HomeMy WebLinkAboutM02112009M'O'Ae, �C RISK MANAGEMENT COMMITTEE February 11, 2009 - 9:30 a.m. MINUTES MEMBERS: David Alvarez, Deputy Prosecuting Attorney Philip Morley, County Administrator/Risk Manager Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair) RECORDER: Erin Lundgren, Deputy Clerk of the Board Chair Lorna Delaney called the meeting to order at 9:30 a.m. in the presence of Members David Alvarez and Philip Morley. APPROVAL OF MINUTES Member Alvarez moved to approve the minutes of October 8, 2008 as presented. Member Morley seconded the motion which carried by a unanimous vote. EXECUTIVE SESSION The Committee met in Executive Session from 9:31 to 9:35 a.m. regarding potential litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the Executive Session the meeting was reconvened and the following deliberations and actions were taken. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: #C-01-09 Claimant: Carol Nydegger Damages: $379.40 Allegation: Damage to Vehicle Window The Committee reviewed the details of this claim and concluded there is inadequate evidence to prove that the damage sustained was the result of an act or omission by County personnel. Additionally, rocks or traction sand material projected upward from the road surface by a tire of any vehicle is considered an ordinary "road hazard" for which the County is not liable. Member Morley moved to deny payment of claim #C-01-09 submitted by Carol Nydegger in the amount of $379.40. Member Alvarez seconded the motion which carried by a unanimous vote. Decision: Denied Risk Management Committee Meeting Minutes - February 11, 2009 Page: 2 Claim No.: #C-02-09 Claimant: Jane Richardson Damages: $336.04 Allegation: Damage to Vehicle/Windshield The Committee reviewed the details of this claim and concluded there is inadequate evidence to prove that the damage sustained was the result of an act or omission by County personnel. Additionally, rocks or traction sand material projected upward from the road surface by a tire of any vehicle is considered an ordinary "road hazard" for which the County is not liable. Member Alvarez moved to deny payment of claim #C-02-09 submitted by Jane Richardson in the amount of $336.04. Member Morley seconded the motion which carried by a unanimous vote. Decision: Denied DIRECTION TO THE CLERK/RECORDER Member Alvarez moved to direct the Clerk to prepare the claim reports for signature regarding the decision made on each claim and to send a letter notifying the claimants of the decisions. Member Morley seconded the motion which carried by a unanimous vote. NOTICE OF ADJOURNMENT Member Alvarez moved to adjourn the meeting at 9:45 a.m. Member Morley seconded the motion which carried by a unanimous vote.
