HomeMy WebLinkAboutM12022014 RISK MANAGEMENT COMMITTEE December 2, 2014 -10:30 a.m. MEETING MINUTES MEMBERS: Philip Morley, County Administrator/Risk Manager Erin Lundgren, Clerk of the Board/Risk Coordinator (Chair) Ruth Gordon, Superior Court Clerk Jean Baldwin, Public Health Director Bob Hamlin, Emergency Management Program Manager/Safety Officer LEGAL COUNSEL: David Alvarez, Deputy Prosecuting Attorney SECRETARY: Leslie Locke, Executive Assistant/Claims Coordinator Chair Erin Lundgren called the meeting to order at 10:30 a.m. in the presence of Members Ruth Gordon, Philip Morley, Jean Baldwin and Legal Counsel David Alvarez. Member Bob Hamlin was absent. APPROVAL OF MINUTES Member Gordon moved to approve the meeting minutes of November 4, 2014 as presented. Member Baldwin seconded the motion. The motion carried. EXECUTIVE SESSION An Executive Session was scheduled from 10:35 a.m. to 11:00 a.m. with the Deputy Prosecuting Attorney, County Administrator, Public Health Director, Superior Court Clerk, Clerk of the Board, and Executive Assistant/Claims Coordinator regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). The actual period of time the Committee met in Executive Session on this topic was from 10:35 a.m. to 10:57 a.m. At the conclusion of the Executive Session the Committee resumed the regular meeting. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: #C-03-14 Claimant: Linda Nelson Damages: $1,000,000.00 Allegation: False Arrest and Assault by Jefferson County Deputies and Jailers Risk Management Committee Meeting Minutes — December 2, 2014 Page: 2 The Committee is waiting for a response from the Sheriff s office regarding this claim. Deputy Prosecuting Attorney Alvarez will contact the Washington Counties Risk Pool to discuss the medical documents that the claimant provided with this claim. No Action was taken. Decision: Pending Claim No.: #C-08-14 Claimant: Richard Nelson Damages: $513.23 Allegation: Property Damage to Windshield The Committee reviewed the details of this claim. The claimant alleges that a County vehicle pulling a trailer was traveling North on Center Valley Road while he was traveling South on Center Valley Road. A rock came off the truck or trailer resulting in his windshield being damaged. The Public Works Department submitted a recommendation to deny the claim due to the fact that rocks or traction sand material projected upward from the road surface by a tire of a vehicle is a "road hazard" for which the County is not liable. Member Morley moved to deny claim #C-08-14. Member Gordon seconded the motion. The motion carried. Secretary Locke will draft a letter of denial to be sent to the claimant. Decision: Denied Claim No.: #C-09-14 Claimant: Allan Caillier Damages: $300.00 Allegation: Property Damage to Windshield The Committee reviewed the details of this claim. The claimant alleges that he was following a County vehicle traveling North on Highway 19. A rock was thrown from the right side of the dual wheels of the County vehicle resulting in his windshield being damaged. The Public Works Department submitted a recommendation to deny the claim due to the fact that rocks or traction sand material projected upward from the road surface by a tire of a vehicle is a "road hazard" for which the County is not liable. Member Gordon moved to deny claim #C-09-14. Member Morley seconded the motion. The motion carried. Secretary Locke will draft a letter of denial to be sent to the claimant. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). The actual period of time the Committee met in Executive Session on this topic was from 11:05 a.m. to 11:20 a.m. At the conclusion of the Executive Session the Committee resumed the regular. No old business was discussed. OLD BUSINESS NEW BUSINESS DISCUSSION re: Windshield Damage Claims: Member Morley moved to revisit the way windshield claims are handled by the Risk Management Committee. Member Gordon seconded the motion. The motion carried. Secretary Locke was directed to extend an invitation to the Public Works Director and Public Works staff to attend a future meeting to discuss this issue. She was also asked to gather the following information on past windshield damage claims: 1) Time of year incident occurred; 2) The number of claims received; and 3) The number of claims that were approved/denied. ANNOUNCEMENT re: Member Baldwin announced her intention to resign from the Risk Management Committee. This matter will be discussed at a future meeting.
