HomeMy WebLinkAboutM06282016 RISK MANAGEMENT COMMITTEE June 28, 2016 -10:30 a.m. SPECIAL MEETING MINUTES MEMBERS: Philip Morley, County Administrator/Risk Manager Erin Lundgren, Clerk of the Board/Risk Coordinator (Chair) Ruth Gordon, Superior Court Clerk Bob Hamlin, Emergency Management Program Director/Safety Officer Vacant, Department Director LEGAL COUNSEL: David Alvarez, Deputy Prosecuting Attorney SECRETARY: Leslie Locke, Executive Assistant/Claims Coordinator Chair Erin Lundgren called the meeting to order at 10:30 a.m. in the presence of Members Philip Morley, Ruth Gordon, Bob Hamlin and Legal Counsel David Alvarez. Prosecuting Attorney Michael Haas was also present. APPROVAL OF MINUTES Member Gordon moved to approve the meeting minutes of June 7, 2016 as presented. Member Morley seconded the motion which carried by a unanimous vote. EXECUTIVE SESSION An Executive Session was scheduled from 10:35 a.m. to 10:45 a.m. with the County Administrator, Clerk of the Board, Chief Civil Deputy Prosecuting Attorney, Superior Court Clerk, and Executive Assistant/Claims Coordinator regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). The actual period of time the Committee met in Executive Session on this topic was from 10:35 a.m. to 10:43 a.m, At the conclusion of the Executive Session the Committee resumed the regular meeting. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: #C-03-16 Claimant: Terry Breland Damages: $399.84 Allegation: Personal Property Damage The Committee reviewed the details of this claim. The claimant alleges that a Jefferson County Sheriffs Deputy placed the claimant's cell phone on the patrol vehicle and drove off. The cell Risk Management Committee Special Meeting Minutes — June 28, 2016 Page: 2 phone fell on the ground and was run over by another vehicle. An incident report was filed by the Sheriffs Department confirming the damage to the claimant's cell phone. The claimant is requesting $399.84 which is the total amount to pay off his current cell phone contract. That amount does not include the cost to purchase a new cell phone. The Committee discussed the actual cost to replace the claimant's cell phone. Member Gordon stated that due to the actions of the Deputy Sheriff, she feels it is the responsibility of the County to replace the cell phone not pay off the cell phone contract. Member Hamlin moved to request documentation from the claimant showing the cost of a replacement phone and to authorize the County Administrator to review the documents and approve payment not to exceed $700. Member Gordon seconded the motion which carried by a unanimous vote. The Secretary will contact the claimant and request the appropriate documents and prepare the necessary documents to process payment of this claim. Decision: Approved OLD BUSINESS The Committee reviewed the 2016 Civil Lawsuit Status Log (as of June 20, 2016) prepared by Chief Civil Deputy Prosecuting Attorney Alvarez. NEW BUSINESS Member Gordon informed the Committee that there has been a recent State Supreme Court case that could impact Jefferson County by having to release debt on cases where judgement has expired. The Prosecuting Attorney's Office will work with Member Gordon to draft an Administrative Order to reduce potential liability to the County. NOTICE OF ADJOURNMENT Member Gordon moved to adjourn the meeting at 11:21 a.m. Member Morley seconded the motion which carried by a unanimous vote.
