HomeMy WebLinkAbout05 0916 91IN THE BOARD OF THE COUNTY COMMISSIONERS IN AND FOR THE COUNTY OF JEFFERSON IN THE MATTER OF an ordinance changing) the designation of the responsible ) official under the Jefferson County ) State Environmental Policy Act ) Implementing Ordinance, No. ?-84, ) from the Jefferson County Board of ) County Commissioners to the Director ) of the Jefferson County Planning ) Department. ) ORDINANCE NO. 5-0916-91 WHEREAS, the Jefferson County State Environmental Policy Act Implementing Ordinance, No. ?-84, presently designates the Jefferson County Board of County Commissioners as the "responsible official" for the purposes of making threshold determinations, supervising the scoping and preparation of required environmental impact statements, and performing other functions assigned by the "lead agency"; and WHEREAS, the Jefferson County Board of County Commissioners finds that the recent acceleration of growth in Jefferson County has added to the number and complexity of its tasks as the "responsible official"; and WHEREAS, the Jefferson County Board of County Commissioners finds that changing the designation of the "responsible official" would assist in conserving its own, as well as staff, resources in the form of time and energy expended on detailed project reviews; and WHEREAS, the Jefferson County Board of County Commissioners finds that by delegating its duties as the "responsible official" to the Director of the Jefferson County Planning Department, the quality, efficiency, and predictability of SEPA project reviews would be improved; and WHEREAS, the Jefferson County Board of County Commissioners finds that changing the designation of the "responsible official" would serve the best interests of the citizens of Jefferson County; NOW, THEREFORE, the Jefferson County Board of County Commissioners hereby ordains that the following provisions of the Jefferson County State Environmental Policy Act Implementing Ordinance, No. 7-84 shall be amended as follows: Subsection 3,20(1) shall be amended to read: "For those proposals for which the County is the lead agency, the responsible official shall be the Director of the Jefferson County Planning Department." Severabilit¥: If any portion of this ordinance is held invalid by any court of competent 3urisdiction, such portion shall be deemed a separate portion of this ordinance and such holding shall not affect the validity of the remaining portions of this ordinance. Effective Date: This ordinance shall become effective on the 16th day of September, 1991. Adoption: Adopted by the Jefferson County Board of Commissioners on this 16th day of September, 1991.
