MINUTES

Chair Lorna Delaney called the meeting to order at 9:30 a.m. in the presence of Member David Alvarez
and Member Philip Morley.
APPROVAL OF MINUTES
Member Alvarez moved to approve the Special Meeting minutes of July 8, 2010 as presented. Member
Morley seconded the motion which carried by a unanimous vote.
EXECUTIVE SESSION
The Committee met in Executive Session from 9:31 a.m. to 9:50 a.m. regarding potential litigation.
This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of
the Executive Session the meeting was reconvened. The committee deliberated and took the following
action.
Claim No.: C-08-10
Claimant: Joe D'Amico, SSNW
Damages: $30,000.00
Allegation: Personal Damage (Business Tort)
The Committee reviewed the details of this claim. This type of claim is covered by the Risk Pool and
Guy Bogdanovich, outside legal counsel has been assigned to handle this claim. No action by the
Committee was taken.

Claimant: Debra Delaire (on behalf of son CJ Delaire)
Damages: Unknown
Allegation: Bodily Injury
The Committee reviewed the details of this claim. The investigation by the Jefferson County Public
Works and the Insurance Adjuster assigned by the Washington Counties Risk Pool reveals that the
County has no liability for this accident. Member Morley moved to prepare a letter expressing regret
that CJ Delaire was injured and inform the claimant that the County is not liable and therefore must deny
claim #C-09-10. Member Alvarez seconded the motion which carried by a unanimous vote. Member
Alvarez will draft a letter for Member Morley's signature.

Allegation:
Vehicle Damage
The Committee reviewed the details of this claim. Based on an internal investigation confirming the
facts as presented to the County by the claimant, the members agreed that the claim should be paid.
Member Morley moved to approve payment of claim #C-10-10 submitted by Bobbi Lee Gunn in the
amount of $1,931.76. A final invoice must be submitted for payment. Member Alvarez seconded the
motion which carried by a unanimous vote.
Member Alvarez moved to direct the Clerk to prepare a claim report and draft a letter to Bobbi Lee
Gunn for the County Administrator's signature regarding the decision made on claim #C-10-10.
Member Morley seconded the motion which carried by a unanimous vote.

Claimant: Nancy Steinberg
Damages: Unknown
Allegation: Bodily Injury
The Committee reviewed the details of this claim. The Washington Counties Risk Pool has assigned an
adjuster to investigate this claim which has not been completed. Member Morley moved to prepare a
letter to Ms. Steinberg indicating regret that she was injured at H. J. Carroll Park and informing her that
her claim is in the process of being reviewed. Member Alvarez will draft a letter for Member Morley's
signature.

SAMPLE CLAIM FOR DAMAGES FORM
The Committee reviewed the sample claim for damages form and made grammatical changes. Member
Alvarez stated that he reviewed the applicable Washington State law and concluded that all the
information that is required by RCW 4.96.020 is asked of the claimant through the claim for damages
form. The `Draft' Claim for Damages form, along with the `Draft' Risk Management Policy are now
ready to be presented to the Jefferson County Board of Commissioners for their review during a future
County Commissioner meeting.
NOTICE OF ADJOURNMENT
Member Morley moved to adjourn the meeting at 10:25 a.m. Member Alvarez seconded the motion
which carried by a unanimous vote.
