HomeMy WebLinkAboutM04082009g4N CO w ti �: _ �14 G'0� IN RISK MANAGEMENT COMMITTEE April 8, 2009 - 9:30 a.m. MINUTES MEMBERS: David Alvarez, Deputy Prosecuting Attorney Philip Morley, County Administrator/Risk Manager Lorna Delaney, Clerk of the Board/Risk Coordinator (Chair) RECORDER: Erin Lundgren, Deputy Clerk of the Board In the absence of Chair Lorna Delaney, Acting -Chair David Alvarez called the meeting to order at 9:30 a.m. in the presence of Member Philip Morley. APPROVAL OF MINUTES Member Morley moved to approve the minutes of March 11, 2009 as presented. Acting -Chair Alvarez seconded the motion. The motion carried. EXECUTIVE SESSION The Committee met in Executive Session from 9:31 to 9:45 a.m. regarding potential and actual litigation. This exemption is outlined in the Open Public Meetings Act RCW 42.30.110(1)(i). At the conclusion of the Executive Session the meeting was reconvened and the following deliberations and actions were taken. CLAIMS FOR DAMAGES DISCUSSION AND POSSIBLE DECISION Claim No.: #C-03-09 Addendum Claimant: John Lantz Damages: $51.80 Allegation: Damage to Water Line The Committee reviewed the facts relating to this claim. Internal investigation confirms the facts as presented to the County by the claimant. Acting -Chair Alvarez moved to recommend that the additional charges referenced in the addendum to claim #C-03-09 submitted by John Lantz be paid in full in the amount of $51.80. Member Morley seconded the motion. The motion carried. Decision: Pay Claim Risk Management Committee Meeting Minutes - April 8, 2009 Page: 2, Small Claims Suit No.: #18-09 Claimant: Meg Amos Damages: $1,402.49 plus $29.00 filing fee Allegation: Damage to Vehicle/Windshield Acting -Chair Alvarez explained that Meg Amos has filed a small claims suit in District Court for damages to her vehicle she alleges were caused by rocks thrown from equipment being operated by County Road Crew personnel. The case is scheduled to be heard on July 17, 2009 at 2:00 p.m. The Committee discussed various options for settling the case prior to mediation. Acting -Chair Alvarez moved that Member Morley call Meg Amos with an offer of $1,000 to settle the case out of Court. Member Morley seconded the motion for discussion and suggested that Meg Amos be offered the option to either settle the case for $1,000 or the amount of her insurance deductible for having the vehicle repaired. Acting -Chair Alvarez agreed and amended his motion that Meg Amos be offered the two options. Acting -Chair Alvarez called for a vote on the amended motion. The motion carried. Decision: Settle Case (After the meeting, Philip Morley sent an e-mail (copy attached) to the recorder and members of the Risk Management Committee informing them that he had spoken by telephone with Meg Amos and offered to settle the case for either $1,000 or the amount of her deductible if she wants to put it through her insurance. Meg Amos is considering the offer and will respond within a few days after discussing the matter with her husband.) (David Alvarez responded by e-mail (copy attached) stating that the e-mail sent by Philip Morley to all members of the Risk Management Committee, constitutes a public meeting of the Risk Management Committee and therefore the entire e-mail chain needs to be part of the minutes for the April 8, 2009 meeting.) DIRECTION TO THE CLERK/RECORDER The Clerk was directed to prepare the claim report for signature regarding the decision made on the addendum to claim #C-03-09 and to send a letter notifying the claimant of the decision. NOTICE OF ADJOURNMENT Acting -Chair Alvarez moved to adjourn the meeting at 9:50 a.m. Member Morley seconded the motion. The motion carried. She is considering our offer, wishes to discuss it with her husband, and will let us know if they want to accept either settlement offer within a few days. I'll keep you posted.
