HomeMy WebLinkAboutM06092010 RISK MANAGEMENT COMMITTEE June 9, 2010 - 9:30 a.m. MINUTES MEMBERS: David Alvarez, Deputy Prosecuting Attorney Philip Morley, County Administrator/Risk Manager Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair) RECORDER: Leslie Locke, Deputy Clerk of the Board Chair Lorna Delaney called the meeting to order at 9:30 a.m. in the presence of Member David Alvarez. Member Philip Morley was absent. APPROVAL OF MINUTES Member Alvarez moved to approve the minutes of May 12, 2010 as presented. Chair Delaney seconded the motion. The motion carried. EXECUTIVE SESSION The Committee met in Executive Session from 9:31 a.m. to 9:50 a.m. regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the Executive Session the meeting was reconvened. The committee deliberated and took the following actions. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: C-03-10 Claimant: Johnnie Hynson Damages: $220,100 (Claimant amended amount from $165,000) Allegation: Violation of Public Records Act Member Alvarez stated that Mr. Hynson has filed a lawsuit with the Jefferson County Auditor. An update was given and legal proceedings are moving forward. No action by the Committee was taken. Decision: Pending Risk Management Committee Meeting Minutes - June 9, 2010 Page: 2 Claim No.: C-06-10 Claimant: Hanna Tallman (Represented by State Farm Agent Tom Slighter) Damages: $1,794.18 Allegation: Vehicle Damage The Committee reviewed the details of this claim. Sheriff Hernandez has recommended that this claim be denied. The Washington State Patrol submitted their findings in which they determined that both drivers (Sheriff's van and the Gray Cherokee) bear some liability for the collision. In light of the State Patrol's findings, Member Alvarez suggested the County pay half the damages. Member Alvarez moved to direct the Clerk to send the Washington State Patrol's narrative to the Washington Counties Risk Pool for their review and decision. Chair Delaney seconded the motion. The motion carried. Decision: Pending Claim No.: C-07-10 Claimant: Dee Meek Damages: $1,542.35 Allegation: Vehicle Damage The Committee reviewed the details of this claim. Sheriff Hernandez has recommended payment of this claim. An adjuster, assigned by the Risk Pool has investigated this claim and recommended payment. The Risk Pool has made payment to the Auto Repair Shop (Renaissance Design) in the amount of $1,514.13. Member Alvarez moved to approve reimbursement to the Risk Pool in the amount of $1,514.13. Chair Delaney seconded the motion. The motion carried. The Claimant has also requested reimbursement for both mileage (24 miles) he drove in order to submit a second estimate for damages and for supplies purchased to weatherproof his rear window. Member Alvarez moved to direct the Clerk to contact the claimant and ask him if the outstanding amount owed to him is $17.10. Chair Delaney seconded the motion. The motion carried. Decision: Pending Claim No.: C-08-10 Claimant: Joe D'Amico, SSNW Damages: $30,000.00 Allegation: Personal Damage (Business Tort) The Committee reviewed the details of this claim. This type of claim is covered by the Risk Pool and Guy Bogdanovich, outside legal counsel has been assigned to handle this claim. No action by the Committee was taken. Decision: Pending SAMPLE CLAIM FOR DAMAGES FORM Member Alvarez reviewed some minor changes to the draft claim for damages form. No action by the Committee was taken pending review by the County Administrator/Risk Manager. This item will be carried forward to the next meeting. Risk Management Committee Meeting Minutes - June 9, 2010 Page: 3 CHANGE IN RISK MANAGEMENT POLICY Chair Delaney explained that the draft Risk Management Policy has been reviewed and she has incorporated all the changes into the policy. There are still questions to be answered and it was concurred to discuss this matter at the next meeting. NOTICE OF ADJOURNMENT Member Alvarez moved to adjourn the meeting at 10:18 a.m. Chair Delaney seconded the motion. The motion carried.
