HomeMy WebLinkAboutM08062013RISK MANAGEMENT COMMITTEE August 6, 2013 - 10:00 a.m. MINUTES MEMBERS: Philip Morley, County Administrator/Risk Manager Erin Lundgren, Clerk of the Board/Risk Coordinator (Chair) Judi Morris, Treasurer Jean Baldwin, Public Health Director Bob Hamlin, Safety Officer LEGAL COUNSEL: David Alvarez, Deputy Prosecuting Attorney RECORDER: Leslie Locke, Deputy Clerk of the Board Chair Erin Lundgren called the meeting to order at 10:00 a.m. in the presence of Members Judi Morris, Jean Baldwin, Bob Hamlin and Philip Morley and Legal Counsel David Alvarez. APPROVAL OF MINUTES Member Morris moved to approve the meeting minutes of July 2, 2013 as presented. Member Baldwin seconded the motion which carried by a unanimous vote. EXECUTIVE SESSION An Executive Session was scheduled from 10:05 a.m. to 10:20 a.m. with the County Administrator, Deputy Prosecuting Attorney, Public Health Director, Treasurer, Safety Officer, Clerk of the Board, and the Deputy Clerk of the Board regarding actual litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). The actual period of time the Committee met in Executive Session on this topic was from 10:05 a.m. to 10:15 a.m. At the conclusion of the Executive Session the Committee resumed the regular meeting and no action was taken. Member Morris excused herself for the remainder of the meeting. An Executive Session was scheduled from 10:20 a.m. to 10:40 a.m. with the County Administrator, Deputy Prosecuting Attorney, Public Health Director, Treasurer, Safety Officer, Clerk of the Board, and the Deputy Clerk of the Board regarding potential litigation. At the conclusion of the Executive Session the Committee resumed the regular meeting and the following action was taken. Claim No.: C-04-13 Claimant: Jay Oppenborn Damages: $948.91 - $1,029.80 Allegation: Vehicle Windshield Damage The Committee reviewed the details of this claim. The Claimant alleges that during the chip sealing process on Oak Bay Road a County pilot vehicle threw a rock resulting in his windshield being cracked. The Public Works Department submitted a recommendation to deny this claim due to the fact that rocks or traction sand material projected upward from the road surface by a tire of a vehicle is a "road hazard" for which the County is not liable. Member Morley moved to deny claim 4C-04-13. Member Hamlin seconded the motion. The motion carried. The Deputy Clerk of the Board will draft a letter of denial. Decision: Denied Claim No.: C-05-13 Claimant: John Grande Damages: $250.00 (Insurance Deductible) Allegation: Vehicle Windshield Damage The Committee reviewed the details of this claim. The Claimant alleges a Sheriff's vehicle was traveling in the center turn lane at a high rate of speed, with lights flashing. A rock was thrown resulting in the Claimant's windshield being cracked. Member Morley moved to wait to take action until a response and recommendation is received from the Sheriff s Office. Member Baldwin seconded the motion. The motion carried. Decision: Pending OLD BUSINESS At the June 4, 2013 meeting Member Morley suggested establishing a policy for all Jefferson County employees to be drug tested if they are involved in an accident while driving a County vehicle or their personal vehicle while conducting County business. Member Baldwin informed the Committee that the Personnel Manual contains wording regarding drug testing after an accident. Risk Management Committee Meeting Minutes - August 6, 2013 Page: 3 Discussion of Sample Punitive Damage Language: Legal Counsel Alvarez drafted a "Frequently Asked Questions" handout to be given to employees. This information is helpful for employees when they are named in a civil lawsuit while performing their regular job duties as a County employee. Legal Counsel Alvarez will make some revisions and a draft will be reviewed at a future Risk Management Committee meeting. NEW BUSINESS Discussion re: Washington Counties Risk Pool Audit: On July 9, 2013 Jill Lowe with the Washington Counties Risk Pool conducted an audit of the Jefferson County risk management program. The audit provides a baseline from which to assist the County in strengthening its program. The Committee reviewed the draft audit and staff will respond to the Risk Pool. Update re: Washington Counties Risk Pool Summer Conference: Member Morley and Legal Counsel Alvarez attended the summer conference of the Washington Counties Risk Pool. They updated the committee on items and issues that were discussed at the conference. Washington Counties Risk Pool Deductible Plan: In 2012 the Committee reviewed an analysis prepared by the Washington Counties Risk Pool to increase the amount of the deductible from $10,000 to $25,000 per occurrence. Based on the analysis, Member Morley moved to increase the County's deductible to $25,000 and request a motion from the Board of County Commissioners approving this change, prior to the August 16, 2013 deadline. Member Hamlin seconded the motion. A vote was called on the motion Members Morley and Hamlin, and Chair Lundgren voted for the motion; Member Baldwin abstained from voting. The motion carried.
