RISK MANAGEMENT COMMITTEE

Chair Erin Lundgren called the meeting to order at 10:00 a.m. in the presence of Members Judi
Morris and Philip Morley and Legal Counsel David Alvarez. Member Jean Baldwin was absent.
APPROVAL OF MINUTES
Member Morris moved to approve the meeting minutes of October 2, 2012 (No meeting held in
November) as presented. Member Morley seconded the motion. The motion carried.
EXECUTIVE SESSION
The Committee met in Executive Session from 10:05 a.m. to 10:15 a.m. regarding potential
litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i).
At the conclusion of the Executive Session the meeting returned to open session with the
following action taken.
Claim No.: C-03-12
Claimant: Sarah Sanders
Damages: $5,000
Allegation: Breech of Contract and Destruction of Property
The Committee reviewed the details of this claim. The following two settlement offers were
made to Sarah Sanders: #1 in the amount of $2,400 offered on September 19, 2012; and #2 in
the amount of $5,000 which is the full amount requested by the Claimant offered on October 24,
2012. On November 7, 2012 the Claimant's attorney submitted a letter requesting damages in
the amount of $25,000 for destruction of property. Joe Campeau, an adjuster assigned by the
Washington Counties Risk Pool was asked by Legal Counsel Alvarez to send a letter to Ms.
Sanders re -offering $5,000 with a deadline for acceptance of the offer. Member Morris moved

to direct the Secretary to follow up with Mr. Campeau to make sure the letter was sent with a
deadline for the Claimant to respond to the offer. Member Morley seconded the motion. The
motion carried.
Decision: Pending
Claim No.: C-04-12
Claimant: Kevin Coker
Damages: $24,926
Allegation: Error in Permitting Process — Legal Costs and Loss of Wages
The Committee reviewed the details of this claim. David Alvarez noted that a small claims case
has been filed by Mr. Coker in the Jefferson County District Court. Community Development
Director Carl Smith will be briefed by Mr. Alvarez and outside legal counsel and represent the
County in court regarding the small claims case. The Washington Counties Risk Pool has
assigned W. Dale Kamerrer of Law, Lyman, Daniel, Kamerrer & Bogdanovich, P.S. as the
County's outside legal counsel. On October 25, 2012 Mr. Kamerrer sent a letter to Mr. Coker
explaining the County's position regarding the claim for damages. Member Morley moved to
deny this claim and to send a letter to Mr. Coker notifying him of the decision and include a
copy of Mr. Kamerrer's October 25, 2012 letter. Member Morris seconded the motion. The
motion carried.
Decision: Denied
OLD BUSINESS
Legal Counsel Alvarez inquired about the status of filling the Safety Officer vacancy on the
Risk Management Committee. Member Morley responded that this issue will be discussed
further in 2013.
NEW BUSINESS
A new lawsuit has been filed in Clallam County alleging Jefferson County has violated the
Public Records Act. Legal Counsel Alvarez stated that the Washington Counties Risk Pool does
not cover this type of violation and he will be representing Jefferson County in court.
NOTICE OF ADJOURNMENT
Member Morris moved to adjourn the meeting at 10:34 a.m. and Member Morley seconded the
motion. The motion carried.
