HomeMy WebLinkAboutM12142011RISK MANAGEMENT COMMITTEE December 14, 2011 - 9:30 a.m. MINUTES MEMBERS: Philip Morley, County Administrator/Risk Manager Elizabeth Hill, Clerk of the Board/Risk Coordinator(Chair) Judi Morris, Treasurer Jean Baldwin, Public Health Director Vacant, Safety Officer LEGAL COUNSEL: David Alvarez, Deputy Prosecuting Attorney RECORDER: Leslie Locke, Deputy Clerk of the Board Chair Elizabeth Hill called the meeting to order at 9:30 a.m. in the presence of Member Judi Morris, Member Jean Baldwin, Member Philip Morley and Legal Counsel, David Alvarez. APPROVAL OF MINUTES Member Morley moved to approve the minutes of November 9, 2011 as presented. Member Morris seconded the motion which carried by a unanimous vote. EXECUTIVE SESSION The Committee met in Executive Session from 9:35 a.m. to 10:00 a.m. regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the Executive Session the meeting returned to open session and the following claims were discussed: Claim No.: C-13-11 Claimant: Harold Elyea Damages: $761,058 Allegation: Personal Injury The Committee reviewed the details of this claim. Outside counsel (Mark Johnsen) has been assigned by the Washington Counties Risk Pool and is in the process of investigating this claim. No action was taken by the Committee. Decision: Pending Risk Management Committee Meeting Minutes - December 14, 2011 Page: 2 Claim No.: C-06-10 Claimant: Hanna Tallman, et al; James McGill and Phillip Booth Damages: Unknown Allegation: Bodily Injury The Committee reviewed the details of this claim. An adjuster, Joe Campeau, assigned by the Washington Counties Risk Pool is in the process of investigating this claim. The Washington Counties Risk Pool has requested that this Committee authorize Mr. Campeau to enter into settlement discussions not to exceed $5,000. Member Morley moved to authorize with the recommendation that negotiations begin at 40% of the medical costs or roughly $2,600. He further recommended any funds awarded to the claimant go to direct payment of medical costs. Included in the motion is the direction to Legal Counsel Alvarez to contact the Washington Counties Risk Pool and notify them of these recommendations. Member Morris seconded which carried by a unanimous vote. Decision: Pending OLD BUSINESS Member Morley advised the Committee that a further advertising is needed to fill the Central Services Director vacancy. That person will serve as the Safety Officer for the Risk Management Committee. In reference to a discussion held at the November 9, 2011 RMC meeting, the Deputy Clerk of the Board stated that at the end of each year the Auditor's office bills each department for any claims they incurred which is paid back to the General Fund. NEW BUSINESS Member Morley stated he received correspondence from the Washington Counties Risk Pool regarding loss control data findings. The WCRP is requesting the County to provide an update on the risk assessment. Chair Hill will send out the information to departments. A follow up discussion regarding this issue will take place at the January, 2012 RMC meeting.
