards in the event of their not being returned.
Secondly, allow for the possibility of the Department being
required to pay labor charges for constructing replacement boards.
Applicants would receive a full refund of the $30 deposit if all
notice boards were returned to the department following the
threshold determination process. This may provide a sufficient
incentive to raise the board return rate above its present 50%
level.
